Sec. 2. That all acts and deeds done and performed in the organization and incorporation of said town are declared to be valid and legal in law and equity, and to be considered binding by the laws of the State of Florida.

Sec. 3. That all officers elected and qualified, and that all acts and deeds done by and through the Mayor and Town Council and other officers of said town, not in conflict with the laws of this State are hereby declared valid and legal.

Sec. 4. This Act shall take effect immediately upon its passage and approval by the Governor.

CHAPTER 6320-(No. 201).

AN ACT Authorizing and Empowering the City of Apalachicola, a Municipal Corporation Organized and Existing Under the Laws of Florida, to Enter Into a Contract for Lighting the Streets of Said City for a Period Not Exceeding Ten Years, and to Levy, Impose and Collect on the Real and Personal Property Subject to Taxation by Said City a Special Annual Tax Not to Exceed Four (4) Mills on the Dollar for the Purpose of Paying for Such Lighting.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That the City Council of the City of Apalachicola be, and it is hereby, authorized and empowered to enter into a contract for lighting the streets of said city for a period not exceeding ten years, and to levy, impose and collect upon the real and personal property subject to taxation by said city, a special annual tax, not to exceed four (4) mills on the dollar for the purpose of paying for such lighting.

Sec. 2. That this Act shall take effect upon its approval by the Governor.

CHAPTER 6321-(No. 202).

AN ACT to Legalize the Election Held in the City of Arcadia, on the 16th Day of May, A. D. 1911, to Determine by an Affirmative Vote of a Majority of the Electors of Said City Voting at the Said Election, Whether or Not the Bonds Proposed by an Ordinance Entitled "An Ordinance to Provide for Calling an Election in the City of Arcadia to Determine Whether Said City Shall Issue Bonds for the Following Purposes, To-wit: Constructing and Maintaining a System of Waterworks; Constructing and Maintaining a System of Sewerage, and Opening, Widening and Paving the Streets of Said City," Passed by the City Council of Said City on the 10th Day of April, 1911, and Approved on the 10th Day of April, 1911, Should Be Authorized and Issued, and to Declare and Render Valid Said Election and the Results as Shown by the Returns Thereof, and to Declare and Render Valid Said Ordinance and to Authorize the Issue of Bonds as Provided by Said Ordinance.

Whereas, Authority is given by Chapter No. 5080 of the Laws of Florida and Chapter No. 6034 amendment thereof of the Laws of Florida, to the City of Arcadia to issue bonds for constructing and maintaining a system of waterworks for said city; constructing and maintaining a system of sewerage for said city; and opening, widening and paving the streets of said city; Provided, The issuance of bonds proposed to be issued shall have been authorized by an affirmative vote of a majority of the votes cast by the qualified electors of said city at an election held for that purpose in the manner provided by said Acts of the Legislature; and, Whereas, An Ordinance was duly passed by the City Council of Arcadia on April 10th, 1911, and approved April 10th, 1911, and became an ordinance of said city in the manner provided by law, entitled "An Ordinance

to provide for calling an election in the City of Arcadia to determine whether said city shall issue bonds for the following purposes, to-wit: Constructing and maintaining a system of waterworks; constructing and maintaining a system of sewerage; and opening, widening and paving the streets of said city;" and,

Whereas, A proclamation was duly issued and published as provided by said ordinance, calling an election for the purpose of determining whether said bonds should be issued, which election was held on May 16th, 1911, resulting in a majority of the qualified electors of said city voting at said election, approving the issue of bonds as provided for in said ordinance; and,

Whereas, It is important that no question should arise as to the validity of said ordinance and of said election, or as to the validity of the bonds provided for in said ordinance, and which may be issued in pursuance thereof, and of the said authority; therefore,

Be it Enacted by the Legislature of the State of Florida:

Section 1. That the said ordinance herein before mentioned, and the said election held in the City of Arcadia on the 16th day of May, 1911, in pursuance thereof be, and the same are hereby, legalized and declared to be valid and binding in every respect.

be passed in connection therewith, are hereby declared to be valid in manner, form and effect as issued, and to be binding and to have full force, virtue and effect in law and equity against the said City of Arcadia, and the entire taxable property therein for the payment of the principal, sum and interest thereon when due and payable, according to the provisions of said ordinance or ordinances; Provided, That the said bonds shall not be sold for a greater discount than 5% of their par value, and in contravention of said ordinances authorizing their issue as to the amount of issue and the time of payment.

Sec. 3. The provisions of this Act shall be construed remedial and curative of any defect in or want of power upon the part of the municipality of the City of Arcadia to pass, ordain and adopt said ordinance, or to hold said election and to conduct the same in the manner in which the said ordinance was passed and said election was held and conducted, and to declare the result, and to arrive at such result through the votes of those who voted at said election; and hereby legalizes said ordinance and said election and said approval of the issuance of said bonds, and said bonds which may be issued in pursuance of said ordinance in so far as the Constitution of the State of Florida permits and the Legislature has power.

Sec. 4. All laws in conflict with this Act are hereby repealed.

Sec. 5. This Act shall take effect immediately after its passage and approval by the Governor.

CHAPTER 6322-(No. 203).

AN ACT to Amend Sections 30, 31 and 60 of Chapter No. 5080, Laws of Florida, Approved May 29, 1901. Entitled An Act to Abolish the Present Municipal Government of the Town of Arcadia in the County of DeSoto, State of Florida, and to Establish, Organize and Constitute a Municipality to be Known and Designated As the City of Arcadia, and to Define Its Territorial Boundaries and to Provide for Its Jurisdiction, Powers and Privileges.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That Section 30 of Chapter No. 5080 of Laws of Florida be amended to read as follows:

Sec. 30. That the council shall have power to provide the said municipality with waterworks and public baths to be within or beyond the boundaries of said city; to provide for the prevention or extinguishing of fires; to organize and establish fire departments; to fix and establish a fire limit within which no building shall be constructed, repaired, altered or enlarged, except upon permission being first obtained for such purpose or purposes from the City Council, provided that the said council shall not authorize any building already within said fire limit to be altered, improved or enlarged, or any building hereafter to be erected or constructed therein, except out of and from material which will render said building or improvement fireproof; to provide by ordinance for granting permission to construct, build, alter or enlarge dwellings, or other houses within the corporate limits, and to provide the kind of material to be used therein; and shall have power to provide by ordinance for the tearing down and removal of any building or structure which they shall determine to be built in violation of the rules established for the construction of buildings and structures; to order the removal of any building or structure which shall be determined by said council or the sanitary committee thereof to be a nuisance or injurious to or dangerous to health or life; and to provide for the lighting of said city.
