CHAPTER 80. APPROPRIATION-DEFICIENCY NATIONAL GUARD. House Bill No. 60. AN ACT to make an appropriation to pay the deficiencies of the National Guard for the fiscal year ending June 30, 1909, and declaring an emergency. Be It Enacted By the People of the State of Oklahoma: Appropriation. Section 1. There is hereby appropriated out of any moneys in the state treasury not otherwise appropriated the sum of seven hundred thirty-five and 53/100 ($735.53) dollars or so much thereof as may be necessary, to pay the deficiencies for the support of the National Guard for the fiscal year ending June 30, 1909, and the State Auditor shall issue warrants upon the State Treasurer for such portion thereof, as may be found to be due upon the auditing of the respective claims in favor of the persons to whom such claims are allowed: Provided, that all claims and accounts against the state shall be itemized and sworn to be true and correct, and shall bear the approval of the Adjutant General before being audited. Approved March 24, 1910. CHAPTER 81. FOREIGN CORPORATIONS-EXAMINATION OF OFFICERS, AGENTS AND RECORDS. House Bill No. 62. AN ACT requiring foreign corporations doing business in Oklahoma to produce for inspection and examination, officers, agents, books and papers in the State of Oklahoma, providing penalty for failure, and declaring an emergency. Be It Enacted By the People of the State of Oklahoma: Section 1. It is hereby made the duty of each and every foreign corporation doing business in the State of Oklahoma, in any action pending in any court of record, within the state. wherein the State of Oklahoma, or any of the officers in their official capacity are parties, upon the application of said state, or said officers and upon the order of the presiding judge of said court, for which authority is hereby vested, upon reasonable notice, at a time and place within the state to be fixed by said court, to cause to appear for examination and inspection any of its officers, agents, books and papers. Violation of order-penalty. Section 2. Any such corporation named in section 1 failing or refusing to comply with the order named in section 1 of this act, shall be fined in any sum not less than $50.00 nor more than $500.00; and each separate day such corporation fails or refuses to comply with any order as provided in section 1 of this act, shall constitute a separate offense. Emergency. Section 3. An emergency is hereby declared, by reason whereof it is immediately necessary for the preservation of the public peace, health and safety that this act take effect and be in force from and after its approval. Approved March 24, 1910. CHAPTER 82. APPROPRIATION-CARE OF INSANE AT NORMAN. Senate Bill No. 63. (A Bill entitled) AN ACT making an appropriation to pay for the care of the insane at Be It Enacted By the People of the State of Oklahoma: Section 1. There is hereby appropriated out of any money in the treasury of the State of Oklahoma not otherwise appropriated, for the support of the insane now being cared for at the Hospital for the Insane at Norman, Oklahoma, as per contract with the Oklahoma Sanitarium Company, at the rate of two hundred dollars ($200.00) per annum for each patient, to be paid upon itemized and sworn vouchers, approved by the Governor, the sum of twenty-five thousand dollars ($25,000.00), or so much thereof as may be necessary, for the year ending June 30, 1910; and the sum of one hundred thirty thousand dollars ($130,000.00), or so much thereof as may be necessary, for the year ending June 30, 1911; Provided, however, that in the event provision shall be made for the care of said insane persons at some other institution during said fiscal year, then the appropriation hereby made shall be available for the care of said insane persons at such other institution so provided for. Emergency. Section 2. An emergency is hereby declared, by reason whereof it is necessary for the immediate preservation of the public peace and safety that this act take effect from and after its passage and approval. Approved March 24, 1910. CHAPTER 83. APPROPRIATION-STATE PENITENTIARY. Senate Bill No. 65. As Amended by Committee on Appropriations. (A Bill entitled) AN ACT making an appropriation for the constructing, building and equipment of the State Penitentiary at McAlester, Oklahoma. Be It Enacted By the People of the State of Oklahoma: Section 1. There is hereby appropriated out of the public building fund of the State of Oklahoma, not otherwise appropriated, the sum of two hundred thousand dollars ($200,000.00), or so much thereof as may be necessary for the purpose of constructing and equipping the State Penitentiary located at McAlester, Oklahoma. Approved March 24, 1910. CHAPTER 84. HEALTH-SANITATION OF JAILS AND POOR HOUSES. Senate Bill No. 74. AN ACT to better the sanitary conditions of jails and poor houses and to require that same be painted, whitewashed and cleaned at certain intervals. Prescribing penalties for violation of this act, and declaring an emergency. Be It Enacted By the People of the State of Oklahoma: Section 1. It shall be the duty of the county commissioners of each county in the State of Oklahoma to furnish supplies and cause the walls of county jails to be thoroughly whitewashed, the cells freshly coated with paint and the windows and floors thoroughly scrubbed; and the bedding cleansed and disinfected and the jail thoroughly cleansed and this duty shall be performed during the first week of each quarter of the year, beginning with January. City jails. Section 2. It shall be the duty of mayors of cities of the first class, during the first week of each quarter of the year, beginning with January, to see that supplies are provided and to have the walls of the city jails whitewashed or painted and cleansed and the cells painted, the bedding disinfected, and the windows and floors thoroughly scrubbed. Town jails. Section 3. It shall be the duty of mayors of all other towns to supply the material for and to, at least twice a year, during the first week of January and July, cause the jails or holdovers of their respective cities or towns to be thoroughly disinfected, to whitewash or paint the walls of same; the bedding to be disinfected and cleansed and the floors and windows to be thoroughly scrubbed. Authority of Commisioner of Charities. Section 4. Should any of the buildings above enumerated in this act become unsanitary in the opinion of the Commissioner of Charities and Corrections, such officer shall have authority to direct that such buildings shall be cleansed or put in a sanitary condition and may direct the respective officers above specified to cause same to be done, whether it be at the times mentioned in the foregoing sections or at any other time. Contagious disease-isolation. Section 5 Should any prisoners in any county or city jail or holdover complain of illness, the county or city physician, whose duty it may be to attend such prisons, shall be summoned, and if such prisoner should be found to have a contagious disease, he shall be immediately removed and isolated to some room or place having no connection with the other prisoners. Same-jail coustruction. Section 6. It shall be the duty of officials who hereafter construct jails, city prisons or holdovers to provide a room for the segregation of prisoners who may be found to have a contagious disease. |
