CHAPTER 6380-(No. 261).

AN ACT to Amend Section 1 of An Act Entitled "An Act to Provide for the Assessment and Collection of the Taxes for the City of Orlando and for the Collection of the Back Taxes and Tax Sale Certificates of Said City," Approved April 30th, 1903.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That Section One of An Act entitled "An Act to provide for the assessment and collection of the taxes of the City of Orlando and for the collection of the back taxes and tax sale certificates of said city," approved April 30th, 1903, be, and the same is hereby, amended, so as to read as follows:

"Section 1. That all property, real and personal, with in the City of Orlando taxable for State purposes shall be taxable by the city for municipal purposes.

The City Council is hereby authorized to levy and im pose license taxes for municipal purposes by ordinance, upon any business, profession, occupation and privilege engaged in or enjoyed within the city, and to grade and fix the amounts thereof without regard to any of the provisions of any general revenue law now in force, or here after to be enacted which does not specifically repeal this Act."

Sec. 2. This Act shall take effect on July 1st, A. D. 1911.

CHAPTER 6381-(No. 262).

AN ACT to Amend Section One of An Act Entitled "An
Act to Authorize the City of Orlando to Issue Addi-
tional Bonds to the Amount of One Hundred and Fifty
Thousand Dollars," Approved May 31st, 1905.

Be it Enacted by the Legislature of the State of Florida:
That Section One of An Act entitled "An Act to Auth-
orize the City of Orlando to issue additional bonds to the

amount of One Hundred and Fifty Thousand Dollars" be amended so as to read as follows:

Sec. 1. That the City Council of the City of Orlando is hereby authorized to issue in addition to its present bonded indebtedness bonds to the amount of Three Hundred and Fifty Thousand Dollars, for constructing or purchasing waterworks, for constructing purchasing works for supplying light to the city and to private consumers, and for constructing a system of sewerage for the city. Before any such bonds are issued, however, the question of issuing them, as well as the amount to be issued, shall be submitted to the registered voters of the city then residing therein who own real estate therein and have paid their taxes for the year last due thereon, in such manner and after such public notice as the City Council may by ordinance prescribe, and shall, four-sevenths of all the voters of the city having such qualifications and actually voting at such election, vote in favor of issuing the bonds and the amount proposed to be issued, the City Council may issue them, otherwise not. The City Council shall by ordinance provide for opening the city registration books before any such bond election, and also for ascertaining the registered voters who possess the qualifications aforesaid.

CHAPTER 6382-(No. 263).

AN ACT to Extend the Powers of the Town of Pablo
Beach, Florida.

Be it Enacted by the Legislature of the State of Florida:

Section 1. The legislative powers of the Town of Pablo Council. Beach shall be exercised by the Town Council, composed of nine members, who shall serve for a period of two years, and until their successors are elected and qualified, and at the general town election to be held in July, 1911, nine members of the Town Council shall be elected and the four members elected who shall of the nine receive the lowest vote, shall hold office for one year, and until their successors are elected at the election to be held in July,

1912. The four members of the Town Council elected at the general town election in 1912 shall hold office for two, and their successors shall be elected in the even years thereafter. The five members of the Town Council who shall receive the highest vote at the general town election in July, 1911, shall hold office for two years, and their successors shall be elected in the odd years thereafter.

Sec. 2. The Town of Pablo Beach shall have the power to borrow money and issue bonds to the extent and in the manner that cities and towns which are incorporated under the general law of Florida, may borrow money or issue bonds for the purpose of building or repairing the public works of the town, the widening, opening, grading and paving, bulkheading and extension of streets or parks, sewerage and drainage, payment of existing indebtedness of the Town of Pablo Beach, or any other municipal pur pose.

Sec. 3. The office of the Town Tax Assessor of the Town of Pablo Beach shall be abolished after the 1st day of July, A. D. 1911, and in lieu thereof the Town Clerk shall, after the general town election in July, 1911, be the Tax Assessor of the Town of Pablo Beach, and he shall assess all property subject to taxation in said town, and shall perform all the duties heretofore performed by the Tax Assessor in regard to the assessment of taxes and special assessments against property for sidewalks, paving and other public improvements, and shall perform such other duties as are prescribed by law and the ordinances Clerk, Treas of the Town of Pablo Beach. The Town Clerk, Town Treasurer and Town Tax Collector, may be one and the same person. He shall receive a salary to be fixed by ordinance and shall give bond for the faithful performance of his duties as the Town Council shall prescribe.

Sec. 4. The Town of Pablo Beach may make its own assessments of property for taxation and all property shall be assessed at its full cash value without regard to the valuation placed thereon by the County Tax Assessor for the previous year.

Sec. 5. The Town of Pablo Beach is hereby authorized to levy and enforce license or occupational taxes for mu nicipal purpose upon any and all occupations and to grade and fix the amounts in the same manner that the

Legislature could impose such licenses and taxes for State purposes, but nothing contained in this Section shall be construed as conferring power on the Town of Pablo Beach to impose a license tax upon the sale of spirituous, vinous or malt liquors in contravention of the general laws of the State of Florida on that subject.

Sec. 6. This Act shall take effect and become a law upon its passage and approval by the Governor. Approved June 3, 1911.

CHAPTER 6383-(No. 264).

AN ACT to Amend Section 1 of Chapter 6092 Laws of Florida, the Same Being An Act Entitled An Act to Provide for the Deposit in Bank or Banks and for the Loan and Investments of Funds of the City of Palatka, and for Obtaining Interest Thereon, Approved June 1, 1909.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That Section 1 of Chapter 6092, Laws of Florida, the same being An Act entitled An Act to provide for the deposit in bank or banks and for the loan and investments of funds of the City of Palatka, and for obtaining interest thereon, approved June 1, 1909, be, and the same is hereby amended to read as follows:

Section 1. That it shall be the duty of the City Coun- Depository. cil of the City of Palatka to designate as a depository or as depositories of all of said city's funds, such bank or banks located in the State of Florida as offer the best rate of interest for such funds, as the City Council may by ordinance or resolution determine from time to time to deposit upon interest, and as furnish such security as may be required and approved by said City Council; Provided, however, That the designation of any one or more depositories for any one or more of said funds shall be for a period of not less than six months nor more than two years, at the option of said City Council; Provided, further, That the sinking fund provided by law and ordi

nance for the retirement of bonds now issued, or that may be issued, shall be invested or loaned as the City Council may, by ordinance or resolution, determine from time to time.

Sec. 2. That all laws and parts of laws in conflict with this Act be, and the same are hereby repealed.

Sec. 3. That this Act shall take effect upon and from its passage and approval by the Governor.

CHAPTER 6384-(No. 265).

AN ACT to Authorize the Town of Palmetto, Florida, to Issue Bonds for Municipal Purposes, and to Provide for the Payment of Interest Thereon.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That the Mayor and Town Council of the Town of Palmetto, Florida, in their corporate capacity are hereby authorized to issue from time to time, bonds of said town of such denominations, and bearing such rate of interest, not to exceed six per cent. per annum, payable semi-annually, and upon such terms and conditions as may by ordinance be determined, to an amount not to exceed twenty thousand dollars, which twenty thousand dollars of bonds, shall be in addition to the twenty-five thousand dollars of bonds of said town already issued and outstanding, which said bonds to be issued shall be signed by the Mayor, countersigned by the President of the Town Council, and attested by the clerk, and shall be payable at such time as the Town Council by ordinance shall provide; said bonds to be used to build and pave streets, to build and extend waterworks, to construct a sewer system, and to refund outstanding indebtedness of said Town of Palmetto, and for such other municipal purposes as the Town Council of said Town of Palmetto may by ordinance designate and which shall be approved by a majority of the votes cast at an election to be held for the purpose in the manner provided for in Section 2 of this Act. The entire taxable property of said town shall be pledged for the payment of said bonds and the interest thereon.
