Furthermore, unless the license being assigned has been paid in full, the approval is conditioned upon the assignee's execution of the applicable financing statements (i.e. the UCC-1 Forms) and payment of all costs associated with the preparation and recordation of the financing statements, on or before the consummation date. Where applicable, the Bureau will send all assignors listed herein the appropriate loan documents and financing statements upon notification of the proposed consummation date. Additionally, all installment payments must be current on the consummation date. Upon receipt of the letter required by Section 1.948(d) of the Commission's rules, and satisfaction of all requisite conditions, including execution of the appropriate documents, the Bureau will consider the assignment "complete" and will issue the license to the assignee with the date of the license grant identical to the date upon which the transaction closed, thus completing the assignment.

Failure of the parties to comply with Section 1.948(d) of the Commission's rules, or any specific condition described above, will result in automatic cancellation of the Commission's assignment approval, and dismissal of the underlying assignment application.

In order to be current, the installment payment may not be in the non-delinquency period or grace period. On April 13, 2000, the Commission released an order granting a number of formal complaints concerning the assessment of end user carrier line charges on independent payphone providers by certain local exchange carriers.' The complaints listed in the caption above were inadvertently omitted from the April 13 Liability Order.

ACCORDINGLY, IT IS ORDERED, pursuant to Sections 4(i), 4(j), 201(b), and 208 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 154(j), 201(b), and 208 and the authority delegated in sections 0.111 and 0.311 of the Commission's rules, 47 C.F.R. §§ 0.111 and 0.311, that the above-captioned cases shall be added to the caption of the April 13 Liability Order and shall be covered by the determinations therein.

In this Forfeiture Order (“Order"), we issue a monetary forfeiture in the amount of thirteen thousand five hundred dollars ($13,500) to Jerry Smith for willful and repeated violations of Sections 95.409(a), 95.410(a) and 95.411(a)(1) of the Commission's Rules ("Rules").' The noted violations involve Mr. Smith's operation of a Citizens Band (“CB") Radio Station with a non-typeaccepted transmitter, with a transmitter output power greater than four watts carrier power in the AM (A3) mode, and with an external RF power amplifier.

On January 8, 2001, the Commission's Philadelphia, Pennsylvania Field Office issued a Notice of Apparent Liability for Forfeiture (“NAL”) in the amount of thirteen thousand five hundred dollars ($13,500) to Mr. Smith for the noted violations.2 Mr. Smith has not filed a response. Based on the information before us, we affirm this forfeiture.

Accordingly, IT IS ORDERED that, pursuant to Section 503(b) of the Communications Act of 1934, as amended (“Act”),3 and Sections 0.111, 0.311 and 1.80(f)(4) of the Rules,* Jerry Smith IS LIABLE FOR A MONETARY FORFEITURE in the amount of thirteen thousand five hundred dollars ($13,500) for operating a CB Radio Station with a non-type-accepted transmitter, with a transmitter output power greater than four watts carrier power in the AM (A3) mode, and with an external RF power amplifier, in willful and repeated violation of Sections 95.409(a), 95.410(a) and 95.411(a)(1) of the Rules.

Payment of the forfeiture shall be made in the manner provided for in Section 1.80 of the Rules' within 30 days of the release of this Order. If the forfeiture is not paid within the period specified,

the case may be referred to the Department of Justice for collection pursuant to Section 504(a) of the Act. Payment shall be made by mailing a check or similar instrument, payable to the order of the Federal Communications Commission, to the Federal Communications Commission, Forfeiture Collection Section, Finance Branch, P.O. Box 73482, Chicago, Illinois 60673-7482. The payment should note the NAL/Acct. No. referenced above. Requests for full payment under an installment plan should be sent to: Chief, Revenue and Receivables Operations Group, 445 12th Street, S.W., Washington, D.C. 20554.7

5. IT IS FURTHER ORDERED that, a copy of this Order shall be sent by Certified Mail, Return Receipt Requested, to Jerry Smith, 125 Commonwealth Avenue, Claymont, DE 19703.

PETITIONER REQUESTS CARRYOVER OF UNUSED FUNDS IN THE FEDERAL UNIVERSAL SERVICE SUPPORT MECHANISM FOR SCHOOLS AND

Petitioner has filed three requests for the Commission to reconsider the application of unused funds in the schools and libraries universal service support mechanism. 1 Specifically, the petitioner requests that unused funds from Year One of the schools and libraries mechanism be carried forward for use in subsequent funding years of the schools and libraries mechanism.

Pursuant to sections 1.415 and 1.419 of the Commission's rules, 47 C.F.R. §§ 1.415, 1.419, interested parties may file comments on or before April 26, 2001, and reply comments on or before May 3, 2001. Comments may be filed using the Commission's Electronic Comment Filing System (ECFS) or by filing paper copies. See Electronic Filing of Documents in Rulemaking Proceedings, 63 Fed. Reg. 24,121 (1998). Comments filed through the ECFS can be sent as an electronic file via the Internet to <http://www.fcc.gov/e-file/ecfs.html>. Generally, only one copy of an electronic submission must be filed.
