GENERAL ORDINANCES

AN ORDINANCE

Restraining the Running at Large of Certain Animals.
Passed Nov. 29, 1915; Approved Dec. 1, 1915.

The city of Duluth does ordain:

What Animals Not to Run at Large.

Section 1. No person shall suffer or permit any horse, mule, cattle, swine, sheep, goat or other beast, or any chicken, turkey, goose or other poultry owned or controlled by him to run at large within the limits of the city of Duluth.

Pound Limits

Section 2. The pound limits of the city of Duluth shall be the same as the city limits.

Pound Districts.

Section 3

There shall be ten pound districts within the city of Duluth as follows:

The First and Second precincts of the First ward of said city shall constitute the first pound district.

The Fourth precincts of the First ward shall constitute the second pound district.

The Third, Fifth and Sixth precincts of the First ward and the Second ward of said city shall constitute the third pound district.

The Third and Fourth wards and all of the Fifth ward of said city excepting the Fifth precinct thereof shall constitute the fourth pound district.

The Sixth ward and all that part of the Seventh ward lying easterly of the center line of Twenty-sixth avenue west and the same produced to the city limits, shall constitute the fifth pound district.

All that part of the Seventh ward lying between the center line of Twenty-sixth avenue west and the same produced to the city limits on the east and the following described line on the west. to-wit: Beginning at the center line of Forty-seventh avenue west at the southerly end thereof; thence along the center line of Fortyseventh avenue west to the center line of Norton avenue (Eighth street); thence along the center line of Norton avenue (Eighth street) to the center line of Fifty-third avenue west; thence north along the center line of Fifty-third avenue west and the same produced in a direct line to the city limits, shall constitute the sixth pound district.

All that part of the Seventh ward lying westerly of the last above described line, and all that part of the Eighth ward lying easterly of the center line of Seventy-third avenue west, and the same extended in a direct line to the city limits, shall constitute the seventh pound district.

All that part of the Eighth ward lying between the center line of Seventy-third avenue west and the same extended in a direct line to the city limits, and the westerly line of sections 4 and 9, township 48, north of range 15, west of the Fourth Principal Meridian, shall constitute the eighth pound district.

All that part of the Eighth ward lying westerly of the west line of sections 4 and 9, township 48, north of range 15, west of the Fourth Principal Meridian shall constitute the ninth pound district.

The Fifth precinct of the Fifth ward shall constitute the tenth pound district.

Public Pounds.

Section 4. There shall be ten public pounds in the city of Duluth, one of which shall be situated in each of the pound districts hereinbefore provided for.

Poundmasters. Number. Appointment.

Section 5. There shall be at least ten pound masters in the city of Duluth, one for each of the pound districts hereinabove provided for.

Poundmasters shall be in the division of Public Safety.

The duties of any poundmaster may be performed by any employe of the city designated by the Commissioner of Public Safety; such designation to be in writing and filed with the city clerk; such other employe to serve without additional pay.

The poundmaster from any pound district shall also perform such other work, either as a special policeman or as an employe of any departments of the city, as the Commissioner of Public Safety shall direct, and at such compensation as shall be fixed for such work, under the provisions of the Charter. A park policeman may be appointed as poundmaster, by the Commissioner of Public Safety, to serve in public parks, without additional compensation from the city.

Poundmasters, Special Duties of.

Section 6. In addition to the other duties prescribed in this ordinance, the poundmasters shall have the powers and perform the duties of policemen. It shall also be the duty of the poundmasters in their respective pound districts to see that dogs and other animals required to be licensed by the ordinances of the city of Duluth, are in fact so licensed, and if they find any such animals running at large without a license, they shall impound the same. Section 7. It shall be the duty of the poundmasters to impound any animal found running at large contrary to the provisions of this ordinance, in their respective pound districts, in the public pound for the district in which such animal is found running at large.

Poundmasters, Duties of as to Animals Impounded.

Section 8. The poundmaster shall provide subsistence for all animals impounded, and the expenses thereof shall be paid by the owner or the person claiming the same. Within twenty-four

(24) hours after the animal is mpounded the poundmaster shall cause three notices containing a description of the impounded animal to be posted as follows: One at the city postoffice, one at the city hall and one at the public pound in which the animal is impounded. Said notices shall further state a time, not less than ten (10) days from the time of the posting of said notice, and a place when and where said animal, if not redeemed, as hereinafter provided, shall be sold at public auction to the highest bidder.

And in case the impounded animal is an unlicensed dog, such animal shall be impounded and disposed of according to the provisions of Ordinance No. 331 of the City of Duluth.

Any animal impounded under the provisions of this ordinance may be redeemed at any time before sale by paying to the poundmaster all the expenses of taking and keeping the same, and in the case of any horse, mule, cattle, swine, sheep, goat or other beast, a penalty of two (2) dollars for each animal and in case of any chicken, turkey, goose or other poultry, a penalty of twenty-five (25) cents for each fowl.

Poundmasters, Certificate of Sale of Animals Impounded.

Section 9. At the close of such sale the poundmaster shall give to the purchaser a certificate containing a description of the animal sold, the amount of poundage dues for which said animal was sold, the price for which said animal was sold, and the name of the person to whom sold.

Poundmasters, Monthly Reports.

Section 10. The poundmaster shall render a monthly statement to the council, under oath, of all fees, charges and moneys from sales and penalties received by him, and after deducting his fees and expenses paid or incurred by him, shall pay the balance over to the city treasurer, and file said treasurer's receipt with said

statement.

Permitting Animals to Trespass Prohibited.

Section 11 It shall be unlawful within the city of Duluth for any owner or person having charge of any of the animals specified in section one of this ordinance, to allow the same to trespass upon or run over any lawn, garden, improved lot or fenced private grounds. Breaking Open Public Pounds, Etc., or Resisting Poundmaster Prohibited.

Section 12. It shall be unlawful for any person to break open, or in any manner, directly or indirectly, assist in breaking open any public pound in said city or to rescue therefrom any animal impounded therein or to hinder, delay or obstruct the poundmaster in securing in a public pound any animal liable to be impounded therein.

Wards and Precincts.

Section 13. The wards and precincts herein referred to are the wards and precincts of the City of Duluth as the same existed on November 1, 1913.

Section 14. Any person violating any of the provisions of this
