DECEMBER 9, 1911. MR. PRESIDENT: I have been directed to inform your honorable body that the Assembly on December 9, 1911, passed the following (A. C. R. No. 11), in which it requests the concurrence of the Commission: Concurrent Resolution authorizing the Executive Secretary to make contracts with two American and two Filipino newspapers for the publication of official advertisements.

By unanimous consent, Assembly Concurrent Resolution No. 11 was read the first time by title only and referred to the Committee on Matters Pertaining to Bureaus under the Executive Control of the Governor-General for report and recommendation.

Commissioner Araneta entered the Session Chamber at this point.

REPORT OF STANDING COMMITTEE.

[Committee Report No. 312.]

MR. PRESIDENT: The Committee on Municipal and Provincial Governments, to which was referred on December 1, 1911, Assembly Bill No. 707, entitled "An Act amending Act Numbered Nineteen hundred and seventy-nine by granting a donation in money, to be paid from provincial funds, to families of unclassified employees, including laborers, of the provincial government, injured in the clear line of duty, has examined the same and has the honor to report it back to the Commission with the following recommendation, viz:

That the accompanying bill be passed with the following amendment:

On page 1, line 14, strike out the words "their families,” and insert in lieu thereof the words "the family of the deceased employee or laborer," so that section 1 of the bill shall read as follows:

"SECTION 1. Paragraph three of section one of Act Numbered Nineteen hundred and seventy-nine is hereby amended to read as follows:

"To provide, in its discretion, for the payment from provincial funds of their regular compensation during the period of their disability, not exceeding ninety days, to unclassified employees of the provincial government, including laborers, when said employees or laborers are injured in the clear line of duty; the necessary expenses of medical attendance, transportation, and hospital fees for such injured employees or laborers, and in case of their death from

said injuries, their reasonable burial expenses may likewise, in the discretion of the provincial board, be paid from provincial funds; and a donation in money may be granted the family of the deceased employee or laborer in a sum, not exceeding ninety days' pay, which shall be in accord with his efficiency and services to the Government.'

The portion of Act No. 1979 which it is intended to amend authorizes provincial boards to pay, for a period not exceeding ninety days, the regular compensation of unclassified employees and laborers in the service of the provincial government, when said employees and laborers are incapacitated for work by injuries received in the clear line of duty; but in case such employees or laborers die suddenly, as a result of such injuries, or if the lapse of time between the injury and the date of death is less than ninety days, it would either not be possible to pay compensation to such employees or laborers, or their families, or the compensation paid would necessarily be inadequate, as it would have to consist of the ordinary compensation of the employee or laborer for the short time at the expiration of which his injury caused death, since Act No. 1979, as it stands, does not authorize the payment of the compensation above mentioned on account of death, but for incapacitation for work. The consequence is that employees or laborers incapacitated for work for a longer or shorter period are treated more liberally than those who die from injuries received as mentioned. This injustice the attached bill endeavors to remedy by giving the employee or laborer who dies the same status as the one merely incapacitated for work, and granting to the family of the former a donation in a sum not exceeding ninety days' pay.

The purpose of the amendment suggested by your committee is to make it evident that the donation mentioned will be granted only to the families of employees or laborers who died, and not to those of employees or laborers incapacitated for work for more or less time.

Assembly Bill No. 707 was thereupon read the second time and, together with the report of the Committee on Municipal and Provincial Governments thereon, referred to the Committee of the Whole.

It was considered in committee and reported back to the Commission with the following recommendation:

That the amendment recommended by the standing committee be concurred in;

That the bill be further amended as follows:

Strike out lines 1, 2, and 3 and insert in lieu thereof the following: "SECTION 1. The second paragraph of subsection (nn) of section thirteen of Act Numbered Eighty-three, entitled "The Provincial Government Act,' as amended, is hereby further amended to read as follows."

Strike out in lines 13 and 14 the words "may likewise in the discretion of the provincial board be paid from provincial funds;" and strike out in lines 14 and 15 the words "may be granted" and insert in lieu thereof the word "to."

Strike out section 2 in its entirety.

And that as so amended the bill pass.

The report and recommendation of the Committee of the Whole were adopted, and the bill ordered on file for third reading.

EXECUTIVE SESSION.

The Commission proceeded to the consideration of executive business.

After the consideration of executive business, the Commission returned to regular session.
