for the purpose of killing, injuring or catching fish, shall be guilty of a misdemeanor and upon conviction, before any court having jurisdiction, shall be fined not less than fifteen ($15.00) nor more than one hundred ($100.00) dollars for each offense.

§ 5. Illegal Devices or Contrivances for Killing or Injuring Fish.-Any person or persons who, take or attempt to take from any of the waters of the State except private ponds any fish with a gig or spear, or by fishing under the rock, groping, grabbing, or tickling, or catching in any manner with the hands unless said fish shall be first caught by hook and line, trot line, hand line, or set line, shall be guilty of a misdemeanor and on conviction, before any court having jurisdiction, shall be fined not less than fifteen ($15.00) nor more than one hundred ($100.00) dollars.

§ 6. To Prevent the Killing of Fish by Use of Sledge or Similar Device.-That it shall be unlawful for any person or persons to kill, injure, shock, or stun, in any manner, any fish by striking upon the rock or ice, and any person so doing by any of the above mentioned methods shall be guilty of a misdemeanor and shall be fined upon conviction thereof, before any court of competent jurisdiction, not less than fifteen ($15.00) nor more than one hundred ($100.00) dollars for each offense.

§ 7. Lawful Manner of Catching Bait to be Used for Fishing Purposes.-Any person or persons may take from any of the public waters of this State minnows to be used for bait for fishing with pole and line, hand lines, set lines, trot lines; provided, however, if any fish are caught when seining for bait, it will be a misdemeanor if such fish are not, without injury, immediately returned to the water from which taken, and upon conviction thereof, be

fore any court having jurisdiction, shall be fined not less than fifteen ($15.00) nor more than one hundred ($100.00) for each offense.

8. Charge to Jury.-It shall be the duty of the judge in all circuit courts of the respective counties of the State to give this act specially in charge to each grand jury in said court, and it shall also be the duty of all judges holding courts of inquiry to give this and all other acts for the protection of game and fish specially in charge to each jury of circuit courts.

9. That the county courts and magistrates courts of the respective counties of this State wherein any of the offenses herein enumerated are committed shall have jurisdiction concurrent with the circuit courts to try such offenses and assess fines for the same.

10. Local and State Laws Released.-All laws and parts of laws general, special or local, in conflict with the provisions of this act as to the fish laws of this State, are repealed in so far as they so conflict herewith.

CHAPTER 30.

AN ACT amending an Act entitled "An Act for the protection of game and fish," Chapter 35, Acts 1912. Approved March 12, 1912.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

Amend Section 25 by striking out the following words, beginning with "of" in the 11th line and ending with the word "dollars" in the 12th line, and substituting therefor the words "seven dollars

and fifty cents ($7.50)," so that said section when amended shall read as follows:

Section 25. Non-Resident or Alien Hunter's License-How Obtained.-Any non-resident or alien of this State, or person who has not been a resident of this State for one year, may procure a license for hunting by filing his or her affidavit with the county clerk of any county in this State, stating his or her age, place of residence, postoffice address, height, color, color of his or her eyes, and hair, and the fact whether he or she can write his or her name, and by paying to said county clerk the sum of seven dollars and fifty cents ($7.50). which license shall entitle him or her to hunt in all the counties of this State, after receiving the permission of the owner or agent of the land.

Amend Section 30 by striking out in the 4th line the word "May" and inserting in lieu thereof the word "January" and by striking out the word "December" in line 7, between the word "of” and “in” in line 7, substituting in lieu thereof the word "January," so that said section as amended shall read as follows:

Section 30. License Delivered to and Returned by County Clerks.-The Game and Fish Commission shall deliver to each county clerk in the State ten days before the first day of January in each year as many licenses as may be required and shall charge said clerk with the number issued to him. On the fifteenth day of January in each year and within ten days thereafter each county clerk shall return to the Commission all unused licenses and stubs of licenses used.

Amend Section 34 by striking out the word "fifty" after the word "than" and before the word "nor" in the seventh line, and inserting in lieu

thereof the word "fifteen," and by striking out the word "two" in line seven between the words "than" and "hundred" and substituting in lieu thereof the word "one." Further amend Section thirty-four by striking out all of the words beginning with "and" in the thirteenth line and ending with "theirs" in the fourteenth line, so that said section as amended shall read as follows:

Section 34. Hunting Without License Prohibited. Any person who hunts in this State without first obtaining a license, permitting him or her to do so, or any person who lends or transfers his or her hunting license to another, upon conviction, shall be punished by a fine of not less than fifteen nor more than one hundred ($100.00) dollars, to which may be added imprisonment in the county jail for any period not exceeding thirty days, but any resident owner, landlord or tenant and members of their families may hunt upon their own lands or leasehold in season without obtaining a hunting license as hereinbefore provided.

Amend Section 36 by adding the following words after the word "conviction" in the eleventh line and before the word "such" in the eleventh line. "In case of conviction a fee of five dollars ($5.00) shall be assessed as costs and it shall be the duty of the trial judge to collect this sum from the defendant and pay it to the person securing the apprehension and conviction of the parties convicted for violation of the game and fish laws," so that said section when amended shall read as follows:

Section 36. Fines and Penalties-Distribution of. After payment of the percentage of fines allowed by the law to other public officers, one-half of the remainder of all fines, forfeitures and penalties collected under this act or any other law of

this State, relating to fish and game, shall be paid to the executive agent, warden, or other persons appointed by the commission, sheriff, or his deputy, constable or his deputy, or peace officer, securing the apprehension or conviction. In case of conviction a fee of five dollars ($5.00) shall be assessed as costs and it shall be the duty of the trial judge to collect this sum from the defendant and pay it to the person securing the apprehension and conviction of the parties convicted for violation of the game and fish laws. Such money shall be paid by the court collecting the same and the remainder shall be forwarded to the State Treasurer and credited to the Fish and Game Commission fund.

CHAPTER 31.

AN ACT for the protection of game birds and game animals; fixing open and closed seasons and providing penalties for violation.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. Quail or Bobwhite-When Unlawful to Catch or Kill.-No person shall between the second day of January and the 14th day of November, both days inclusive, in any year, catch, kill, injure, or pursue with such intent, any quail or Bobwhite, or have in possession any quail or Bobwhite, or any part of any quail or Bobwhite, dead or alive, no matter when or where caught or killed, whether caught or killed in this State, or any other state, territory, country or place, except as hereinafter provided in section twelve of this act.
