CHAPTER XLI.

An act to repeal an act entitled "An act to incorporate the Burlington and Willingboro' Turnpike Company," approved March twenty-first, anno domini one thousand eight hundred and fifty-five.

WHEREAS, That portion of the Burlington and Willingboro' Preamble. turnpike situate in the township of Burlington, in the county of Burlington, and state of New Jersey, has been purchased by the inhabitants of said township; and whereas, the residue of said turnpike has been for some time past virtually abandoned by the said turnpike company in neglecting to make any repairs upon the same, thereby rendering it not only difficult, but dangerous to travel upon; and whereas, it is the wish of the stockholders that the charter be repealed, and the said turnpike declared to be a public road; therefore,

1. BE IT ENACTED by the Senate and General Assembly of the Act of State of New Jersey, That the act entitled "An act to incor- 1855, reporate the Burlington and Willingboro' Turnpike Compa- pealed. ny," approved March twenty-first, anno domini one thous and eight hundred and fifty-five, be and the same is hereby repealed, and that the said turnpike shall be deemed and taken to be a lawful public road, and shall be kept in repair in the same manner and by the same means, and shall be subject to the same penalties as other public roads are in the several townships through which the same may pass.

2. And be it enacted, That this act shall be deemed and taken to be a public act and shall take effect immediately. Approved February 17, 1874.

CHAPTER XLIII.

An act to incorporate the West Jersey Orphanage for Destitute Colored Children.

1. BE IT ENACTED by the Senate and General Assembly of the State of New Jersey, That Joseph M. Kaighn, Charles Rhoads, William J. Sewell, Augustus Reeve, J. Earl Atkinson, Isaac B. Mulford, Asahel Troth, Joseph M. Cooper, William Bettle, Richard H. Reeve, Joseph C. Hollingshed, John Cooper, Jacob Pitman, William H. Cole, Benjamin F. Starr, John Gill, junior, John Stockham, Isaac C. Martindale, Howard M. Cooper, Alexander C. Wood, Henry Fredericks, Howard French, Martha A. Kaighn, Beulah M. Rhoads, Meribah Troth, Anne Burrough, Susan Atkinson, Mary Mulford, Abigal Starr, Anna B. Cooper, Sarah Fredericks, Mary Pitman, Priscilla Lippincott, Emma G. Cole, Matilda Bockins, Rachel Cooper, Rebecca C. W. Reeve, Mary C. Browning, Elizabeth Brewer, Abigal Hollingshed, Mary M. Cooper, Jane Bettle, Sallie W. Reeve, Hannah Martindale, Mary Bettle, Sallie C Kaighn and Sarah Wyatt Reeve, and their associates be and they are hereby incorporated and made a body politic, Corporate in law and fact, by the name, style and title of "The West name and Jersey Orphanage for Destitute Colored Children," and by that name, style and title shall have perpetual succession, with power to have a common seal and the same to change at pleasure; to make contracts relative to the institution; to sue and be sued, implead and be impleaded, and by that name, style and title to be capable of taking, holding, purchasing and conveying any estate, real or personal for the use of said corporation; provided, the annual income of such estate shall not exceed ten thousand dollars, nor be applied to any other purposes than those for which this association is formed; to fix the quorum of the board of managers and of the board of trustees, and appoint such officers as may be requisite; to establish such other by-laws, rules and regulations as the said corporation shall judge necessa ry or expedient for the due management of the concerns of

3. 4. And be it enacted, That it shall and may be lawful for

the said corporation in their discretion, to take under their guardianship all colored children who may be placed under their care and management in either of the following modes: First-Colored children under twelve years of age who shall be voluntarily surrendered by their father, or, in case of his death or absence, by their mother or by their guardian, to the care of said corporation by an agreement or declaration in writing; second-colored children under twelve years of age who may be committed to the care of said corporation by any judge of the circuit court or court of common pleas of the counties of Burlington, Camden, Atlantic, Gloucester, Cumberland, Salem and Cape May, or by the mayor of the city of Camden, on account of vagrancy, or the exposure or neglect or abandonment of said children by their parents, guardians or other people having custody of said children; and in case of poor colored children under the age of twelve years, contemplated by the twelfth and twenty-fifth sections of the act of the legislature of this state, entitled "An act for the settlement and relief of the them out. poor," approved April tenth, one thousand eight hundred and forty-six, it shall be lawful for the persons therein authorized to bind out such children, to commit the same by an agreement or declaration in writing, signed by said persons required to sign such children's indentures to the care and management of said corporation.

5. And be it enacted, That the said corporation shall have guardian- the guardianship of the said children so placed under their said chil- care and management during their minority, shall cause their min- them to be educated and instructed in a proper manner, and may, when in their discretion it shall appear proper, bind the said children, with their consent, as apprentices during their minority to such persons and at such places, and to learn such trades and employments as in the judgment of the said corporation will be the most conducive to the benefit and advantage of said children; provided, that the charge and power of the said corporation over and upon the said children, shall not, in the case of females, extend beyond the age of eighteen years, or the said corporation in their discretion may return the said children to their parents or surviving parent or guardian.

CHAPTER XLIX.

An act to set off from the Township of Belleville, in the County of Essex, a new Township to be called the township of Franklin.

1. BE IT ENACTED by the Senate and General Assembly of the State of New Jersey, That all that part of the township of Belleville, in the county of Essex, beginning at the Passaic River in the division line between lands of William H. Conover and lands of Joseph W. Hancox; and thence running a westerly direction in a direct line to the northeasterly corner of lands belonging to the estate of Thomas Van Winkle deceased, and thence along the northerly boundary of said land to the Bloomfield township line; thence along the line of Bloomfield to the line between Essex and Passaic counties; thence easterly along the Passaic county line to Passaic river; thence southerly along Passaic river to the place of beginning, shall be and hereby is set off from the township of Belleville, in the county of Essex, and made a separate township to be known by the name of the township of Franklin.

2. And be it enacted, That the inhabitants of the township Corporate of Franklin, in the county of Essex, shall be and are hereby constituted a body politic and corporate in law by the name of "The Inhabitants of the Township of Franklin, in the County of Essex," and shall be entitled to all the rights, powers, privileges and advantages, and shall be subject to all the regulations, government and liabilities to which the inhabitants of the other townships in said county of Essex are or may be entitled or subject by the laws of this state.
