Provided, That nothing in this section shall be construed to allow fishing with a seine or net for any purpose or under any circumstances except dip net or cast net for purposes of catching bait in the waters of Lake Tohopekaliga or Lake East Tohopekaliga in said county.

Sec. 3. That it shall be unlawful for any person or Fishing persons to catch fish in any of the fresh water lakes or other streams of Osceola County in this State during the months of January, April, May, June, September, October, November and December of any year who has not previously paid for and procured from the County Judge of said county a license to fish, the amount of which said license shall be twenty-five dollars for residents of said county, and fifty dollars for non-residents of said county; all said licenses be issued for the period of one year.

Sec. 4. Any person or persons violating the provisions of this Act shall be deemed guilty of a misdemeanor and punished accordingly.

Sec. 5. That all laws and parts of laws in conflict with the provisions herein be and the same are hereby repealed.

Sec 6. This Act shall take effect on July 1st, 1911.

CHAPTER 6294-(No. 175).

AN ACT to Authorize the Board of County Commissioners of Palm Beach County, Florida, to Issue County Warrants Not to Exceed Fifty Thousand Dollars on the Road Fund of Said County for the Purpose of Paying for the Construction of Certain Roads, and Providing the Rate of Interest Which Said Warrants Shall Bear and How and Where Payable and the Period for Which Said Warrants Shall Run.

Be it Enacted by the Legislature of the State of Florida:

of Palm Beach County, Florida, for the purpose of paying for the construction of hard surface public roads to be built along the banks of canals which shall connect Lake Okeechobee in Palm Beach County, Florida, with tidewater in Palm Beach County, Florida, is hereby authorized and empowered to issue county warrants in a sum not to exceed fifty thousand dollars ($50,000.00) on the road fund of said Palm Beach County, Florida, which said warrants shall bear interest at a rate not to exceed six per cent per annum, payable semi-annually, at the office of the Treasurer of said Palm Beach County, Florida, and which said warrants shall run for a period not to exceed five years from their respective dates.

Sec. 2. That all laws and parts of laws in conflict with this Act are hereby repealed.

CHAPTER 6295-(No 176).

AN ACT to Organize a County Court in the County of Pasco; to Prescribe for the Appointment of a Prosecuting Attorney for Said Court; to Prescribe for the Terms of Said Court and to Make said Court a Court of Record; to Provide for the Transfer of all Causes Now Pending in the Circuit Court and the Justice of the Peace Courts to Said Court for Further Consideration, Which Causes Will be Within the Jurisdiction of Said County Court; to Provide for the Drawing of the First Jury; to Provide How Judgments in Said Court Shall Become Liens; to Provide for the Salaries and Fees of the Officers of Said Court, and to Provide What Officers Shall be the Officers of Said Court.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That there be and is hereby organized in and for Pasco County, Florida, a County Court which shall be designated and known as the "County Court of Pasco County, Florida."

Sec. 2. The terms of said court shall commence respectively the second Tuesday in February; the second Tuesday in May; the second Tuesday in August, and the second Tuesday in November, but the first term of said court shall begin on the second Tuesday in August, 1911. Sec. 3. All suits within the jurisdiction of the County Court pending in the Circuit Court of Pasco County, Florida, shall be transferred to the County Court of Pasco County, Florida, and the Clerk of the Circuit Court of Pasco County, Florida, is hereby directed to deliver forthwith to the County Judge of the County Court of Pasco County, Florida, all papers, files and copies of all records in any and all of such suits.

Sec. 4. All suits within the jurisdiction of the County Court pending before any and all of the Justice of the Peace Courts in said County of Pasco shall be immediately transferred to the County Court for further adjudication in said County Court by the Justices of the Peace of Pasco County, Florida.

Sec. 5. Said court shall have and exercise all the pow ers, authority and jurisdiction conferred upon County of County Courts as provided by the Constitution and laws of this State, and the rules of practice and procedure of the County Court shall be the same as is now provided by the laws and Constitution of this State, and processes issued out of said court shall run throughout the State and be directed to all and singular to the sheriffs of the State of Florida. Trials of any case or cases may be had in vacation, when trial by jury is waived by counsel of the parties to the cause, and cases so tried shall be as binding and effectual as though they were tried in term time. Said court shall be and is hereby declared to be to all intents and purposes a Court of Record.

Sec. 6. Six jurors shall be summoned from the county Jurors. at large to serve at each term of said court as now provided by law for summoning such jurors in County Courts of this State. When all six jurors do not appear at any term the panel may be completed by order of the court to the sheriff to complete the panel by summoning bystanders. The first jury for the said court shall be drawn as provided by Section 1576 of the General Statutes of Florida.

Sec. 7. The County Judge of said county shall be the judge of said court; the sheriff of said county shall be the executive officer of said court; the Clerk of the Circuit Court of Pasco County, Florida, shall be clerk of said court. There shall also be a Prosecuting Attorney for said court who shall be at the time of his appointment and thereafter at the time of his election, a practicing attorney.

Sec. 8. The Prosecuting Attorney of said County Court, prior to the general election in 1912, shall be ap pointed by the Governor by and with the advice and consent of the Senate. At the general election in 1912 a County Attorney for said court shall be elected for a term of four years; and every four years thereafter a County Attorney shall be elected for said court.

Sec. 9. Trials de novo from the Justice of the Peace Courts in said county may be had in the following man

ner:

Any party desiring to appeal from the final judgment of the Justice of the Peace Court in any district in said county may apply for and obtain an appeal in both civil and criminal cases as follows:

The party taking the appeal shall file a supersedeas bond in civil cases in any amount equal to double the amount recovered, with two good and sufficient sureties to be approved by the court; and in criminal cases a bond in an amount to be fixed by the court, with good and sufficient surety to be approved by the court, the bonds in both civil and criminal cases to be conditioned as provided by law. In appeals in both civil and criminal cases, the court may authorize and accept cash bonds or bonds in surety companies, which surety companies have complied with the laws of this State relative to doing business in this State and are doing business in this State. The trial court shall send up the supersedeas bond or bonds, affidavits, warrants, and all other papers touching the case in the trial court to the County Court in appellate proceedings; and no other act or thing shall be nec essary to give the County Court complete jurisdiction in appellate cases; and the County Court shall proceed to try said case or cases on the papers sent up from the lower court de novo. The trial court may recognize the

prosecuting witnesses for the State in criminal cases to appear at the trial of the cause in the County Court.

Sec. 10. The judgments of the County Court of this Judgments. county shall be a lien on the real estate of the defendant or defendants situated in this county when obtained and recorded in said county; and a lien on real estate of the defendant or defendants in other counties of this State when a duly certified copy of said judgment is obtained and recorded in the other county of this State.

AN ACT to Prohibit the Catching of Fish in the Lakes and Streams of Polk County, State of Florida, With Any Seine, Net, Trap or Set Device, Except Bait Which May be Caught With Dip Net, or by Shooting or Gigging or Otherwise Than With a Hook and Line, and to Prohibit the Transporting or Receiving for Transportation; and to Prohibit the Selling or Offering for Sale, Shipping or Offering for Shipment or Transportation, Within Said County, of any Fish Taken from Such Lakes or Streams Otherwise Than With a Hook and Line.
