The Commission met at the call of the Chair at 10 o'clock and 30 minutes antemeridian.

Present: Commissioners Gilbert, Luzuriaga, Araneta, Palma, Sumulong, Branagan, and Elliott.

Absent: The President, and Commissioner Worcester (on official business).

READING OF JOURNAL.

The Journal of Thursday, November 23, 1911, was read and approved.

THIRD READING OF BILL.

Assembly Bill No. 79. An Act to provide Government scholarships for young Filipinos who shall have completed any professional course of study or who are otherwise licensed or authorized to practice scientific, artistic, or industrial professions, in order that they may continue their studies in the higher educational institutions in America or in Europe, and for other purposes.

Assembly Bill No. 79 was read the third time.

Commissioner Araneta moved the following amendment: Section 5, page 3, line 9, strike out the words "protection, care, and welfare" and insert in lieu thereof the words "care, protection and welfare.”

The motion prevailed.

The question then being upon its passage, the roll was called and the bill was passed.

Commissioner Gilbert moved to amend the title to read as follows:

An Act to provide Government fellowships for persons who shall have studied and completed some professional, technical, scientific, artistic, or industrial course in certain institutions and received a degree therefrom, in order that they may continue their studies in the higher educational institutions of America or Europe, and for other purposes.

The motion prevailed, and the title as amended was read and approved.

Ordered, That the Secretary request the concurrence of the Assembly in the amendment of the Commission.

REPORTS OF STANDING COMMITTEE.

[Committee Report No. 296.]

MR. PRESIDENT: The Committee on Matters Pertaining to the Department of Commerce and Police, to which was referred on October 20, 1911, resolution No. 43 of the convention of municipal presidents of Occidental Negros indorsing Assembly Bill No. 235, entitled "An Act making provisions with respect to the municipal police," has examined the same and has the honor to report it back to the Commission with the following recommendation, viz:

The proposed law contains some good features, but it is recommended that the matter be laid on the table until the bill is received from the Assembly in due course.

MR. PRESIDENT: The Committee on Matters Pertaining to the Department of Commerce and Police, to which was referred on November 22, 1911, Assembly Bill No. 226, entitled "An Act granting a prize of fifteen thousand pesos to the inventor of an incombustible roof to substitute nipa, and creating a technical board to pass upon the conditions of the invention," has examined the same and has the honor

to report it back to the Commission with the following recommendation, viz:

That the bill be passed.

The report was adopted.

Assembly Bill No. 226 was read the second time and referred to the Committee of the Whole.

It was considered in committee and reported to the Commission with the recommendation that it pass with the following amendment:

Section 1, page 1, lines 2 and 3, strike out the words "to be paid out of Insular funds not otherwise appropriated," and in lines 7 and 8, strike out the words "not more costly than nipa” and insert in lieu thereof the words "as economical as nipa."

Section 2, page 2, lines 1 to 12, inclusive, strike out the words "The form and conditions in which the competition shall be conducted and the determination of the question relating to the cost of the roofing or system invented, as indicated in the next preceding section, shall be subject to the rules adopted on the twenty-ninth of August, nineteen hundred and eight, by the Technical Board appointed by the Governor-General under the provisions of Act Numbered Eighteen hundred and thirty-eight: Provided, however, That in awarding the prize authorized by this Act to an inventor it shall be sufficient for him to have obtained an average of seventy-five points: And provided further," and insert in lieu thereof the words "Subject to the approval of the Governor-General, the board provided for in this section shall prescribe the form and conditions in which the competition shall be conducted, and shall determine the question relative to the cost of the roofing, or system invented which are indicated in the next preceding section: Provided, however.”

Section 6, page 3, strike out in its entirety and insert in lieu thereof the following:

"SEC. 6. For the purpose of carrying out the provisions of this Act there is hereby appropriated, out of any funds in the Insular Treasury not otherwise appropriated, the sum of fifteen thousand pesos."

The report and recommendation of the Committee of the Whole were adopted, and the bill ordered on file for third reading.

THE COMMITTEE OF THE WHOLE ON COMMISSION BILL NO. 138.

The Commission then proceeded to the consideration in Committee of the Whole of Commission Bill No. 138, entitled "An Act to amend Act Numbered Six hundred and sixty-six, entitled 'An Act defining property in trade-marks and in trade-names and providing for the protection of the same, defining unfair competition and providing remedies against the same, providing registration for trade-marks and trade-names, and defining the effect to be given to registration under the Spanish royal decree of eighteen hundred and eighty-eight relating to the registration of trade-marks, and the effect to be given to registration under this Act,' by providing for the publication of applications for registration of trade-marks and trade-names and for the filing of opposition to such registration by persons considering themselves damaged thereby, and forbidding the importation of certain merchandise, and for other purposes." After some consideration the committee rose and reported with the recommendation that the bill pass.

The report and recommendation of the Committee of the Whole were adopted.

On motion by Commissioner Gilbert, unanimously carried, The bill was considered urgent under the provisions of Rule XIV, Rules of the Commission, and read the third time by title only.

The question then being upon its passage, the roll was called and Commission Bill No. 138 was passed, and the title read and approved.

Ordered, That the Secretary request the concurrence of the Assembly in the bill as passed.

Commissioner Elliott was absent during the proceedings on this bill.

THIRD READING OF BILL.

On motion by Commissioner Araneta,

Commission Bill No. 136, entitled "An Act repealing sections seven hundred and fifty-five, seven hundred and fifty-six, seven hundred and fifty-seven, seven hundred and fifty-eight, and seven hundred and sixty of Act Numbered
