CHAP. 19.

AN ACT to amend chapter five hundred and seventy-five of the Laws of eighteen hundred and sixty-five entitled "An act to amend an act entitled an act to incorporate the Amsterdam Female Seminary."

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section three of chapter five hundred and seventy-five of the Laws of eighteen hundred and sixty-five, entitled "An act to amend an act entitled an act to incorporate the Amsterdam Female Seminary," is hereby amended so as to read as follows:

CHAP. 20.

AN ACT to authorize the trustees of the village of Brockport to purchase lands and repair and improve any buildings thereon, or erect a new building thereon, for the use of the fire department of said village and other village purposes, and to borrow money on the credit of said village for such purposes.

For the money so borrowed, the said trustees are hereby authorized to issue the bonds of said village in such sums as they shall deem expedient, bearing interest at a rate not exceeding six per centum per annum. The sum so borrowed shall be made payable in equal annual payments as said trustees shall deem expedient, with interest payable annually. Such bonds shall be signed by the president of said village and attested by the village clerk under the corporate seal of said village, and shall not be negotiated at less than their par value.

§3. No money shall be raised or indebtedness incurred under the ness not to provisions of this act until the trustees shall be authorized to incur said indebtedness by a majority of the legal votes cast at an annual election in said village or at any special election ordered, to be held by said trustees on a notice of at least ten days. No person shall be entitled to vote on said question unless he shall be at the time of said election liable to be assessed for property in said village owned by himself or his wife.

§4. The trustees of said village are hereby authorized and empowered, and they shall each year levy upon the taxable property of said village, at the same time and in the same manner as other village taxes are levied, a sum sufficient to pay the principal and interest falling due on the aforesaid bonds each year until said bonds are fully paid; and said taxes shall be collected at the same time and in the same manner as other village taxes are collected in said village, and they shall apply the proceeds faithfully to the payment of said bonds authorized to be

issued under this act.

§ 5. The said property purchased under the provisions of this act is hereby declared exempt from all public taxes, rates or assessments. § 6. This act shall take effect immediately.

CHAP. 21.

AN ACT to cause certain obstructions to be removed from the Erie canal and making an appropriation for such purpose.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The superintendent of public works is hereby empowered of pier of and directed to remove, within sixty days after the passage of this act, the pier of the weigh-lock in the Erie canal at the city of Utica, and the pier of the stop-gate in the canal at the rear of the house of refuge in the city of Rochester.

§2. The sum of twenty-five hundred dollars, or so much thereof as may be necessary, is hereby appropriated for such purpose out of any funds in the treasury not otherwise appropriated, and the treasurer is hereby directed to pay the same on the warrant of said superintendent of public works.

§3. This act shall take effect immediately.

CHAP. 22.

AN ACT to authorize the sale of the stock held by the town.
of Kirkland, in the Rome and Clinton Railroad Company,
and to authorize the application of the proceeds to the pay-
ment of the bonds of said town issued in payment for said
stock, and after such payment, then to the payment of the
bonds of said town issued in pursuance of chapter five hun-
dred and eighty-one of the laws of eighteen hundred and
sixty-seven.

SECTION 1. The railroad commissioners of the town of Kirkland, Railroad Oneida county, appointed and holding office under the provisions of commis chapter five hundred and ninety-two, of the laws of eighteen hundred may sell and sixty-nine, are hereby authorized and empowered to sell at public not less or private sale, but at not less than par, and transfer so much of the than par. capital stock of the Rome and Clinton railroad, now owned by said town, as will be sufficient for the payment of all the bonds of said town still outstanding which were issued to pay for said stock, and to apply the proceeds in payment of said outstanding bonds, and after the payment of such outstanding bonds, then that said commissioners may, in like manner, sell and transfer so much of said capital stock of said railroad company as will be sufficient for the payment of the bonds of said town still outstanding were issued in pursuance of chapter five hundred and eighty-one of the laws of eighteen hundred and sixtyseven, or pay such part thereof as the proceeds of the sale of the balance of said stock will pay of the same.

§ 2. This act shall take effect immediately.

CHAP. 23.

AN ACT to amend section one of chapter fifty-five ot the laws of eighteen hundred and eighty, entitled "An act to amend section three of chapter one hundred and ten of the laws of eighteen hundred and seventy six, entitled 'An act supplemental to chapter sixty of the laws of eighteen hundred and thirteen,' entitled 'An act to provide for the incorporation of religious societies,' and of the several acts amendatory thereof."

SECTION 1. Section three of chapter one hundred and ten of the laws of eighteen hundred and seventy-six, entitled "An act supplemental to chapter sixty of the laws of eighteen hundred and thirteen, entitled

'An act to provide for the incorporation of religious societies, and of the several acts amendatory thereof,"" is hereby amended so as to read as follows:

§ 3. Whenever any church, parish or religious society, in connection with any such governing body, shall become extinct (by reason of the death or removal of its members), or for any other cause, it shall be lawful for the trustees elected by such governing body, as aforesaid, to take possession of the temporalities belonging to such extinct church or society, and manage, sell or dispose of the same and apply the proceeds thereof to any of the objects or purposes mentioned in the second section of this act. It shall not be lawful for said trustees to divert Governing said property to any other object. The governing body to which such tode church or society belongs shall determine when any church or society when has become extinct, or has ceased to maintain religious services for become two consecutive years (as is customary in said governing body) provided that no church or society having more than thirteen resident attending male members each of whom has annually paid pew rent, or annual contributions toward the support of the church or society the last two years, shall be declared extinct, except it has failed to maintain religious services for two consecutive years, according to the customs and usages of the governing body to which such church or society belongs.

CHAP. 24.

AN ACT to release to Hannah Fox the right, title and interest of the People of the State of New York in and to real estate in the city of Auburn, county of Cayuga, of which Mary A. Fox died seized.

PASSED March 21, 1882; by a two-third vote.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. All the right, title and interest of the people of the state of New York in and to all that tract or parcel of land situate on the north side of Perrine street, in the city of Auburn, and being part of lot forty-six, bounded as follows: beginning at a point on the north side of Perrine street, formerly Ellen street, and at the south-east corner of land bought by Barak B. Willey of Ruth. A. Hurd, thence north three degrees east, two chains and fifty links; thence west parallel with said Perrine street fifty-six feet; thence south three degrees west, two chains and fifty links to said Perrine street; thence east along said street fiftysix feet to place of beginning, and being the same premises described in deed from Burak B. Willey and wife to Mary A. Fox recorded in Cayuga county clerk's office in book of city deeds, number one hundred and forty-seven, page three hundred and forty-two is hereby released to Hannah Fox, the mother of Mary A. Fox deceased, her heirs and assigns forever.

§2. Nothing in this act contained shall be construed to impair or affect the right to said real estate of any heir-at-law, devisee, grantee or creditor.

§ 3. This act shall take effect immediately.

CHAP. 25.

AN ACT to amend chapter forty-one of the Laws of eighteen hundred and seventy-nine, entitled "An act in relation to the temporary relief of the poor in the town of Kingston, Ulster county."

PASSED March 21, 1882; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section four of chapter forty-one of the Laws of eighteen hundred and seventy-nine, entitled "An act in relation to the temporary relief of the poor in the town of Kingston, Ulster county," is hereby amended so as to read as follows:

§ 4. The electors of the town of Kingston shall, at their annual Electors to town meeting in each year, determine by ballot what sum of money, amount to not exceeding three hundred dollars, shall be raised at the next annual be raised. levy by the board of supervisors for the support of the poor in said town.
