granting to the Fulton Avenue Church, of the city of Brooklyn, permission to convey to said Elm Place Congregational Curch, of the city of Brooklyn, certain land on Elm Place in the city of Brooklyn, and the proceedings upon which said order was obtained are hereby made valid in all respects.

§ 2. The deed from said Fulton Avenue Church, of the city of Brooklyn, to said Elm Place Congregational Church, of the city of Brooklyn, bearing date the twenty-third day of March, eighteen hundred and fifty-seven, and recorded in the office of the register of the county of Kings, in liber four hundred and forty-four of conveyances, page four hundred and sixty, conveying certain land on Elm Place, in the city of Brooklyn, vested in the grantee therein named all the right, title and interest with the said Fulton Avenue Church, of the city of Brooklyn, had in or to said land at the time of the delivery to said grantee of said deed thereof; and said deed is hereby in all respects ratified and confirmed as a good and sufficient conveyance thereof to said Elm Place Congregational Church, of the city of Brooklyn, at the time of said delivery thereof. Provided nothing herein contained shall affect any action now pending, or impair any intermediate right acquired by lien or otherwise in or to the land or premises affected by said conveyance.

§ 3. This act shall take effect immediately.

CHAP. 27.

AN ACT to extend the time for the collection of county taxes in the city of Auburn, New York

PASSED March 21, 1882.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The constables of the city of Auburn, to whom the city treasurer of said city has issued warrants for the collection of unpaid county taxes for the year eighteen hundred and eighty-one, are hereby authorized to surrender their levies, made pursuant to the direction contained in and by virtue of said warrants, within five days after the passage of this act, to the city treasurer aforesaid, with an account of the unpaid county taxes which they have failed to or been unable to collect.

§ 2. The time for the collection of county taxes now levied and uncollected in the city of Auburn, New York, is hereby extended to the first day of May next; provided the city treasurer of said city shall pay over the money already collected by him, shall make his return to the county treasurer of the county of Cayuga, as now required by law, of all unpaid taxes on lands of non-residents, and renew his bond to the satisfaction of such county treasurer; and in such case the warrants issued by the board of supervisors of such county, and delivered to said city treasurer, shall continue in full force and effect until the first day of May next. But nothing in this act contained shall be construed as extending the time in which the county treasurer of Cayuga county is required by law to pay the state tax to the comptroller.

§ 3. In case any of said taxes shall remain unpaid on the seventh day of March instant the said city treasurer is hereby authorized to issue new warrants immediately thereafter, returnable on the first day of

May next; which new warrants shall be in substance and effect, and
like proceedings had and taken thereunder, as is provided by the char-
ter of said city of Auburn for the collection of county taxes.
§ 4. This act shall take effect immediately.

CHAP. 28.

AN ACT for the support of the poor in the town of Oswegatchie, in the county of St. Lawrence.

§2. The office of overseer of the poor in the town of Oswegatchie office of is hereby abolished. There shall be a corporation in the said town by overseer the name of "The Superintendents of the poor of the town of Oswc- and corgatchie," which shall possess the usual powers of a corporation for portion public purposes. William I. Averell, William L. Proctor, John Pickens, Erastus Vilas, James Eysman and Charles Lum are hereby appointed such superintendents for the purpose of carrying into effect the provisions of this act. They shall be divided into three classes, Classes and hold their offices for the periods following, that is to say: William and terms I. Averell and John Pickens shall constitute the first class, and hold superintheir offices until the first Tuesday of March, eighteen hundred and tendents. eighty-three; James Eysman and Erastus Vilas shall constitute the second class, and hold their offices until the first Tuesday of March, eighteen hundred and eighty-four; and Charles L. Lum and William L. Proctor shall constitute the third class, and hold their offices until the first Tuesday of March, eighteen hundred and eighty-five; and upon the expiration of their several terms of office, their places shall be filled by persons duly elected at the annual town meetings held in the town of Oswegatchie for the year in which such terms of office shall expire, which elections shall be conducted in the following manner, that is to say: Each elector may place upon a separate ballot the name of one suitable person, who shall be a citizen of the United States, of full age and a resident of said town of Oswegatchie, under the words, "for superintendents of the poor," and deposit the same in a separate box to be provided for that purpose by the officers who shall preside at such town meetings; and a separate poll-list shall be kept of the persons voting for such superintendents, and the two persons having the greatest number of votes, at such elections, shall be declared and deemed duly elected. And at every annual town meeting thereafter there shall be elected, in the same manner, two persons as superintendents. The persons clected shall hold their office for the term of three years, and until others are duly elected in their places.

§3. The said superintendents of the poor may sue and be sued in their corporate name in any of the courts of this state. They shall have the sole and exclusive care and management of the poor in the said town, and shall provide for and maintain the persons enumerated in the fourteenth section of the act concerning "the relief and support of indigent persons,' in the manner hereinafter mentioned, and for that purpose they shall have and exercise all the powers and authority now vested by law in the overseers of the poor of towns, and in superintendents of the poor of counties, not inconsistent with the provisions of this act. They shall also have and possess the powers following:

1. To appoint, by a resolution to be entered upon their minutes, an officer, to be denominated "the overseer of the poor of the town of Oswegatchie," together with such other agents as may be necessary in order to carry into effect the purposes of this act, which said overseer and other agents shall hold their offices during the pleasure of the said superintendents, and receive such fixed annual salary as a compensation for their services as the said superintendents may direct. The said superintendents shall require their agent who may act as treasurer to give satisfactory bonds for the faithful discharge of duty as such

treasurer.

2. To visit the poor of the said town at their several places of residence, and direct the overseer of the poor so to do, and inquire and examine into their circumstances, the number and ages of the members of their families, the places of their former residence, their employments, for what length of time and to what extent they have been dependent on the public for support, their ability to labor, and the causes of their poverty; and the superintendents may direct either permanent or temporary relief to such poor persons, under such rules and regulations as they may from time to time adopt.

3. To contract for, purchase and provide provisions, fuel, clothing and other necessaries for the support of or distribution the among poor, as in their judgment they may deem necessary.

4. The said superintendents shall have power to receive from the supervisor of the town of Oswegatchie the excise money received in said town outside of the limits of the city of Ogdensburg, with all fines, forfeitures and penalties which may accrue to them as such superintendents, together with all moneys raised in the said town for the support of poor, which said several sums of money shall be applied by the said superintendents to the support and relief of the poor in said town, according to the provisions of this act, and all fines, et cetera, which are now by law directed to be paid to the supervisors of the town for the support of the poor.

5. The said superintendents shall also have power, and it shall be their duty, to sue in their corporate name for all violation of the excise laws committed in said town, in any court having jurisdiction of such suits. All other suits and proceedings which may now by law be prosecuted and maintained, in the name of the overseers of the poor of the town of Oswegatchie, to enforce civil remedies, shall and may hereafter be prosecuted and maintained, and such remedies may be enforced, in the name of the superintendents of the poor of the town of Oswegatchie, not in conflict with the charter of the city of Ogdensburg, but shall be additional thereto.

6. Such superintendents may also appoint one of their body presivacancies, dent, who shall hold the office during their pleasure, and they may also fill all vacancies which may occur among their number by death,

resignation or otherwise, by appointing some suitable person or persous to fill such vacancy or vacancies, who shall hold their office for the unexpired terms of the persons whose places had thus become. vacant. They shall keep written records of their proceedings, and may Records. establish rules and regulations for their own government, the government of their overseers, agents and servants, in the examination of paupers and others applying for or entitled to relief, and in the distribution of food, fuel, clothing and other necessaries among the poor of the town.

7. They shall have power from time to time to borrow all such sums May of money as they may deem necessary to carry out the powers vested in them by this act, not to exceed twelve thousand dollars in any one year, and to give obligations in their corporate name, to be signed by their president and secretary, for the payment of such sum of money, and of any debts incurred by them as such superintendents, and the town of Oswegatchie shall be liable for the payment of such obligations.

And all bonds required according to the provisions of the statutes relating to bastards shall be given to them in their corporate name; but nothing in this act contained shall be construed to release or discharge the superintendents of the poor of St. Lawrence county from their liability to any person or persons residing in the town of Oswegatchie, supporting any bastard child already chargeable to said county of St. Lawrence, in cases in which they have heretofore compromised with the putative father for such support.

§4. The said overseer of the poor shall keep an office, to be provided Office and for him by the said suverintendents, in the city of Ogdensburg, which the overshall be open and accessible to those having business therein, at all seer of the seasonable hours. He shall devote his time and attention to the discharge of his public duties, and shall, among other things, attend the meetings of the said board of superintendents, and act as the secretary thereof. He shall aid them in the examination into the circumstances and conditions of the poor persons applying for or entitled to relief, as provided in the second subdivision of second section of this act, and shall keep a record of such examinations. He shall keep the minutes of the proceedings of the superintendents, and an account of their receipts and disbursements, together with the names of the persons relieved, the manner of the relief, and the time when it was rendered, and prepare their annual and other reports. He shall carry into effect the orders and directions of the said superintendents in distributing relief to poor persons, and generally perform all such duties as may be assigned to him from time to time.

§ 5. The said superintendents shall annually, on the first day of Annual November in each year, or when the same shall fall on Sunday, then report. on the day succeeding, cause to be prepared a report containing an exact and accurate account of all moneys received by them, and the sources from whence such moneys were received during the preceding year, an exact and accurate account of all their expenditures, and of all debts incurred by them, which are unpaid for the same period of

time; and the objects for which such expenditures were applied, and the persons to whom they were paid for the same period of time also, the number of those provided with out-door relief and the expenses incurred for such out-door relief during the year; which said report shall be signed by the said superintendents and overseers, and filed in the office of the town clerk of such town, and publish a synopsis of the same containing the amounts of receipts and the sources from whence obtained, the amount of expenditures and for what purpose, in two newspapers published in said city of Ogdensburg, of opposite politics. §6. The said superintendents shall also, on the first day of November, and when the same shall fall on Sunday, then on the succeeding day in each year, furnish the supervisor of the town of Oswegatchie with a written estimate, to be signed by them, of the amount of moneys which, in their judgment, will be required for the support of the poor of said town, not to exceed in any one year the sum of three mills upon the dollar upon last preceding assessment roll of said town, which said estimate shall, by the said supervisor, be laid before the board of supervisors of the county of St. Lawrence, at their next annual meeting, who shall cause the moneys in such estimate mentioned to be levied and collected on the said town, at the same time and in the same manner as the other taxes are levied and collected; and they shall also, by their warrant, direct and require the collector to pay the same, when collected, to the said superintendents, who shall apply the same to the relief and support of the poor in the manner herein directed.

It shall be the further duty of said superintendents to ascertain, as soon after their organization as practicable, the sums of money boras to exist- rowed and debts incurred in the support of the poor of Oswegatchie, between January first, eighteen hundred and eighty-two, and the date of this act going into effect, by the committee appointed by the citizens of said town at a public meeting thereof held January fourteenth, eighteen hundred and eighty-two; and said superintendents are hereby authorized on ascertaining and auditing the amount of said loans and indebtedness that may have been so incurred between January first, eighteen hundred and eighty-two, and the time of this act taking effect, to borrow sufficient money upon the credit of said town in the manner provided in subdivision seven of section three of this act, to pay said indebtedness so incurred and audited with interest thereon; and it shall be their duty so to pay said audited indebtedness; and with their first annual report of their estimate, submit a certificate of said indebtedness to the supervisor of the town, who shall in like manner submit the same to the board of supervisors, who shall cause the amount thereof, with interest, to be assessed on the town of Oswegarchie, and the money to be paid over to said superintendents.

§ 7. The said superintendents of the poor shall receive no compensation whatever for any services rendered by them under the provisions of this act; but all reasonable and proper expenses, incurred by them in executing their trusts as such superintendents shall be paid out of any moneys raised for the support of the poor as herein mentioned.

8. It shall not be lawful for the said superintendents of the poor, or either of them, or the said overseer of the poor, to be concerned or goods and interested, directly or indirectly, in the sale of any goods, merchandise or other personal property found, furnished or provided for the use of the poor of the said town of Oswegatchie; nor shall such superintendents and overseer, or either of them, take or receive any profit, reward or emolument, for or on account of any goods, merchandise or personal property found, furnished or provided by any person or per
