CHAPTER 6282-(No. 163).

AN ACT Permitting and Authorizing the Board of County Commissioners of Leon County, Florida, in Their Discretion, to Employ an Attorney to Represent the State in all Hearings and Trials, in Which the State is a Party, in the County Judge's Court of Said County; Limiting the Salary of Such Attorney, and Fixing the Manner in Which Same Shall be Paid.

Be it Enacted by the Legislature of the State of Florida:

Section 1. The Board of County Commissioners of Leon County, Florida, are hereby permitted and authorized, in their discretion, to employ an attorney to represent the State in all hearings and trials, in which the State is a party, in the County Judge's Court of said county.

Sec. 2. The salary of such attorney shall be fixed by the Board of County Commissioners of said county, but shall not be more than six hundred dollars per annum, and shall be paid quarterly out of the fine and forfeiture fund of said county by warrant drawn in due form against said fund.

Sec. 3. All laws and parts of laws in conflict with this Act be, and the same are hereby repealed.

Sec. 4. This Act shall take effect immediately upon its passage and approval by the Governor.

CHAPTER 6283-(No. 164).

AN ACT Regulating the Manner of Catching Fish in the Fresh Water Lakes and Streams of Leon County, and Providing Punishment for the Violations of this Act.

Be it Enacted by the Legislature of the State of Florida: Section 1. That from and after the passage of this Act it shall be unlawful for any person or persons, to catch, or take, any fish from the fresh water lakes and streams

of Leon county, in any manner except by fishing, with hooks and lines, or bobs, and any person or persons violating the provisions of this Act by catching or taking any fish from the said fresh water lakes or streams by means of any seine, net, basket, trap, gun, speer or gig, or in any other manner than herein provided, shall be guilty of a misdemeanor.

Sec. 2. All laws and parts of law in conflict with the provisions of this Act are hereby repealed. And this Act shall take effect upon its becoming a law.

CHAPTER 6284-(No 165).

AN ACT to Regulate the Hunting of Fox in Leon County,
Florida, by Non-residents of Said County.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That from and after the passage of this Act, Fox hunting it shall be unlawful for any non-resident of the County of Leon to hunt, shoot, trap, chance with dogs, kill or take any fox or foxes in Leon County at any time until he shall pay to the Game Warden of said county the sum of five dollars per day for each and every day or part of a day that he shall hunt fox or foxes in said County; and it shall be the duty of any such person, before hunting any fox or foxes in said county, to give to the Game Warden of said county five days' previous notice in writing of his intention to hunt therein, and name in such notice a day certain and some well known place in said county where he will meet said Game Warden to pay for the privilege of hunting therein. Any person violating the provisions of this section shall be guilty of a misdemeanor.

Sec. 2. All moneys collected under this Act, whether for licenses to hunt or for fines, shall be turned over to the County Commissioners of said county; one-half of same to be applied on the salary of the Game Warden, and the other half to be paid into the fine forfeiture fund.

Sec. 3. This Act shall not be construed to apply to licenses for hunting any other game or animals other than mentioned in this Act.

Sec. 4. All laws and parts of laws in conflict with the provisions of this Act be, and the same are hereby repealed.

Sec. 5. This Act shall take effect immediately upon its passage and approval by the Governor.

CHAPTER 6285-(No. 166).

AN ACT to Authorize the County Commissioners of Levy
County to Offer Rewards for the Killing of Certain
Animals.

Be it Enacted by the Legislature of the State of Florida:

Section 1. The Board of County Commissioners of Levy County is hereby authorized and empowered, when they may deem it advisable, to offer and pay rewards for each and every one of the following animals killed in said county, to be evidenced by the bringing in and filing with the County Commissioners the scalps of such animals: for each wild cat, $1; for each fox, 50 cents; for each bear, $5; said reward to be paid out of the general funds of the county.

Sec. 2. This Act shall take effect immediately upon its passage and approval by the Governor.

ing of the Public Roads and Bridges of Liberty County,
Florida; to Provide a Road and Bridge Fund for Said
County and for the Assessment and Collection of the

Section 1. Each County Commissioner's District in Liberty County is hereby declared a road district for the tricts. purposes of this Act, and the roads and bridges in said district shall be under the supervision of the Board of County Commissioners, except within incorporated towns. Sec. 2. All public roads and bridges now established as such in Liberty County are retained as public roads and bridges by this Act, and the abolishing or changing of the same shall be done by recommendation or petition of a majority of free-holders living nearest and using the road or bridge proposed to be abolished or changed. Sec. 3. The Board of County Commissioners are hereby Establishempowered to establish new roads and bridges in the manner prescribed by Section 2 of this Act, and shall have the right and power to appropriate and use any material which may be necessary for the construction, maintenance and repair of roads and bridges; but before using such material they shall endeavor to obtain the same by purchase or otherwise from the respective owners. But should the County Commissioners and the owners of the land or material be unable to agree on the price to be paid, then the Board of County Commissioners shall have the right to proceed to condemn the land upon which such material is located and damages awarded to the owner thereof in the same manner as is now provided or may hereafter be provided by law for the condemnation of lands for roads and highways and other public purposes; Provided, however, That when any damages are assessed Damages by by reason of any survey passing through any property, the Board of County Commissioners may order the survey changed or revoked if in their opinion the damages assessed are greater than the use of said road would be to the traveling public.

Sec. 4. The width of all public roads shall be fixed by the County Commissioners but no public roads shall be less than twenty feet measuring from edge of ditch nearest to road on each side.

Sec. 5. The County Commissioners shall, each year after the passage of this Act, at the time of levying taxes for county purposes levy a special tax not to exceed five mills on the dollar on all real and personal property in the County subject to taxation, for the establishing, working, repairing and maintaining of all public roads and bridges in the county, the same to be assessed and collected as other taxes of the county, and the money arising therefrom shall be paid into the County Treasury as a special fund to be expended under the direction of the Board of County Commissioners solely for the purpose of establishing, working, repairing and maintaining the roads and bridges of the county; Provided, That the Board of County Commissioners before levying such tax give sixty days notice in a newspaper published in the county and posted in one or more conspicuous places in each commissioner's district in the county of their intention to levy such tax. And the Board of County Commissioners shall not levy the tax as prescribed in this Act if a majority of the registered voters shall, by their vote or petition, oppose such tax levy.

Sec. 6. The Board of County Commissioners shall, at such time as they may deem advisable, after they have levied the tax as provided for in Section 5 of this Act, proceed to advertise or post for thirty days or more not less than one notice at the courthouse and one in each County Commissioner's District in the most conspicuous places for sealed bids to oversee the working of the public roads and bridges of the county for a term of one year, requiring the said bids to be filed with the Clerk of the Board of County Commissioners not later than twenty-four hours prior to the time appointed by the Board of County Commissioners for the opening of said bids, and at the next regular meeting of the Board of County Commissioners, after the expiration of the thirty days' notice; the Chairman of the Board of County Commissioners (in open session) shall open and read or cause to be read, each and every bid so filed; and it shall be the duty of the Board of County Commissioners to award
