governor, prior to the adoption of the state constitution, were performed at Monterey as the seat of government. The constitutional convention was held there. The resignation of General Riley of the position of governor, after the election of Governor Burnett, was dated at San José, the pueblo de San José having been fixed as the seat of government by the constitution, subject to be made permanent by law. The first legislature met at San José. An act to take the sense of the people of California on the subject of a permanent location of the seat of government was passed April 22, 1850. An act of February 4, 1851, fixed the seat of government at Vallejo; an act of February 4, 1853, fixed the seat of government at Benicia permanently, as recited in the act; but on February 25, 1554, the seat of government was fixed at its present location, Sacramento city, and it

was so held to be in In re Capital People v. Bigler, 5 Cal. 23, wherein Judge Murray reviews the entire subject. The legislature of 1851 was commenced at San José, and ended at Vallejo; that of 1852 was held at Vallejo; that of 1853 was held at Vallejo and Benicia; and that of 1854 at Benicia and Sacramento city. Since the act of 1854, supra, though several attempts were made to remove, by legislation, the permanent seat of government, none have proved successful. In consequence of the flood and inundation of Sacramento, the session of the legislature of 1862 (being the thirteenth session) was commenced at Sacramento city and ended at San Francisco, being a temporary removal. The seat of government may now, however, be said to be at last permanently located at Sacramento city, and is so treated in all the provisions of this code."
