FRIDAY, NOVEMBER 17, 1911.

The Commission met at the call of the Chair at 10 o'clock and 30 minutes antemeridian.

Present: Commissioners Gilbert, Luzuriaga, Araneta, Palma, Sumulong, and Elliott.

Absent: The President, Commissioner Worcester (on official business), and Commissioner Branagan (excused). Commissioner Gilbert in the chair.

READING OF JOURNAL.

The Journal of Thursday, November 16, 1911, was read and approved.

REPORTS OF STANDING COMMITTEES.

[Committee Report No. 285.]

MR. PRESIDENT: The Committee on Municipal and Provincial Governments, to which was referred on the 2d of November, 1911, resolution No. 208 of the municipal council of Urdaneta, Pangasinan, petitioning the Legislature for an Act granting to each councilor of the municipalities of the Philippine Islands a per diem of #5 for each regular session of the council attended by him and another per diem of 10 for each special session, in addition to a salary of 15 a month for the service rendered by him to the Bureau of Agriculture, has examined the same and has the honor to report it back to the Commission with the following recommendation, viz: That the petition be laid on the table.

The request made would perhaps be more worthy of consideration

if the municipalities of these Islands had sufficient funds to pay the increased expenditure caused by the appropriation by each municipality of the amounts necessary to cover the cost of the per diems and salaries solicited in said resolution; but unfortunately, with the exception of Cebu and Iloilo, all of the other municipalities in the provinces have not sufficient revenues to cover the necessaries of a provident and well-organized municipal administration, this being the reason why at times certain deficiencies and consequent shortcomings are noted in certain branches of the municipal administration. Therefore, your committee is of the opinion that the petition should be denied so long as the economic conditions of the municipalities show no better results.

MR. PRESIDENT: The Committee on Matters Pertaining to the Department of Finance and Justice, to which was referred on October 17, 1911, Commission Bill No. 25, entitled "An Act regulating the registration, branding, conveyance, and slaughter of large cattle; providing for the disposition, care, custody, and sale of estrays and large cattle captured or seized; providing for the surrender of certificates of ownership, and so forth, of dead cattle and those transferred, slaughtered, lost, and so forth, providing penalties for noncompliance with its provisions and for theft, robbery, and so forth, of large cattle; repealing all prior laws, ordinances, and regulations inconsistent with its provisions, and for other purposes,” has examined the same and has the honor to report it back to the Commission with the following recommendation, viz:

That this bill be referred to the Committee on Matters Pertaining to the Department of Public Instruction as a matter pertaining to that Department rather than to the Department of Finance and Justice. Respectfully submitted.

EXECUTIVE SESSION.

The Commission then proceeded to the consideration of executive business, particularly the report of the Secretary of Commerce and Police for the fiscal year ending June 30, 1911.

After consideration of executive business, the Commission returned to regular session.

MESSAGES FROM THE ASSEMBLY.

NOVEMBER 17, 1911.

MR. PRESIDENT: I have been directed to inform your honorable body that the Assembly on November 16, 1911, passed the following Assembly Bill (A. B. No. 795), in which it requests the concurrence of the Commission: An Act to fix the amount of the gold-standard fund, created under Act Numbered Nine hundred and thirty-eight, authorizing the deposit of the excess of the amount so fixed to the credit of the general fund of the Treasury and authorizing the investment of a portion of the said gold-standard fund.

By unanimous consent, Assembly Bill No. 795 was read the first time by title only.

Commissioner Elliott moved that the bill be referred to a select committee to be composed of the President of the Commission and two other members to be named by him. The motion was seconded by Commissioner Araneta, and being put to a vote was carried.

Commissioners Araneta and Elliott were then named as the two other members of the committee.

NOVEMBER 17, 1911.

MR. PRESIDENT: I have been directed to inform your honorable body that the Assembly, on November 17, 1911, agreed to the amendments of the Commission to Assembly Bill No. 668, entitled "An Act providing that the annual tax on the assessed value of the real estate of the city of Manila for the year nineteen hundred and twelve shall be one per centum thereof."

MR. PRESIDENT: The Committee on Matters Pertaining to the Department of Finance and Justice, to which was referred on October 17, 1911, Assembly Bill No. 140, entitled "An Act to amend section thirty-four of Act Numbered Eleven hundred and forty-seven, entitled 'An Act regulating the registration, branding, conveyance, and slaughter of large cattle, and providing for the disposition, care, custody, and sale of estrays or large cattle captured or seized by the Philippines Constabulary or other peace officers, and repealing Act Numbered Six hundred and thirty-seven and so much of Act Numbered Eight hundred and seventy-seven as provides for the disposition, care, custody, or sale of cattle, carabaos, horses, and animals of the bovine family, and all other Acts or parts of Acts inconsistent with the provisions of this Act,' by exempting the owners of large cattle over two years of age who voluntarily present the same for branding and registration from the penalty established in said Act, and repealing in such case section forty of Act Numbered Sixteen hundred and twenty-seven," has examined the same and has the honor to report it back to the Commission with the following recommendation, viz:

That this bill be referred to the Committee on Matters Pertaining to the Department of Public Instruction as a matter pertaining to
