CHAP. 86.

AN ACT to authorize the commissioners of the land office to sell and convey to the New York, Lackawanna and Western Railroad Company a right of way across the lands occupied by the New York Soldiers' and Sailors' Home.

PASSED April 19, 1882; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The commissioners of the land office are hereby authorized to sell and convey to the New York, Lackawanna and Western Railroad Company the right of way for the road of said company, across the lands occupied by the New York State Soldiers' and Sailors' Home, on such terms and conditions as in the judgment of said commissioners and the board of trustees of said home may be for the best interest of the state.

§ 2. This act shall take effect immediately.

CHAP. 87.

AN ACT to legalize the action of the town meeting of the town of Little Valley, in Cattaraugus county, held February twenty-eighth, eighteen hundred and eighty-two, appropriating five hundred dollars for highway purposes, without the notice required by law.

PASSED April 19, 1882; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The action of the town meeting of the town of Little town meet Valley in Cattaraugus county, held February twenty-eighth, eighteen hundred and eighty-two, in appropriating five hundred dollars for highway purposes in said town for the then ensuing year, upon the application of the highway commissioner, but without a notice of such intended application having been posted by such commissioner as required by law, is hereby legalized and confirmed and declared to be as valid and of the same force and effect as if such notice had been given.

§ 2. Nothing in this act contained shall affect any suit or proceeding now pending.

§3. This act shall take effect immediately.

CHAP. 88.

AN ACT to amend chapter five hundred and seventy-four of the laws of eighteen hundred and seventy-three, entitled "An act to incorporate the old guard of the city of New York."

PASSED April 19, 1882.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section three of chapter five hundred and seventy-four of the laws of eighteen hundred and seventy-three, entitled "An act to incorporate the old guard of the city of New York," is hereby amended so as to read as follows:

No person shall be eligible to membership in the old guard of Persons the city of New York, who shall not have been a member of the light not eligible guard or city guard of the city of New York, the national guard of bership. this state, or any state in the union for the period of five years or honorably discharged therefrom, or an ex-officer of the regular army, navy or volunteer service of the United States.

§ 2. This act shall take effect immediately.

CHAP. 89.

AN ACT to amend chapter forty-one of the laws of eighteen
hundred and sixty-one, entitled "An act to incorporate the
Veterans of the National Guard, Seventh Regiment, First
Division, New York State Militia."

The People of the State of New York, represented in Senate and
Assembly, do enact as follows:

SECTION 1. Section four of chapter forty-one of the laws of eighteen hundred and sixty-one, entitled "An act to incorporate the Veterans of the National Guard, Seventh Regiment First Division, New York State Militia," is hereby amended so as to read as follows:

§ 4. The said corporation may purchase and hold real or personal May hold estate and is authorized to accumulate a fund for the pecuniary relief personal of indigent and reduced members and of their widows and children, to estate, etc. be called the "Benevolent Fund of the Veterans of the Seventh Regiment," and said fund shall be administered by officers of said association, who shall be the colonel, paymaster and chaplain of said association, as trustees. Additions to the said fund may be made by appropriations from the said association by donation. and by legacies and devises to the said association which it is hereby authorized to receive and apply in the manner aforesaid. §2. CHAP. 90.

AN ACT to authorize the town of Shawangunk, in the county of Ulster, to issue bonds in a sum sufficient to pay off the several judgments against said town which are included in the present tax roll of said town and which were recovered on bonds issued by said town of Shawangunk, in aid of the Wallkill Valley railway.

PASSED April 20, 1882; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The town of Shawangunk, in the county of Ulster, is hereby authorized and empowered to issue its bonds in a sum sufficient to pay off the several judgments against said town, which are included in the present tax roll of said town, and which were recovered on bonds issued by said town of Shawangunk in aid of the Wallkill Valley railway.

§ 2. Said bonds shall be issued within thirty days after the passage of this act under the hand and seal of the supervisor of said town, and countersigned by the town clerk thereof; they shall become due and payable, one-tenth part thereof in ten years from the time of issuing the same, and one-tenth part thereof in each and every year thereafter until they all become due; they shall be what are known as coupon bonds and shall draw interest at a rate not exceeding five per centum per annum, payable semi annually, and shall be sold for not less than their par value.

§3. The supervisor of said town, before issuing. any of said bonds, shall execute to the said town of Shawangunk a good and sufficient bond, in the penal sum of sixty thousand dollars, with two sufficient sureties, conditioned that he will faithfully apply the proceeds of said bonds to the payment of the several judgments against said town. which are included in the present tax roll of said town and which were recovered on bonds issued by said town of Shawangunk in aid of the Wallkill Valley railway, and that he will in all things conform to the requirements of this act in the issuing and disposition of said Bond to be bonds, and of the proceeds thereof. The bond of said supervisor shall be approved by a justice of the supreme court in the third judicial district, and shall be filed with the clerk of the county of Ulster before any such bonds shall be issued.

4. The supervisor of said town of Shawangunk shall immediately, after the passage of this act in conjunction with Jacob D. Wurts, the late chairman of the board of supervisors of Ulster county and John E. Kraft, the clerk of said board, proceed to correct the present tax roll of said town by deducting therefrom the amount of money raised on said bonds, and shall apportion the balance of said tax levy ratably among the tax-payers of said town, with the moneys thus raised on such town bonds, together with such sums as shall be raised by tax in the present tax roll for that purpose, the said supervisor shall at once pay, satisfy and discharge all of the said judgments against said town. of Shawangunk, which are included in the present tax roll of said

PASSED April 20, 1882; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section two of chapter twenty-one of the laws of eighteen. hundred and eighty-two, entitled "An act to cause certain obstructions to be removed from the Erie canal and making appropriations for such purpose," is hereby amended so as to read as follows:

§2. The sum of twenty-five hundred dollars, or so much thereof as Appropriamay be necessary, is hereby appropriated for such purpose out of any tion. funds in the treasury not otherwise appropriated, and the treasurer is hereby directed to pay the same on the warrant of the comptroller, upon the vouchers to be presented by the superintendent of public works.

AN ACT to confirm the incorporation of the Rochester and Charlotte Turnpike Road company and to regulate the tolls thereof.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The acts and proceedings of Rufus K. Dryer, Alexander Pomeroy, Asa T. Soule, James M. Whitney and their associates for the legalized. formation and incorporation of a turnpike road company for the construction of a road or boulevard from the city of Rochester, county of Monroe, to Lake Ontario, and the certificate thereof, bearing date March eleven, eighteen hundred and eighty, and filed March seventeen, eighteen hundred and eighty, in the office of the secretary of state at the city of Albany, and by which such company was incorporated under Corporate the name of "The Rochester and Charlotte Turnpike Road Company" are hereby confirmed and said company is declared to be a corporation under said name.

And in that proportion for a greater or less number of horses, mules, cattle, sheep or swine. "Provided that the vehicles of farmers and of the residents of the town of Greece shall be charged only the rates of toll herein provided for pleasure vehicles over the entire road;" and persons living along the line of the road at the same rate for the distance traveled.

§ 3. This act shall take effect immediately.
