CHAP. 13.

AN ACT to provide for the payment of the interest due on
certain bonds of the county of Greene, known as the bonds
to refund taxes to banks, by issuing new bonds.

PASSED February 8, 1877; three-fifths being present.

The People of the State of New York, represented in Senate and
Assembly, do enact as follows:

SECTION 1. It shall be lawful for the chairman of the board of supervisors and the treasurer of the county of Greene to provide for the payment of the interest now due and to fall due on the first day of March, eighteen hundred and seventy-seven, on the bonds of Greene authorized county, known as the bonds to refund taxes illegally collected of the bonds, etc. Catskill banks, and issued by virtue of resolutions of the board of supervisors of said county of Greene, on the eighth day of December, eighteen hundred and sixty-nine, by loan upon new bonds of said county, as herein provided, instead of the same being raised by tax. The said chairman and treasurer shall prepare and issue coupon bonds, executed by them as such chairman and treasurer, in the form and manner of the bonds aforesaid, now outstanding, of the denomination of five hundred dollars each, payable on the first day of March, eighteen hundred and ninety-seven, and drawing interest payable annually at seven per cent per annum on the first of March in every year.

§ 2. The county treasurer of said county shall sell and dispose of the bonds authorized by this act at public auction to the highest bidder, but not for less than their par value, and the money that shall be raised by the sale of said bonds shall be applied by the said county treasurer to the payment of the interest due on said bonds to and including March first, eighteen hundred and seventy-seven, and for no other purpose.

§ 3. The said board of supervisors shall cause to be levied by tax on the taxable property of said county, and collected and paid to said treasurer, annually, such sums as may be necessary to pay the interest thereafter on the bonds aforesaid now outstanding, and on the bonds issued under this act, and shall also from time to time cause to be levied and collected as aforesaid and paid to said treasurer such sums as may be necessary to pay the principal of any and all of said bonds when the same shall become due, and the treasurer shall apply the moneys so collected and paid to him, to the payment of the interest and principal of said bonds as provided by said boards of supervisors, and for no other purpose.

§ 4. This act shall take effect immediately.

CHAP. 14.

AN ACT to amend the act entitled "An act to provide for the incorporation of villages," passed December seventh, eighteen hundred and forty-seven, and the several acts amendatory thereof, so far as relates to the village of Corning, in the county of Steuben.

SECTION 1. The east, south and west boundaries of the village of East, Corning shall be hereafter coextensive with, and shall embrace all the territory now contained in school district number nine in the town of bounda Corning, and as laid down and described on a map of the town of fined. § 2. § 5. At the annual village election in eighteen hundred and seventy- Officers to seven the trustees shall be elected as above provided, except that the be elected term of office of the trustees who should hold over by the law now in and the force shall not be lessened, and in each ward where two trustees are hereafter first elected they shall draw lots for the term of one or two years, and the result of the drawing shall determine their terms of office respectively, and thereafter one trustee shall be elected in each year in each ward, except vacancies shall be filled by the electors designating on their ballots by the words "to fill vacancy," and the trustee so elected shall hold office only for the unexpired term so referred to.

86. The office of assessor in said village is abolished, and the village Office of assessment shall be made by the trustees from and in accordance with the last town assessment, in the same manner that school taxes are now assessed by the board of education of the village of Corning.

87. The term of office of the clerk, treasurer and pound master of said village shall be one year, and they shall hereafter be elected by the new board of trustees at their first meeting and annually thereafter by a majority vote of said board, and any vacancy in the office of the

clerk, treasurer or pound master shall in like manner be filled by the said board of trustees.

§ 8. There shall be created a fund to be known as a police fund for said village, and all fines collected in cases in which persons shall be arrested by the police constables of said village shall be paid over to the treasurer thereof and belong to such police fund, and the same or so much thereof as may be necessary for that purpose shall under the direction of the board of trustees be applied to the payment of the expenses of the police of said village. And no part thereof shall be applied to or used for any other purpose without the direction by a twothird vote of the said board expressed by resolution, entered upon the minutes of proceedings thereof. And hereafter the police justice of said village shall have no power to remit any fine imposed in any proceeding before him.

89. Any vacancy in the office of president may be filled by a special election called at any time by the board of trustees in the manner now prescribed by law for special elections.

§ 10. Nothing in this act shall change the time and manner of the annual election, except that the board of trustees shall designate a place for an election in each of the four wards, and the trustees of each ward shall preside at the election so appointed, and shall appoint a clerk for each poll, except that the clerk of the village shall be clerk of the election in the ward in which he resides, and the return of votes from each ward shall be made to the board of trustees in the manner now provided by law for the return of votes in general elections to the board of supervisors.

§ 11. At the annual election in eighteen hundred and seventy-seven preside at the several elections shall be held as follows: Trustee Amory Houghton, Jr., shall preside at the poll in the first ward; trustee Frederick Haischer shall preside at the poll in the second ward; trustee Isaiah C. Dow shall preside at the poll in the third ward, and trustee Stephen T. Hayt shall preside at the poll in the fourth ward.

§ 12. This act shall take effect immediately.

CHAP. 15.

AN ACT to amend section seventy-three of chapter three hundred and seventy of the laws of eighteen hundred and seventy-five, entitled "An act to amend and consolidate the several acts relating to the city of Elmira."

PASSED February 9, 1877; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section seventy-three of chapter three hundred and seventy, laws of eighteen hundred and seventy-five, entitled "An act to amend and consolidate the several acts relating to the city of Elmira," passed May seventeenth, eighteen hundred and seventy-five, is hereby amended so as to read as follows:

73. After the board of supervisors of Chemung county shall have corrected the assessment roll of said city and inserted therein the county taxes levied and assessed by them they shall annex to such roll a warrant, under the hands of the chairman and clerk of said board, com

manding the said city chamberlain to collect from the several persons relative to and corporations named in said roll the sums mentioned opposite their mentr roll respective names, and authorizing the said chamberlain, in case any of city. person or corporation named in said roll shall refuse or neglect to pay his taxes on or before the first day of March next ensuing, to levy the same by distress and sale of the goods and chattels of such person or corporation, and they shall on or before the fifteenth day of December deliver the said roll to the chamberlain of said city.

§ 2. This act shall take effect immediately.

CHAP. 16.

AN ACT to amend chapter two hundred and ninety-one of the laws of eighteen hundred and seventy, entitled "An act for the incorporation of villages."

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Subdivision twenty-three of section three, of title three Law of chapter two hundred and ninety-one of the laws of eighteen hundred amended. and seventy, entitled "An act for the incorporation of villages," is hereby amended so as to read as follows:

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The sum of ten thousand dollars, or so much thereof as Appromay be necessary, is hereby appropriated, out of any money in the priation. treasury not otherwise appropriated, to defray the expenses, and to compensate the services of the commissioners and their employes, appointed under chapter three hundred and eighty-two of the laws of eighteen hundred and seventy-six, to investigate certain lateral canals of this state.

CHAP. 18.

AN ACT to enable the town of Duanesburgh, Schenectady county, to issue bonds to pay debts incurred under the provisions of chapter sixty-four, laws of eighteen hundred and fifty-six, and chapter four hundred and one, laws of eighteen hundred and fifty-seven.

PASSED February 14, 1877; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The board of town auditors of the town of Duanesburgh, Schenectady county, is hereby authorized and required to ascertain and in relation certify to the supervisor and town clerk of said town, within sixty days from the passage of this act, the full amount of indebtedness due and chargeable to said town, under and by virtue of chapter sixty-four, laws of eighteen hundred and fifty-six, and chapter four hundred and one, laws of eighteen hundred and fifty-seven, including and particularly setting forth in such certificate the bonds issued under said act, and the coupons due and unpaid thereon, and the judgments, costs, interest and all items of expense unpaid, incurred by reason of litigating and contesting the validity of said bonds, and to whom payable; and said board of town auditors shall allow and audit to each person ascertained to be a creditor the amount now due by reason of such indebtedness, and such certificate of indebtedness shall be recorded in the public records of said town.

§ 2. Upon receiving the certificate of the town auditors as provided in section one, the supervisor and town clerk are hereby authorized and empowered to issue bonds of said town of Duanesburgh, to an amount not exceeding thirty-eight thousand dollars, payable within eleven years from the first day of March, eighteen hundred and seventy-seven, in annual payments of such proportions of the principal as they may determine with interest annually, and the proceeds arising from the sale of such bonds shall be applied and paid exclusively in the payment of coupons due and past due, and interest thereon, judgments, costs, interest and all items of expense mentioned in section one of this act; and whenever any bonds shall be issued under the authority hereof, a full record of the same shall be made in the public records of said town, and the bonds so issued shall be legal claims against said town; but no bonds issued under this act shall be sold for less than par.

§ 3. It shall be the duty of the board of supervisors of Schenectady county to levy and impose a tax upon the taxable property in said town of Duanesburgh annually for the payment of the bonds which may be issued in accordance with section two of this act, in sums sufficient to pay and discharge the amount of principal and interest which shall be found and certified by the supervisor of said town to become due upon said bonds next after each annual meeting of said board, and when collected, shall be paid by the collector to the supervisor of said town, who shall pay the same in redemption of the bonds and interest issued under section two of this act.

§ 4. This act shall take effect immediately.
