CHAP. 110.

AN ACT to amend section two of chapter four hundred and sixteen
of the laws of one thousand eight hundred and eighty-eight,
entitled "An act to facilitate State commerce by increasing and
improving the lockage capacity of the Erie and Oswego canals,
and to improve the Erie, Oswego, Black River, Champlain and
Cayuga and Seneca canals, and providing for the construction of
a basin at Havana, and the opening of the Seneca lake level of the
Chemung canal to navigation.

APPROVED by the Governor April 6, 1889. Passed, three-fifths being present.
The People of the State of New York, represented in Senate and
Assembly, do enact as follows:

SECTION 1. Section two of chapter four hundred and sixteen of the laws of one thousand eight hundred and eighty-eight, entitled "An act to facilitate State commerce by increasing and improving the lockage capacity of the Erie and Oswego canals and to improve the Erie, Oswego, Black River, Champlain and Cayuga and Seneca canals, and providing for the construction of a basin at Havana, and the opening of the Seneca lake level of the Chemung canal to navigation," is hereby amended so as to read as follows:

§ 2. AN ACT to anthorize the contracting board of the city of Troy to
sell and convey certain real property belonging to said city, and
with the proceeds of a portion thereof, and by the issuing of
bonds, to erect and provide for the cost of certain public build-
ings, and to confirm and legalize, in favor of the city of Troy and
its assigns, certain taxes and assessments upon, and public sales by
the chamberlain of said real property.

the vacant lots and parcels of land belonging to said city situate on the east and west sides of Third street between Canal avenue and Madison street, and the vacant lot, also belonging to said city situate on the east side of First street and the south side of Canal avenue in said city, except as hereinafter mentioned. The said board shall fix the terms and conditions of all such sales and may impose any restrictions that said board shall deem proper relative to the use and enjoyment of the property sold. All contracts or conveyances which may become necessary under the provisions of this act on the part of the city, shall be drawn by the corporation counsel of said city. The said board shall, however, reserve from the said lots a Reservasufficient number thereof upon which to erect a police station-house, certain a fire engine-house and hose depot, and a hook and ladder-house in lots for said city, and to secure an abundance of light, air and room for all the said buildings. §3. The city taxes and assessments levied and assessed upon said vacant lots, for the non-payment of which the said lots, or any of them, have been sold at public sale by the chamberlain of said city and at which sales the said lots, or any of them, were purchased or bid in on behalf of said city, are hereby legalized and are made valid and effectual liens on the respective lots in favor of the city of Troy and its assigns, and the sale or sales of said lots, or any of them, by the chamberlain, at which sale or sales they were purchased or bid in by said city of Troy, or by the comptroller thereof on behalf of the city, are hereby confirmed and legalized in favor of the city of Troy and its assigns. Nothing contained herein shall affect any action or special proceeding relative to said property which is now pending in any

court.

§ 4. All acts or parts of acts inconsistent with or repugnant to this. act are to that extent hereby repealed.

§ 5. This act shall take effect immediately.

CHAP. 112.

AN ACT to provide the means of payment for the celebration by
the city of Brooklyn, of the centennial of the inauguration of
George Washington as President of the United States of America.
APPROVED by the Governor April 8, 1889. Passed, three-fifths being present.
The People of the State of New York, represented in Senate and
Assembly, do enact as follows:

SECTION 1. The comptroller of the city of Brooklyn is hereby troller and authorized to transfer the sum of twenty-five thousand dollars from the revenue fund of said city to the contingent fund or account of the board of aldermen of said city, and the said board of aldermen are

AN ACT to amend chapter three hundred and thirty of the laws of
one thousand eight hundred and eighty-three, entitled "An act to
supply the city of Schenectady with water."

The People of the State of New York, represented in Senate and
Assembly, do enact as follows:

SECTION 1. Section six of chapter three hundred and thirty of the laws of one thousand eight hundred and eighty-three, entitled "An act to supply the city of Schenectady with water," is hereby amended so as to read as follows:

CHAP. 114.

AN ACT to amend chapter two hundred and ninety-eight of the laws of one thousand eight hundred and eighty-three, entitled "An act to provide for the government of the city of Albany." APPROVED by the Governor April 8, 1889. Passed, three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section seventeen of title three of chapter two hundred and ninety-eight of the laws of one thousand eight hundred and eightythree is hereby amended so as to read as follows:

§ 17. In addition to the number of copies of such journal that may be required by the clerk of the common council for the distribution herein provided for, there shall be printed not exceeding five hundred copies, which shall be kept by said printer or clerk in some safe place; and immediately after the first day of January in each year, such copies for the preceding year shall be properly indexed and bound under the direction of the clerk of the common council, with a list of city officers, committees and other proper prefatory matter to be prepared by him, and the same shall be distributed under the direction of the common council.

§ 2. Section thirty of title three of chapter two hundred and ninetyeight of the laws of one thousand eight hundred and eighty-three is hereby amended so as to read as follows:

30. No street, avenue or public place in the city of Albany, which has been once paved, and the expense thereof paid for by the owners case of re- of adjoining property by assessment or otherwise, shall hereafter be repaved with any other and different materials at their expense, unless such paving or repaving be petitioned for by one or more persons owning not less than one-half of the number of feet fronting both sides of that portion of the street, avenue or public place to be so paved or repaved, as shall appear by said tax-rolls, of which fact the certificate of the city engineer and surveyor shall be conclusive evidence, except that the common council may, at any time, by law, provide for the grading, repaving with granite block pavement and suitable crosswalk provisions stones and recurbing of any street which is or constitutes an approach as to State to the New Capitol building from the east, including State street from certain ap- Broadway, to the east line of Eagle street, without any petition being presented therefor.
