Indian River North in the said counties of Brevard and Volusia, except in the day time, to wit, after sunrise and before sun set.

Sec. 3. No person or persons, firm or corporation shall sell or expose for sale at any time in the said counties of Brevard and Volusia, any wild duck, and it shall be unlawful for any person or persons, firm or corporation to ship or transport any wild ducks from said counties, for sale, at any time, and it shall be unlawful for any common carrier to transport any wild duck, from the said counties at any time, to be sold.

Sec. 4. Any person or persons, firm or corporation violating the provisions of this Act shall be punished as prescribed by the General Laws of this State, for the violation of special local laws.

CHAPTER 6253-(No. 134).

AN ACT Regulating the Manner of Catching Fish in the
Fresh Water Lakes and Streams of Calhoun County;
Prohibiting Shipment of Same Out of Said County, and
Providing Punishment for Violations of This Act.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That from and after the passage of this Act, it shall be unlawful for any person, or persons, to catch, or take, any fish from the fresh water lakes and streams of Calhoun County in any manner, except by fishing with hook and line, or bob, and any person or persons, violating the provisions of this Section by catching, or taking, any fish from said fresh water lakes and streams with any seine, net, basket, trap or any other device or means, shall be guilty of a misdemeanor.

Sec. 2. It shall be unlawful for any person, or persons, to catch or take any fish from the fresh water lakes and streams of said county, even with a hook and line, or bob, until after such person, or persons, shall have obtained a

license from the County Judge of said county, authorizing such person, or persons, to so fish. The amount of such license shall be $1.50 per annum for each license, and no fractional license shall issue. Such license shall be issued by the County Judge of said county, and shall authorize the holder to catch fish with hook and line, or bob, in the fresh water lakes and streams of Calhoun County at any time of the year (except Sundays), and such license shall expire on the 31st day of December of each year; but no person shall be permitted to take, or catch, more than thirty-five (35) fish per day, even under such license; and the possession by any person, or persons, of more than thirty-five fish for each person, shall be prima facie evidence of guilt. And at the time of issuing the license, the County Judge shall deliver to the holder thereof, a tag or button, and it shall not be lawful for any person to catch any fish in the said fresh water lakes or streams, even when holding a license unless the said tag or button is worn exposed to public view at all times while fishing. Any person violating any of the provisions of this section shall be guilty of a misdemeanor.

Sec. 4. Sec. 5. Upon the recommendation of the Board of County Commissioners of Calhoun County, the Governor shall appoint a Fish Warden for said county, who shall hold his office for two years, and shall receive from the general revenue fund of said county, a salary of fifty ($50) dollars per month, while in the actual performance of his duties as Fish Warden, and such Fish Warden shall have

the authority to arrest, either with or without warrant, any person, or persons, who violate any of the provisions of this Act, and take them for trial before the County Judge, or any Justice of the Peace having jurisdiction. The said Fish Warden shall give bond, payable to the Governor of the State of Florida, in the sum of five hundred ($500.00) dollars, conditioned for the faithful performance of his duties as such Fish Warden. In the event of failure to perform his duties under this law, the said Fish Warden may be removed from office by the Governor upon the suggestion of the Board of County Commissioners of Calhoun County. The said Fish Warden shall report to the Board of County Commissioners every three months his acts and doings as such fish warden, and shall account at such time for all moneys that may have come into his possession as such fish warden, and any failure upon his part to so report and account, shall be grounds for his removal.

Sec. 6. All laws in conflict with the provisions of this Act are hereby repealed, and this Act shall go into effect immediately upon its approval by the Governor, or upon its becoming a law without his approval.

CHAPTER 6254—(No. 135).

AN ACT to Prohibit the Catching and Removal of Fish from the Fresh Waters, Lakes and Streams of Calhoun County, Florida, Between the Fifteenth Day of April and the First Day of June of Each and Every Year; and also to Prohibit the Shipping or Transporting of Any Fish so Caught from Such Waters Outside of the Limits of the State of Florida.

Be it Enacted by the Legislature of the State of Florida:

Section 1. It shall be unlawful to fish with hook and line, seine, drag-net or in any manner catch or remove any fish from the fresh waters, lakes and streams of Calhoun County, Florida, between the fifteenth day of April and the first day of June of each and every year.

Sec. 2. It shall be unlawful for any person or persons, firm or corporation to ship or transport any fish caught from the fresh waters, lakes and streams of Calhoun County, Florida, beyond the limits of this State.

Sec. 3. Any person violating the provisions of Sections 1 or 2 of this Act shall be deemed guilty of a misdemeanor and shall be punished as by statutes in such cases made and provided.

Sec. 4. That all laws and parts of laws in conflict with this Act be, and the same are hereby repealed.

Sec. 5. This Act shall take effect immediately upon its passage and approval by the Governor. Approved June 5, 1911.

AN ACT to Prohibit the Catching or Taking of Food Fish in the Waters of Homosassa River and Its Tributaries in the County of Citrus, in the State of Florida, by the Use of Seines, Gill-nets, Haul-nets or by any other kind of Nets or Device Except Cast-nets, Hook and Line, and Prescribing That Its Violation Shall be Punished by General Laws in Such Cases Made and Provided.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That from and after the passage of this Act it shall be unlawful for any person or persons to catch or take food fish from the waters of the Homosassa River. River and its tributaries situated in Citrus County, in the State of Florida, by the use of seines, gill-nets, dragnets or any other kind of nets or device except castnets, hook and line.

Sec. 2. That whenever any person or persons are found with any device referred to in Section 1 except cast-nets, hook and line in any of said waters it will be considered prima facie evidence of his or their guilt.

AN ACT to Prohibit the Catching or Taking of Food Fish in the Waters of Chassahowitzka River, and its Tributaries, in the County of Citrus, State of Florida, by the use of Seines, Gill-nets, Haul-nets, Drag-nets or by any Other Kind of Nets or Device Except CastNets, Hook and Line, Spear or Gig, and Prescribing That Its Violation Shall be Deemed a Misdemeanor, and Shall be Punished by General Laws in Such Cases Made and Provided.

Be it Enacted by the Legislature of the State of Florida:

Section 1. That from and after the passage of this Act it shall be unlawful for any person or persons to catch or take food fish from the waters of the Chassahowitzka River or its tributaries situated in the County of Citrus, State of Florida, by the use of seines, gill-nets, drag-nets, haul-nets, or any other kinds of nets or device except cast-nets, hooks and lines, gigs or spears.

Sec. 2. That whenever any person or persons are found with any of the devices referred to in Section 1 except cast-nets, hooks and lines, gigs or spears, in any of said waters it will be considered prima facie evidence of his or their guilt.

Sec. 3. Any person or persons violating any of the provisions of this Act shall be deemed guilty of a misdemeanor, and upon conviction shall be punished by General Laws in such cases enacted.

Sec. 4. This Act shall go into effect immediately upon its passage and approval of the Governor.
