CHAPTER 6267—(No. 148).

AN ACT to Amend Section Four (4) of Chapter 5984 of the Laws of Florida, Acts of 1909, Being Entitled "An Act to Organize a County Court in and for the County of Gadsden; to Prescribe the Terms Thereof and to Provide for the Appointment of a Prosecuting Attorney and for His Compensation and for That of the Judge of the Said Court.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That Section Four (4) of Chapter 5984 of the Laws of Florida, Acts of 1909, being entitled "An Act to organize a County Court in and for the County of Gadsden; to prescribe the terms thereof and to provide for the appointment of a Prosecuting Attorney and for his compensation, and for that of the Judge of said court," be amended so as to read as follows.

Sec. 4. The Judge of said court shall receive a salary of three hundred ($300.00) per annum, to be paid quarterly by the Treasurer of the county, upon a warrant to be issued by the Board of County Commissioners for said county, and a fee of three ($3.00) for each case docketed in said court to be taxed and paid as other costs in said court.

Sec. 2. This Act shall take effect immediately upon its passage and approval by the Governor.

CHAPTER 6268-(No. 149).

AN ACT to Authorize the County Commissioners of Gads-
den County of This State to Use for Any Special County
Purpose the Surplus Money in the Fund Raised for
General County Purposes.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That whenever the fund raised for any spec

ial county purpose has been exhausted, or no tax has been levied for any special county purpose authorized by law, and it shall be necessary in the opinion of the Board of County Commissioners of Gadsden County to continue the work for which such specified fund has been provided, or might have been lawfully raised, such Board of County Commissioners are authorized and empowered to use for such special county purpose that shall not be necessary for the current and ordinary expenses of the county, any money in the fund raised for county purposes generally for the year for which such general fund was raised; and such board shall have authority to cause to be transferred by the County Treasurer such part of the surplus money in the general county fund as may be necessary to any special county fund in such amounts as they may deem for the best interest for the county.

Sec. 2. The County Treasurer shall not be allowed any commission for transferring one fund to another.

Sec. 3. All laws and parts of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall take effect immediately upon its approval by the Governor.

CHAPTER 6269-(No. 150).

AN ACT to Validate the Acts of the Boards of County
Commissioners of Gadsden County, of this State, in
Drawing Warrants on the General Revenue Fund of the
County, in Payment for Expenses Incurred for Road or
Bridge Purposes, and of Validating Such Warrants.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That all county warrants heretofore drawn by the Board of County Commissioners of Gadsden Coun ty of this State, against or on the fund raised in said county for general county purposes, and issued in pay ment of and for expenses, obligations, contracts incurred

or made by such Board for constructing, working, building or maintaining roads and bridges, or either of them, in said county, and all warrants so issued as aforesaid, be, and the same are hereby declared to be legal and valid in all respects and for all purposes.

Sec. 2. That all laws and parts of laws in conflict with the provisions of this Act be, and the same are hereby, repealed.

Sec. 3. This Act shall take effect immediately upon its passage and approval by the Governor.

CHAPTER 6270-(No. 151).

AN ACT to Authorize the Board of County Commissioners of Gadsden County, Florida, to Appropriate Moneys from the General Revenue Fund of Said County for Advertising the Resources of Said County, and to Offer Prizes for County Fair Purposes.

Be it Enacted by the Legislature of the State of Florida:

Section 1. The Board of County Commissioners of Gadsden County, Florida, may appropriate annually any sum of money not exceeding One Thousand Dollars, out of the General Revenue Fund of said county for advertising the resources of said county and for county fairs.

Sec. 2. The money so appropriated shall be drawn by warrant or warrants on the County Treasurer of said county, and he shall pay the same from the General Reve nue Fund.

Sec. 3. The Board of County Commissioners shall use their discretion in setting apart the amount to be used for advertising and the amount to be set aside for the payment for prizes for products exhibited in the county fairs. Sec. 4. All laws or parts of laws in conflict with this law are hereby repealed.

Sec. 5. This Act shall go into effect upon its passage and approval by the Governor.

CHAPTER 6271-(No. 152).

AN ACT Authorizing the County Commissioners of Gadsden County, Florida, to Pay Certain Expense Incurred by the County Treasurer of Said County.

Whereas, The County Treasurer of Gadsden County refused to pay a certain warrant issued by the County Commissioners of said county upon the general revenue fund of said county after the road and bridge fund of said county had been exhausted, for services rendered by J. W. Harrell, as Road and Bridge Superintendent, employed by said County Commissioners; and,

Whereas, Proceedings by mandamus were instituted by the said Harrell against the said County Treasurer seeking to compel him to pay said warrant, thereby necessitating the said treasurer to employ legal counsel to advise him, and to represent him in the Supreme Court; and,

Whereas, The County Treasurer's actions in refusing to pay such warrant was sustained by both the Circuit Court and the Supreme Court; Now, therefore,

Be it Enacted by the Legislature of the State of Florida:

Section 1. That the County Commissioners of Gadsden County, Florida, are hereby authorized to pay to A. S. Woodberry, he being the County Treasurer of Gadsden County, such sum as they may find to have been expended by the said Woodberry for legal services in defending the above litigation; Provided, Said amount is not to exceed fifty dollars.

Sec. 2. This Act shall take effect immediately upon its passage and approval by the Governor.

CHAPTER 6272-(No. 153).

AN ACT to Legalize the Election Held on the 16th Day of May, A. D. 1911, in Gadsden County, State of Florida, to Determine Whether Bonds Should be Issued by the Board of County Commissioners for Said County as Proposed and Provided by a Resolution Voted Upon and Passed by Said Board of County Commissioners of Gadsden County, Florida, Passed in Open Session at a Regular Meeting of Said Board on the 3rd Day of April, A. D. 1911, and to Declare and Render Valid Said Resolution and to Authorize the Issuance of Bonds as Provided by Said Resolution.

PREAMBLE.

Whereas, A resolution was passed in open session by the
Board of County Commissioners of Gadsden County,
Florida, on the 3rd day of April, A. D. 1911, and was
legally published and became a legal resolution of said
county and board, recorded in the minutes of the meet-
ing of said board on the 3rd day of April, A. D. 1911,
proposing a bond issue for said county for the purpose
of erecting a courthouse in said county; and,
Whereas, A notice of election was duly passed in open

session by the said Board of County Commissioners on the 3rd day of April, A. D. 1911, and duly published in the several newspapers of said county, as provided by said resolution and according to law calling an election as provided in said resolution, which election was had and held in said County of Gadsden on the 16th day of May, A. D. 1911, resulting in a majority of the legal voters of Gadsden County, Florida, who were qualified to vote and voting at such election, approving the issue of bonds as provided in said resolution; and, Whereas, The said Board of County Commissioners of Gadsden County did at its said meeting on the 3rd day of May, A. D. 1911, in open session designate and appoint certain legal voters of said County of Gadsden.
