The Commission met at the call of the Chair at 10 o'clock and 30 minutes antemeridian.

Present: Commissioners Gilbert, Luzuriaga, Araneta, Palma, Sumulong, Branagan, and Elliott.

Absent: The President, and Commissioner Worcester (on official business).

READING OF JOURNAL.

The Journal of Saturday, October 28, 1911, was read and approved.

MESSAGES FROM THE ASSEMBLY.

OCTOBER 28, 1911.

MR. PRESIDENT: I have been directed to inform your honorable body that the Assembly on October 26, 1911, passed the following bill (A. B. No. 634) in which it requests the concurrence of the Commission: An Act authorizing the Governor-General of the Philippines, or the person acting legally in his stead, to postpone, reduce, remit and annul, or in any other manner compromise, in part or in whole, the confiscation and execution of bonds in criminal cases, and to order the return of moneys, or other personal property confiscated from private parties by the American military authorities during the revolution, under certain conditions.

By unanimous consent, Assembly Bill No. 634 was read the first time by title only and referred to the Committee on Matters Pertaining to the Department of Finance and Justice for report and recommendation.

OCTOBER 28, 1911.

MR. PRESIDENT: I have been directed to inform your honorable body that the Assembly on October 27, 1911, passed the following bill (A. B. No. 648) in which it requests the concurrence of the Commission: An Act establishing and defining the legal rate of interest, and declaring the effect of usury upon contracts, and for other purposes.

By unanimous consent, Assembly Bill No. 648 was read the first time by title only and referred to Commissioner Elliott as a select committee for report and recommendation. CHANGE OF REFERENCE OF RECOMMENDATION OF GOVERNORGENERAL REGARDING USURY LAW.

On motion by Commissioner Araneta, the recommendation contained in the Governor-General's message to the Legislature of October 16, 1911, for the enactment of a law on the subject of usury, heretofore referred to the Committee on Matters Pertaining to the Department of Finance and Justice, was recalled from said committee and its reference to Commissioner Elliott as a select committee for consideration in connection with Assembly Bill No. 648 was directed.

REPORTS OF STANDING COMMITTEES.

[Committee Report No. 250.]

MR. PRESIDENT: Your Committee on Taxation and Revenue, to which was referred on October 17, 1911, a petition from the municipal council of the municipality of Sampaloc, Tayabas Province, asking for a general reassessment of all real estate in 1913, has examined the same and has the honor to report it back to the Commission with the recommendation that further consideration of the petition be deferred until the matter of taking a general census is taken up.

Your committee believes that a general assessment of property for taxation should be made not later than 1913, as petitioned for, but,

unless undertaken in connection with the taking of a general census. the next session of the Legislature can provide for it. If a census is to be taken, Special Agent R. M. Shearer recommends that the assessment of real property be made at the same time, "using the field organization of the Bureau of Education as a nucleus" for the force. Respectfully submitted.

The report was adopted.

[Committee Report No. 251.]

MR. PRESIDENT: The Committee on Matters Pertaining to the Department of Finance and Justice, to which was referred on October 17, 1911, resolution No. 132 of the provincial board of Occidental Negros adopted on December 29, 1910, and resolution No. 35 of the assembly of municipal presidents of the Province of Occidental Negros adopted on January 5, 1911, praying for the passage of a special Act punishing cattle theft, has examined the same and has the honor to report it back to the Commission with the following recommendation, viz:

That the matter be laid on the table.

The object of this recommendation is the passage of a law to provide that justice of the peace courts shall have jurisdiction in cases of theft of work animals where the value of the animal or animals stolen does not exceed 6,250 pesetas.

In the opinion of the undersigned no good reason exists for the passage of the proposed Act.

RESOLUTION.

Commissioner Gilbert introduced the following resolu

tion:

Commission Resolution No. 77. Resolved, That that portion of Commission Resolution Numbered Fifty-one of December eighth, nineteen hundred and ten, providing for the distribution of the re

print of the handbook entitled "Philippine Commission, Legislative Procedure," is hereby repealed and the following distribution directed:

To the Governor-General (two copies),

Other members of the Commission (two copies each),
Speaker of the Assembly (one copy),

Members of the Assembly (one copy each),
Resident Commissioners (one copy each),

Secretary of the Commission (three copies),

Secretary of the Assembly (three copies),

Private secretaries to Commissioners (one copy each),
Executive Secretary (six copies);

and,

Resolved further, That copies remaining after the foregoing distribution has been made may be sold or distributed free in the discretion of the Secretary of Public Instruction in accordance with the provisions of Act Numbered Sixteen hundred and sixty.

The resolution was adopted.

INTRODUCTION OF BILL.

Commissioner Araneta introduced the following bill:

Commission Bill No. 120. An Act to amend section two of Act Numbered Nineteen hundred and fifty-two, entitled "An Act to provide for the establishment of the Province of Batanes; to amend paragraph seven of section sixty-eight of Act Numbered Eleven hundred and eighty-nine in certain particulars; to authorize the provincial board of the Province of Batanes, with the approval of the Governor-General, to extend the time for the payment without penalty of taxes and licenses; to amend section five of Act Numbered Fifteen hundred and eighty-two, entitled 'The Election Law,' by increasing the number of delegates to the Philippine Assembly to eighty-one, and for other purposes," by providing for a provincial fiscal for the Province of Batanes.

Commission Bill No. 120 was read the first and second times and referred to the Committee of the Whole.

It was considered in Committee and reported back to the Commission with the recommendation that it pass.

The report and recommendation of the Committee of the Whole were adopted, and the bill ordered on file for third reading.

EXECUTIVE SESSION.

The Commission then proceeded to the consideration of executive business.

After the consideration of executive business, the Commission returned to regular session.

ADJOURNMENT.

The Commission adjourned to meet at 10 o'clock and 30 minutes antemeridian on Tuesday, October 31, 1911.
