All that part of said city bounded as follows: Beginning at the junction of Broadway and Spring street, thence westerly through the center of Spring street to Hudson street, thence south sixty-two degrees west to the center line of the West Shore railroad, thence northerly along the center line of said West Shore railroad to the center of O'Reilly street, thence northeasterly along the center line of O'Reilly street to the center of Mary's avenue, thence southerly along the center line of Mary's avenue to Ohio street, thence northeasterly along the center line of Ohio street to the center of Jervis avenue, thence southeasterly along the center line of Jervis avenue, to the center of Orchard street, thence northeasterly along the center line of Orchard street to the center of Broadway, thence southerly along the center line of Broadway to the place of beginning, shall be known as ward number eight.

NINTH WARD.

All that part of said city bounded as follows: Beginning at the junction of the center line of Broadway and the center line of the West Shore railroad, thence southerly along the center line of said West Shore railroad to the center of O'Reilly street, thence northeasterly along the center line of O'Reilly street to the center of Mary's avenue, thence southerly along the center line of Mary's avenue to Ohio street, thence northeasterly along the center line of Ohio street to the center of Jervis avenue, thence southeasterly along the center line of Jervis avenue to the center of Orchard street, thence northeasterly along the center line of Orchard street to the center of Broadway, thence northerly along the center line of Broadway to the place of beginning, shall be known as ward number nine.

TENTH WARD.

All that part of said city bounded as follows: Beginning at the junction of the center line of Broadway and the center line of the West Shore railroad, and running thence northerly along the center line of Broadway to Saint James street, thence westerly along the center line of Saint James street to Clinton avenue, thence southerly along the center line of Clinton avenue and Clinton avenue prolonged to the center line of the West Shore railroad, thence northeasterly along the said center line of said railroad to the place of beginning, shall be known as ward number ten.

ELEVENTH WARD.

All that part of said city bounded as follows: Beginning at the junction of the center line of Clinton avenue and the center line of the Wallkill valley railroad and running thence northerly along the center line of Clinton avenue to Saint James street, thence westerly along the center line of Saint James street to Wall street, thence southerly along the center line of Wall street to Linderman avenue, thence southwesterly along the center line of Linderman avenue to the westerly bounds of the city, thence southerly along said westerly bounds to the center line of the Wallkill valley railroad, thence northeasterly along the center line of said railroad to the place of beginning, shall be known as ward number eleven.

TWELFTH WARD.

All that part of said city bounded as follows: Beginning at a point on the city line in the middle of the Esopus creck where the center of Converse street, formerly Frog alley, prolonged northerly will strike the city line and running thence southerly along the said prolonged line and the center line of said Converse street to the center of North Front street, thence easterly through the center of North Front street to the center line of Green street, thence southerly along the center line of Green street. to the center of Saint James street, thence easterly along the center line of Saint James street to the center of Wall street, thence southerly along the center line of Wall street to Linderman avenue, thence southwesterly along the center line of Linderman avenue to the westerly bounds of the city, thence northerly along said westerly bounds to the center of the Esopus creek, thence down and along the center of said creek to the place of beginning, shall be known as ward number twelve.

THIRTEENTH WARD.

All that part of the said city bounded as follows: Beginning at the center of the Rondout creek, the southwesterly corner of said city, thence easterly along the center of said creek to the westerly bounds of ward number seven, thence along the westerly bounds of ward number seven, north twenty-eight degrees west to the southerly bounds of ward number eight, thence along the southerly bounds of ward number eight south sixty-two degrees west to the center line of the West Shore railroad, thence northerly along the center line of said railroad to a point on the prolongation southerly of the center line of Clinton avenue, thence northerly along said prolongation and the center line of Clinton avenue to the center line of the Wallkill valley railroad, thence southwesterly along the center line of said Wallkill valley railroad to the westerly bounds of the city, thence southerly along said westerly bounds to the place of beginning, shall be known as ward number thirteen.

§ 2. Section eight of title two of said act is hereby amended to read as follows:

§ 8. All city officers elected under this act shall enter upon their respective offices the first day of January following the election, at noon of said day. And the common council shall then organize and elect a presiding officer. If January first shall fall on Sunday then such organization shall be effected the following Monday at In case the common council shall fail to elect a presiding officer on or before the second Friday of January in any year, that then and in that case the mayor may at any time thereafter appoint any member of said common council as such presiding officer, who shall serve as such presiding officer until the following first day of January at noon.

§ 3. Section eleven of title two of said act is hereby amended to read as follows:

11. At the general election to be held in November, nineteen hundred and six, no city officers shall be elected except members of the board of education as provided in section one hundred and sixty-two, title fifteen of this act. At the general election to be held in November, nineteen hundred and seven, there shall be elected a mayor, supervisors, members of the board of education and one alderman from each ward. At the general election to be held in November, nineteen hundred and eight, there shall be elected a recorder, a judge of the city court and members of the board of education. The aldermen elected at the general election

held in November, nineteen hundred and four are hereby continued in office until the first day of January, nineteen hundred and eight, at noon. Successors to the mayor, recorder, judge of the city court, supervisors, members of the board of education and aldermen shall be elected at the general election held in November preceding the expiration of their several terms.

§ 4. Section twelve of title three of said act is hereby amended to read as follows:

§ 12. The elective offices of the city shall be a mayor, recorder, judge of the city court, and members of the board of education, to be elected at large and one supervisor to be elected from each of the seven departments hereinafter mentioned, and one alderman to be elected from each ward. For the election of supervisors, the first ward shall constitute the first department; the second and third wards the second department; the fourth and fifth wards the third department; the sixth and seventh wards the fourth department; the eighth and thirteenth wards the fifth department; the ninth and tenth wards the sixth department and the eleventh and twelfth wards the seventh department.

§ 5. Section thirteen of title three of said act is hereby amended to read as follows:

13. The terms of office of said officers shall be as follows: Mayor, two years; recorder and judge of the city court, three years; members of the board of education, five years; aldermen and supervisors, two years.

§ 6. Section fourteen of title three of said act is hereby amended to read as follows:

§ 14. The appointive officers of said city shall be a clerk, corporation counsel, city treasurer, city engineer, superintendent of streets, sewers and city property, an assessor, four police commissioners, five water commissioners, one commissioner of alms from the first and second wards, one from the third and fourth wards, one from the fifth and sixth wards, one from the seventh and eighth wards, one from the ninth and tenth wards, one from the eleventh and twelfth wards, and one from the thirteenth ward; a chief engineer of the fire department, a collector of unpaid taxes and assessments, a poundmaster, a sealer of weights and measures, a janitor of the city hall, members of the board of health and of the examining and supervising board of plumbers and plumbing and such inspectors of election as may be provided by law.

§ 7. Section fifteen of title three of said act is hereby amended to read as follows:

15. The clerk, corporation counsel, city treasurer, city engineer, superintendent of. streets, sewers and city property; the assessor, chief engineer of the fire department, collector of unpaid taxes and assessments, sealer of weights and measures, janitor of the city hall and poundmaster shall be appointed by the mayor. Such appointees shall hold office during the pleasure of the mayor, and may at any time be removed from office by the mayor.

8. Section seventeen of title three of said act is hereby amended to read as follows:

17. The members of the board of health, health officer, meinbers of the examining and supervising board of plumbers and plumbing, inspectors of election and such other appointive officers as may be authorized by general laws shall be appointed in pursuance of such general laws, which shall regulate all appointments to such offices, except that members of the board of health shall be freeholders.

§ 9. Section nineteen of title three of said act is hereby amended to read as follows:

§ 19. A person shall not be elected or appointed to any city office unless he be a resident elector of said city, nor to any ward, district or department office unless he be a resident elector of the ward, district or department for which he is elected or appointed, and whenever any officer of said city ceases to be a resident of said city or the ward, district or department, for which he is elected or appointed his office shall thereby become vacant. The mayor, supervisors, aldermen, assessor, alms, police and water, commissioners shall be taxpayers of said city, whose names shall appear as taxpayers upon the last general tax roll of said city, preceding their several elections or appointments, and the election or appointment of a person to any of such offices whose name shall not appear upon such tax roll shall be null and void.

§ 10. Section thirty of title four of said act is hereby amended to read as follows:

$30. Each alderman of said city shall attend the regular and special meetings of the common council; act upon committees when thereunto appointed; arrest or cause to be arrested all persons violating the laws of the state or the ordinances, by laws or police regulations of the city; report to the mayor all subordinate officers who are guilty of official misconduct or negleet of duty; aid in maintaining peace and good order in the city and perform or assist in performing all duties enjoined upon the aldermen of said city separately or upon the common council thereof.
