CHAP. 10.

AN ACT making an appropriation to the commissioners of

emigration.

PASSED March 2, 1882; three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The comptroller of the State is hereby authorized and directed to draw his several warrants upon the treasurer, who shall rants for, pay the same respectively when presented, in favor of the commissioners of emigration, for such amounts as they may, from time to time, require for the purpose of paying their current expenses from February first, eighteen hundred and eighty-two, to May first, eighteen ́ hundred and eighty-two, which warrant shall not exceed in the aggregate the sum of forty thousand dollars.

§ 2. The sum of forty thousand dollars, or so much thereof as may be necessary, is hereby appropriated for the payment of the warrants in and by the first section of this act mentioned and authorized, which shall be paid out of the moneys in the treasury not otherwise appropriated.

AN ACT authorizing the village school district of the town of Malone to raise money for the maintenance of the district library and of the reading-room.

PASSED March 3, 1882; three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The village school district of the town of Malone may mainten- hereafter, at any annual school meeting, vote a tax upon the taxable property of said district, not exceeding one-half of one mill on the dollar of the assessed valuation of the property thereof, to be expended under the direction of the board of education, for the maintenance of the library of said district and of a reading-room connected therewith, for the care of the library building, and for the purchase of books, periodicals and newspapers, and for other necessary expenditures in connection with said library and reading-room.

§ 2. The sums voted in pursuance of the first section of this act shall be included in the annual tax-list of said district, and be levied and collected in the same manner as the other taxes of the district. §3. This act shall take effect immediately.

CHAP. 12.

AN ACT to define the liberties of the jail in and for the county of Cayuga.

PASSED March 3, 1882.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The city limits of Auburn, in Cayuga county, are and Jail limits. hereafter shall be the liberties of the county jail of Cayuga county.

§ 2. All acts and parts of acts inconsistent or in conflict with this

act are hereby repealed.

§3. This act shall take effect immediately.

CHAP. 13.

AN ACT to amend chapter five hundred and seventy-six of the laws of eighteen hundred and eighty, entitled "An act to ascertain by proper proofs the citizens who shall be entitled to the right of suffrage in cities of sixteen thousand inhabitants, or upwards, and the towns and villages abutting against the boundary of any such cities," as amended by chapter one hundred and ninety-six of the laws of eighteen hundred and eighty-one.

SECTION 1. Section eighteen of chapter five hundred and seventysix of the laws of eighteen hundred and eighty, entitled "An act to ascertain by proper proofs the citizens who shall be entitled to the right of suffrage in cities of sixteen thousand inhabitants, or upwards, and the towns and villages abutting against the boundary of any such cities," as amended by chapter one hundred and ninety-six of the laws of eighteen hundred and eighty-one, is hereby amended so as to read as follows:

18. The provisions of this act shall apply to the towns of Richmond county, and to the town of Olean, Cattaraugus county, and to general elections only in the town of Cortland, Westchester county. § 2. This act shall take effect immediately.

CHAP. 14.

AN ACT to authorize the extension of the time for the collection of taxes in the town of Norwich, in the county of Chenango.

PASSED March 3, 1882; three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The time for the collection of unpaid taxes in the town collection of Norwich, in the county of Chenango, is hereby extended to May extended. first, eighteen hundred and eighty-two, and the warrant for the collection thereof, either by the present collector or of any person who may be appointed in his place, shall be valid for the purpose of enforcing the collection of said unpaid taxes until May first, eighteen hundred and eighty-two; provided the said collector or any person appointed in his place shall renew his bond as required by chapter two of the laws of eighteen hundred and eighty-two, entitled "An act to authorize the extension of the time for the collection of taxes in the several towns of this State."

§ 2. Nothing contained in this act shall be construed to release the said collector or his sureties from any liability now incurred or that may be incurred by him or them on account of any acts or omissions or the part of the present collector that is, the collector to whom the said warrant was originally delivered.

CHAP 15.

AN ACT to amend chapter thirty-one of the laws of eighteen hundred and seventy-two, entitled "An act to amend an act to incorporate the village of Port Richmond.”

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section one of chapter thirty-one of the laws of eighteen hundred and seventy-two, entitled "An act to amend an act to incorporate the village of Port Richmond" is hereby amended so as to read as follows:

§ 1. At the annual meeting of said village, to be held on the first Tuesday in March, eighteen hundred and seventy-two, of the five trustees then to be elected, two shall hold office for one year, two others for two years, and the other of said trustees for three years. One of Residence said trustees so to be elected for one year, and one of said trustees so to be elected for two years, shall reside west of the Morning Star Road, and the other three trustees shall reside east of said road. The electors shall designate by their ballots the names of each of the trustees voted for, and also the number of years which each of said trustees shall, if elected, hold office. And thereafter the trustees elected at each annual meeting shall hold office for two years; except that the trustee elected to fill the vacancy created by the expiration of the term of said trustee,

so to be elected for three years, shall hold his office for three years. And at each annual meeting held in said village thereafter, all vacan- Vacancies. cies then existing, or which will exist on that day in the office of trustee of said village, shall be filled by the electors for a full term of two or three years as the case may be ; except that a vacancy occurring from any other cause than expiration of the term of office of the incumbent shall be filled for the remainder of the unexpired term only. §2. AN ACT to legalize and confirm the official acts of notaries

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The official acts of every person as notary public within Official the state of New York heretofore commissioned as such, which acts acts have been performed since the thirtieth day of March, eighteen hundred and eighty-one, so far as such official acts might be affected, questioned or impaired by reason of having been performed after the expiration of the term of office or by reason of misnomer or misspelling of name or other error made in the appointment or commission of said notary public, or by reason of omission, or failure to take the prescribed oath of office within the time required by law, are hereby legalized and confirmed and made as effectual and valid as if the term of office of said notary public had not expired, or as if no misnomer or misspelling or other error had occurred or been made in the appointment or commission of said notary public, or as if the oath of office had been taken within the time prescribed by law.

§ 2. Nothing in this act contained shall affect any legal action or proceeding now pending.

§ 3. This act shall take effect immediately

CHAP. 17.

AN ACT to amend an act entitled "An act to organize and establish a police for the village of Lansingburgh."

PASSED March 8, 1882; three-fifths being present.

SECTION 1. Section twenty-five of an act entitled "An act to organize and establish a police for the village of Lansingburgh, passed May sixth, eighteen hundred and seventy." is amended so as to read as follows:

§ 2. Section twenty-one of said act is hereby amended so as to read as follows:

The board of trustees of the village of Lansingburgh shall raise by tax annually at the time and in the same manner that other village taxes are levied and collected, all funds necessary to carry out the provissions of this act, and the treasurer of said village shall pay the salary of the policemen monthly as it shall become due on the warrant of the board of police. CHAP. 18.

AN ACT to further extend the time for the payment of the assessment made to pay the expense of constructing the Bird avenue sewer in the city of Buffalo.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Any owner of, or person or corporation interested in any property assessed in assessment roll number ten thousand two hundred and nineteen, for constructing Bird avenue sewer in the city of Buffalo, who has failed to pay the first, second or third installments, or either of them, within the time provided by law, may at any time prior to the first day of July, one thousand eight hundred and eighty-two, pay to the treasurer of said city the original amount of such past due installment or installments, with interest added thereto at the rate of seven per centum per annum, from the time such install ment or installments became due, up to the time of making such payment, and such payment shall be as effectual for all purposes as though made when such installment became due.

§ 2. This act shall take effect immediately.
