RATS.

Indorsement from Special Agent Shearer, forwarding a resolution of the provincial board of Ambos Camarines, recommending favorable consideration of resolution of municipal council of San José, in said province, requesting the sum of 500 for the extermination of the rats which cause much destruction to the crops. The committee resolved to lay this matter on the table.

MATTERS FORWARDED BY THE SPEAKER.

Telegram from the Speaker of the Assembly, recommending that the Joint Committee study Assembly Bill No. 305, entitled “An Act reëstablishing the office of provincial engineer, amending the Provincial Government Act and its amendments." The committee resolved to refer the same to the subcommittee on Commerce and Police, upon the definitive approval of the designation of subcommittees.1

OTHER MATTERS.

Resolution of the provincial board of Palawan, requesting a certain sum from the calamity funds for the purchase of 300 sacks of rice to be distributed among certain Moros who are about to remove from one point of the province to another where they can be more under control, for the security of the peace and safety of the Christian inhabitants. The committee resolved to deny this request.

Communication from the provincial treasurer of Tayabas, asking for information as to whether certain work authorized by the provincial board can be paid for with the balance of the funds appropriated by the committee as relief for the sufferers from the inundation that occurred in said municipality. The committee resolved to request the immediate return of said balance to the Insular Treasury, to the credit of the committee.

Resolution of the provincial board of Tayabas, forwarding a communication from the municipal president of Baler, stating that the provincial treasurer has returned the pay roll of the laborers on the Baler-Pantabangan Road, with the information that the #613 remaining over from the 1,000 donated to said municipality had already been returned to the Insular Treasury, by request of the committee, wherefore the board asks that said sum be again made available for the payment of the laborers, without prejudice to the refund of the balance thereof. The committee resolved to grant this request.

Communication from the municipal president of Sampaloc, Tayabas, forwarding a resolution of the municipal council of said municipality, requesting that the Joint Committee secure from the Philippine Legislature the passage of an Act authorizing a reassessment of real estate for 1912. The committee resolved that a copy of this resolution be sent to both Houses.

The Journal of Friday, November 3, 1911, was read and approved.

EXECUTIVE SESSION.

The Commission then went into executive session for the purpose of perfecting its annual report to the Secretary of War for the fiscal year ending June 30, 1911.

At 12 o'clock and 10 minutes postmeridian, the Commission returned to regular session.

The Commission met at 10 o'clock and 30 minutes antemeridian at the call of the Chair.

Present: Commissioners Gilbert, Luzuriaga, Araneta, Palma, Sumulong, Branagan, and Elliott.

Absent: The President, and Commissioner Worcester (on official business).

READING OF JOURNAL.

The Journal of Saturday, November 4, 1911, was read and approved.

EXECUTIVE SESSION.

The Commission then went into executive session to continue work on its annual report to the Secretary of War for the fiscal year ending June 30, 1911.

Having completed the annual report, the Commission returned to regular session.

SECOND READING OF BILLS.

Commission Bill No. 123. An Act to amend Act Numbered Nineteen hundred and sixty-three, by extending the leave and other privileges of the Revised Civil Service Act to officers and employees of the city of Baguio.

Commission Bill No. 123 was read the second time and referred to the Committee of the Whole.

It was considered in committee and reported back to the Commission with the recommendation that it pass.

The report and recommendation of the Committee of the Whole were adopted by unanimous vote.

On motion by Commissioner Gilbert, unanimously carried, The bill was considered urgent under the provisions of Rule XIV, Rules of the Commission, and read the third time by title only.

The question then being upon its passage, the roll was called and the bill was passed.

Commissioner Araneta moved to amend the title by inserting before the word "officers" in the third line the words "all regularly and permanently appointed."

The motion prevailed.

Commissioner Branagan then moved to amend the title by adding after the words "Act Numbered Nineteen hundred and sixty-three" the words "entitled 'An Act to incorporate the city of Baguio, and for other purposes.'"

The motion prevailed, and the title as amended was read and approved.

Ordered, That Commission Bill No. 123 be enrolled and printed as an Act, the enactment of same being within the exclusive general legislative jurisdiction of the Commission over that part of the Philippine Islands inhabited by Moros and other non-Christian tribes.

Assembly Bill No. 648. An Act establishing and defining the legal rate of interest, and declaring the effect of usury upon contracts, and for other purposes.

Assembly Bill No. 648 was read the second time and referred to the Committee of the Whole.

It was considered in committee and reported to the Commission with the recommendation that it pass with the following amendment:

Section 1, page 1, lines 1 to 5, strike out the words "Interest for any legal indebtedness shall be at the rate of six per centum per annum, unless a different rate not inconsistent with the provisions of this Act is contracted for in writing as provided by article eleven hundred and eight of the Civil Code" and insert in lieu thereof the following: "Interest for any legal indebtedness shall be at the rate of six per centum per annum as provided by article eleven hundred
