ployment, said Road Superintendent shall be responsible. Such deputies when so appointed, shall have actual charge of all the work to be done, subject to the control and direction of the Road Superintendent, and they shall receive as compensation for their several services, a salary to be fixed by the Board of County Commissioners not to exceed the sum of seven hundred and twenty dollars per annum. It shall be the duty of the said Road SuperRoad Super- intendent, either in person or by deputy to cause the road hands assigned to the several roads in each district, to be summoned to work said roads at such times and places and in such numbers as may be deemed to be essential or expedient; the Road Superintendent, or deputy shall have charge of such persons so summoned as well as all persons employed to perform work on roads and bridges and shall direct and oversee such persons so working said roads and bridges and designate the work to be done and performed and as well as the manner of the performance thereof. He shall take charge of all tools, implements. teams and other property which are to be used in the working of the public roads of said county, and shall be required to give proper receipts therefor, and shall be required to make a strict accounting of all property which from any cause or for any purpose shall come into his hands for the purposes aforesaid. He shall once each month make a true and correct report in writing to the Board of County Commissioners, which report shall show all the work done for the previous month, as well as the amount of tools, teams, implements, supplies and other property on hand which belongs to the county at the time of making each report.

It shall be the duty of the Board of County Commis for and care sioners upon the requisition of the Road Superintendent to furnish all tools, implements, teams and supplies which may be necessary in order to carry on the work, and upon the termination of the term of employment of the said Road Superintendent said Board shall have a settlement with such Superintendent, and shall receive from him all tools, implements or other property which were in his hands, control or custody and shall receipt him therefor, and should any of said property be not turned over by the Superintendent at the time of such final settlement, and should not be satisfactorily accounted therefor, then in

such event the said Superintendent and his bondsmen shall be held liable for the value thereof.

Sec. 11. The Road Superintendent shall have the authority by and with the approval of the Board of County of labor. Commissioners to employ such labor by the day or the month at the expense of the county, as the said Road Superintendent and the said Board of County Commission ers shall from time to time deem necessary or expedient, to work on the public roads and bridges of said county. such persons so employed however, shall be required to do and perform such work under the immediate direction and control of the Road Superintendent or his lawful deputy.

Sec. 12. The Board of County Commissioners is hereby authorized to let out any portion of the work on the roads and bridges in said county on contract as in their judgment the work can be so done to the advantage of the county. In awarding any work on the roads and bridges under contract, the same shall be let to the lowest bidder, after due notice for bids, based upon specification and plans furnished by the Road Superintendent and approved by the Board of County Commissioners, upon the contractor complying with such terms as to bond, as the Board of County Commissioners may require; the Board of County Commissioners, however, at their discretion, may reject any and all bids and may require new bids to be made for such work which is proposed to be let out under contract. All work contracted is to be done under the immediate supervision and direction of the Road Superintendent or one of his deputies, and shall be approved, before final settlement is made therefor, by the Board of County Commissioners and the Road Superintendent.

Sec. 13. That all laws and parts of laws in conflict with the provisions of this Act be and the same are hereby repealed.

Sec. 14. This Act shall take effect on the 19th day of June, A. D. 1911, after approval by the Governor.

CHAPTER 6277-(No. 158).

AN ACT to Repeal Chapter 5767 of the Laws of Florida, the Same Being Entitled "An Act to Organize a County Court in and for the County of Lafayette; to Prescribe the Terms Thereof; and to Provide for the Appointment of a Prosecuting Attorney, and for His Compensation, and for That of the Judge of Said Court," Approved May 7, 1907.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That Chapter 5767 of the Laws of Florida, entitled "An Act to organize a County Court in and for the County of Lafayette; to prescribe the terms thereof; and to provide for the appointment of a Prosecuting Attorney, and for his compensation, and for that of the Judge of said court," approved May 7, 1907, be and the same is hereby repealed.

Sec. 2. That all suits pending and undetermined in said court at the time this Act shall go into effect, and all judgments of said court unsatisfied shall be transferred by the Clerk of said County Court to the court having jurisdiction of said causes, and said courts shall have the power to try and determine said cause and issue executions upon all judgments recovered therein or hereby transferred to said courts, and to do all things necessary and proper for complete determination of said causes.

Sec. 3. That all causes, so transferred, disposed of by the several Justices of the Peace of Lafayette County and by the Judge of the Circuit Court shall be as lawful and binding as if said causes had been commenced in their respective courts.

Sec. 4. This Act shall go into effect immediately upon its passage and approval by the Governor.

CHAPTER 6278-(No. 159).

AN ACT to Repeal Chapter 5293 of the Acts of 1903, the
Same Being An Act to Regulate the Hunting of Deer,
Turkey and Other Wild Game in Lafayette County.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That Chapter 5293 of the Acts of 1903, the same being An Act to regulate the hunting of deer, turkey and other wild game in Lafayette County be, and the same is hereby repealed.

Sec. 2. This Act shall take effect upon becoming a law.

CHAPTER 6279-(No. 160).

AN ACT to Prevent the Girdling, Cutting Down or Mutilating of Any Water Oak or Live Oak Trees Now Growing, or the Girdling, Cutting Down or Mutilating of Any Trees of Any Character That Have Been Set Out or Planted, or That May Hereafter be Set Out or Planted, Within Twenty Feet from the Center of Any Public Highway in Lake County, of this State.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That from and after the passage of this Act it shall be unlawful for any person or persons to girdle, cut down or in any manner mutilate any water oak or live oak trees now growing, or to girdle, cut down or mutilate in any manner any trees that have been set out or planted, or to girdle, cut down or mutilate any trees that may hereafter be set out or planted, within twenty feet from the center on each side of any public highway in Lake County, of this State.

Sec. 2. Any person or persons violating the provisions

of this Act shall be deemed guilty of a misdemeanor and shall be punished accordingly.

Sec. 3. This Act shall take effect immediately upon its passage and approval by the Governor.

CHAPTER 6280 (No. 161).

AN ACT for the Protection and Preservation of Deer, Turkey, Quail and Other Wild Game and Birds of Lee County, Florida, and Designating the Time When They Can be Hunted, Chased and Killed and When They Cannot be Hunted, Chased and Killed or Molested, and Providing for a License Tax to be Paid by Nonresidents of the State of Florida, for a Permit to Hunt, Chase and Kill Same, and Providing for the Appointment of a Game Warden and Deputy Game Warden, and Defining Their Powers and Duties and Providing a Special Game Fund for the Prosecution of Violations of Such Game Laws, and for Paying the Expenses Thereof, and Declaring Violations Thereof to be Misdemeanors.

Be it Enacted by the Legislature of the State of Florida:

Section 1. The months of November, December and January shall be and are hereby designated as the open season in which deer, turkey, quail and other wild game and birds of the said County of Lee may be hunted, chased and killed subject to the provisions of this Act and such game shall not be hunted, chased, killed or molested during any other period; Provided, That the owners or lessees of land or their employees or agents may kill any of such game upon such land at any time when such game may be found destroying or injuring any fruit or vege tables upon said land.
