Disposition of funds.

All fines collected under the provisions of this Act shall be paid into the road and bridge fund provided for under this Act.

Sec. 9. The Board of County Commissioners are heretion of road by authorized and it is made its duty, in order to provide a sufficient fund with which to build and construct good roads and bridges in said county, to levy annually such road and bridge tax, and in like amount as is provided by general laws upon all property, real, personal and mixed, situate in said county subject to taxation, in like manner as other taxes are assessed and levied, which said taxes so assessed and levied shall be collected by the tax collector, with other taxes, and the moneys thus collected under such levy, shall constitute a road and bridge fund, together with such other moneys as may be collected, in lieu of performing road services. Said moneys when so collected shall be turned over by the collector of county revenues to the County Treasurer, who shall keep the same as a separate fund, which shall not be expended for any purpose, other than for work on the roads and bridges in said county, for the payment of salaries to the superintendent of roads, and his deputies, to the payment of wages of employees of road work and for the purchase of all necessary material, tools, implements, and teams which from time to time may be deemed necessary or expedient to be purchased for road work; Provided, That one-half of the amount so realized from the special tax herein provided for, on property situate in incorporated cities or towns shall be turned over to the municipal authorities of said cities and towns, to be used in the repair, working and maintenance of the public streets thereof, as may be provided by ordinance in said cities and towns.

Road Superintendent.

Sec. 10. It shall be the duty of the Board of County Commissioners, as soon as practicable after this Act shall become a law, to employ some fit and proper person, as superintendent of roads and bridges, who shall at all times be under the control and direction of said board, under whose supervision and direction all work upon the roads and bridges of said county shall be done. The Board of County Commissioners shall prescribe rules and regulations for the guidance of said superintendent as to the work to be done and as to the performance thereof,

and shall have the right at any time, to remove said superintendent for misconduct, unsatisfactory service or for any other good or sufficient reason. The amount of compensation of such superintendent, when so employed, shall be fixed by the Board of County Commissioners, but shall not exceed the sum of fifteen hundred dollars per annum. Such superintendent before entering upon his duties shall execute a good and sufficient bond, payable to the Chairman of the Board of County Commissioners, and to his successors in office, in the sum of not less than two thousand dollars, conditioned for the faithful performance of all duties devolving upon him as road superintendent of said county, and the faithful accounting for all funds or property of the county, which shall come into his hands, control or custody, by reason of his employment as road superintendent of said county. Such bond when so executed to be approved by the Board of County Commissioners.

Sec. 11. It shall be the duty of the road superintendent, Deputy Suimmediately after entering into contract with the Board perintendof County Commissioners as aforesaid, to appoint, by and with the approval of the Board of County Commissioners, some fit and competent person as his deputy, one for each and every County Commissioner's District in said. County, which said deputies when so appointed shall at all times be subject to the direction, control and supervision of the road superintendent, and for the faithful performance of the work entrusted to said deputy, as well as for the faithful accounting of all tools, materials, supplies and implements or other property which may come into the hands of such deputy by reason of his employment, the said road superintendent shall be responsible. Such deputies when so appointed shall have actual charge of all the work to be done, subject to the control and direction of the road superintendent, and they shall receive as compensation for their several services, a salary to be fixed by the Board of County Commissioners not to exceed the sum of seven hundred and twenty dollars per annum. It shall be the duty of the said superintendent, either in person or by deputy, to cause the road hands assigned to the several roads in each district, to be summoned to work said roads at such times and places and in such numbers as may be deemed

to be essential or expedient; the road superintendent or deputy shall have charge of such persons so summoned as well as all persons employed to perform work on roads and bridges and shall direct and oversee such persons so working said roads and bridges and designate the work to be done and performed as well as the manner of the performance thereof. He shall take charge of all tools, implements, teams and other property which is to be used in the working of the public roads of said county, and shall be required to give proper receipts therefor, and shall be required to make a strict accounting of all property which from any cause or for any purpose shall come into his hands for the purposes aforesaid. He shall once each month make a true and correct report in writing to the Board of County Commissioners which report shall show all the work done for the previous month, as well as the amount of tools, teams, implements, supplies and other property on hand which belongs to the county at the time of making each such report.

It shall be the duty of the Board of County Commissioners upon the requisition of the road superintendent to furnish all tools, implements, teams and supplies which may be necessary in order to carry on the work, and upon the termination of the term of employment of the said road superintendent, said board shall have a settlement with such superintendent, and shall receive from him all tools, implements or other property which were in his hands, control or custody and shall receipt him therefor, and should any of said property be not turned over by the superintendent at the time of such final settlement, and should not be satisfactorily accounted therefor, then in such event the said superintendent and his bondsmen shall be held liable for the value thereof.

Sec. 12. The road superintendent shall have the authority by and with the approval of the Board of County Commissioners to employ such labor by the day at the rate of not exceeding fifteen cents per hour, at the expense of the county, to be paid out of the road and bridge fund, as the said road superintendent and the said Board of County Commissioners shall from time to time deem necessary or expedient, to work on the public roads and bridges of said county, such persons so employed, however, shall be required to do and perform such work

under the immediate direction and control of the road superintendent or his deputy.

Sec. 13. The Board of County Commissioners are Work may hereby authorized to let out any portion of the work on the roads and bridges in said county on contract if, in their judgment, the work can be so done to the advantage of the county. In awarding any work on the roads and bridges under contract, the same shall be let to the lowest bidder, after due notice for bids, based upon specifications and plans furnished by the road superintendent and approved by the Board of County Commissioners, upon the contractor complying with such terms as to bonds, as the Board of County Commissioners may require; the Board of County Commissioners, however, at their discretion, may reject any and all bids and may require new bids to be made for such work as is proposed to be let out under contract. All work contracted shall be done under the immediate supervision and direction of the road superintendent or one of his deputies, and shall be approved, before final settlement is made therefor, by the Board of County Commissioners and the road superintendent.

Sec. 14. This Act shall take effect immediately upon its passage and approval by the Governor. Approved June 3, 1911.

CHAPTER 6300-(No. 181).

AN ACT to Prohibit the Shooting, Trapping, or Molesting
Squirrels and Doves in Santa Rosa and Escambia
Counties, Florida, and Providing a Penalty Therefor
From the 1st Day of March to the 1st Day of October
in Each Year Hereafter.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That it shall be unlawful to shoot, trap, or molest squirrels and doves in Santa Rosa and Escambia Counties, Florida, from the 1st day of March to the 1st day of October in each and every year hereafter. And

when any person or persons are found in possession of any squirrels or doves contrary to this Act it shall be prima facie evidence of his or their guilt under this Act.

Sec. 2. That this Act shall not prevent any person or persons from shooting, trapping, or molesting any squir rel or squirrels destroying property inside his or their enclosure.

Sec. 3. That any person or persons violating this Act shall be guilty of a misdemeanor.

Protection of fish in certain waters of Escambia and Santa Rosa Counties.

CHAPTER 6301-(No. 182).

AN ACT to Prohibit the Catching of Fish in the Waters of Santa Rosa and Escambia Counties, Florida, with Seines, Nets, Traps or Set Devices or by Shooting, Gigging or Otherwise Than by Hook and Line, and to Prohibit the Catching of Fish in the Waters of Santa Rosa and Escambia Counties with Hook and Line During the Months of April and May of Each Year.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That it shall be unlawful to fish with any hook and line, seines, drag nets, or any set devices in any of the waters of Santa Rosa and Escambia Counties, Florida, during the months of April and May of each and every year thereafter, and when any person or persons are found upon any of the streams of Santa Rosa and Escambia Counties, Florida, with any hook and line, seines, nets, traps, or set devices contrary to the provisions of this Act it shall be prima facie evidence of his or their guilt under this section.

Sec. 2. That any person or persons who shall catch or take any fish in the waters of Santa Rosa and Escambia Counties, Florida, with any seine, net, trap or set devices or by shooting or gigging in any of the waters other than by hook and line shall be deemed guilty of a misdemeanor.

Sec. 3. The two preceding sections shall not operate so as to prevent fishing at any time with seines, nets, traps
