CHAPTER 6138-(No. 19).

AN ACT to Provide for the Selection and Securing of a
Site for Government Biological Station on the Gulf
Coast of Florida.

Whereas, A Bill was passed by the United States Senate
and House of Representatives in Congress assembled
which Act was approved March the 1st, 1911, authoriz-
ing the Secretary of Commerce and Labor to establish
a Marine Biological Station on the Gulf of Mexico at a
point on the coast of the State of Florida to be selected
by him in said State; Provided, that the State of Flor-
ida donate and transfer free of cost to the Government
of the United States necessary land and water rights,
upon which may be erected such buildings, wharves and
other structures as may be necessary for the proper
equipment of said station, such biological station, build-
ings, wharves and other structures not to cost exceeding
$50,000.00; therefore,

Be it Enacted by the Legislature of the State of Florida:

Section 1. That a Commission be created to consist of three members of the present Legislature, one to be elected from and by the Senate and two from and by the House of Representatives, to take up the matter of selecting the site for such biological station, with the Commissioner of Commerce and Labor at such time and place as he may designate and suitable to him. And having found such a site, if it be not the property of the State of Florida, to endeavor to have the owner thereof donate the same to the State Board of Commissioners in trust to be used for such site and failing to have the same donated by the owner to endeavor to find another site acceptable to the Secretary of Commerce and Labor, which the owners are willing to donate for such purposes to the State. And in the event that no suitable site can be found acceptable to said Commissioners which the owner is willing to donate, but one is found that is suitable and acceptable to such Commissioners, then and in that event said Commission

shall take a three years' option therein on the name of the Board of Commission in trust for the State of Florida to be by them donated and deeded free of cost to the Government of the United States for the purpose of being used by said biological station.

Sec. 2. And they shall be allowed no other compensation or expenses. And the Comptroller shall issue his vouchers on the State Treasurer to cover the same upon a sworn report thereof to issue being filed with him. And shall also issue his voucher on the State Treasurer to cover the sum paid by them for said option, if option be taken.

AN ACT Appropriating the Sum of Thirty Thousand Dollars for the Purpose of Carrying Into Effect the Provisions of Chapter 5734 of the Laws of Florida, Approved May 31st, 1907, Appropriating Thirty Thousand Dollars to the Florida State Mid-Winter Fair Associa tion, to Pay Premiums at Fairs to be Held in Tampa, Florida, Commencing November 1st, 1907, and November 1st, 1908, Respectively.

Whereas, The Legislature of the State of Florida, at the Session of 1907, passed An Act to appropriate the sum of Fifteen Thousand Dollars annually for two years to pay premiums awarded by the Florida State Mid-Winter Fair Association at Fairs to be held in the City of Tampa; and,

Whereas, Under the provisions of Chapter 5603 of the Laws of Florida, passed at the same session, such restrictions were placed on appropriations made during said session as to prevent the issue of warrants under the appropriation made for the purpose aforesaid; there fore,

Be it Enacted by the Legislature of the State of Florida:

Section 1. That the sum of thirty thousand dollars be, and the same is hereby appropriated out of any money in the State Treasury not otherwise appropriated for the purpose of carrying out the provisions of Chapter 5734 of the Laws of Florida, appropriating thirty thousand dol lars to the Florida State Mid-Winter Fair Association to pay premiums.

Sec. 2. That the Comptroller is hereby authorized and directed to issue warrants on the State Treasurer for the amount appropriated by Section 1 of this Act, or so much thereof as shall be necessary; and the State Treas urer is hereby authorized to pay the same out of any money in the State Treasury not otherwise appropriated;

said warrants to be issued and made payable to those awarded premiums by the Florida State Mid-Winter Fair Association, or their assigns, upon satisfactory proof to the Comptroller of the right of the person presenting claim therefor. Provided, the sum herein appropriated shall Limitation only be used in payment of premiums or prizes as first advertised by the Florida State Mid-Winter Fair Association to be given or awarded.

Sec. 3. That the Florida State Mid-Winter Fair Association shall conform with every requirement contained in Chapter 5734 of the Laws of Florida, and that the bond given by said association shall continue in force until said requirements have been complied with.

Sec. 4. This Act shall take effect immediately upon its passage and approval by the Governor. Approved May 17, 1911.

AN ACT Appropriating the Sum of Four Thousand Dollars for the Purpose of Carrying into Effect the Provisions of Chapter 5735 of the Laws of Florida, Approved May 31st, 1907, Appropriating Four Thousand Dollars to the West Florida Fair Association, to Pay Premiums at Fairs to be Held in DeFuniak Springs, Florida, in the Falls of 1907 and 1908, Respectively. Whereas, The Legislature of the State of Florida, at the Session of 1907, passed an Act to appropriate the sum of Two Thousand Dollars annual for two years to pay premiums awarded by the West Florida Association at fairs to be held in the Town of DeFuniak Springs, Florida.
