TERRITORY OF NEVADA.

CHAPTER I.—An Act to grant Wm. V. Kingsbury and his associates the right to construct a Toll Road in Lake County.

[Approved December 2, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. Wm. V. Kingsbury, E. D. Hosselkus, A. B. Har- Franchise. vey, and W. W. Hall, and such associates as they may admit, shall take, have, and enjoy all the rights, privileges, franchises, and rights of way, and full power to construct and maintain a toll road; the toll road to commence at or near what is called Rush Creek Flat, in Lake County; thence running in an easterly direction to the present station on Smoke Creek, crossing said creek at or near said station; thence running in a northeasterly direction (across the mountains lying between Smoke Creek and Wall Springs) to the Deep Hole Station, in the aforesaid county, and have and enjoy all rights of way across and through the lands and territory lying between said points of beginning and terminus on the line of said road as hereinbefore described, which is hereby granted and ceded to said parties for the term of ten years; provided, that within six months from the date of the passage of this Act, the said parties shall commence the construction of said toll road, and within twelve months shall construct and complete the same, otherwise the right to construct the same shall be forfeited, and this Act become null and void. Said parties shall, at all times after its completion, keep said road in passable order and condition, and shall be responsible for any damage to persons or property travelling over said road caused by neglect to keep said road in proper repair and condi

After the completion of said road, the County of Lake shall have the right to purchase said road at an appraised value, to be determined by three Appraisers, one to be selected by the said owners of said toll road, one by the Commissioners of the aforesaid county, and one to be selected by the two Appraisers hereinbefore provided for, and such valuation shall be estimated to be the value of the road.

SEC. 2. The said parties, upon the construction and completion of said road, shall be authorized and empowered to charge and collect, until a proper organization of Lake County is effected, the following rates of toll:

Wagon and one span of horses, or one yoke of cattle, one doland fifty cents.

Each additional animal, twenty-five cents.

Buggy and one horse, one dollar and twenty-five cents.
Horseman, fifty cents.

Each pack animal, twelve and a half cents.

Loose animals, six and a quarter cents.

SEC. 3. Said parties shall keep at each toll gate on said road a bulletin board, which shall contain the scale of prices.

SEC. 4. When Lake County shall have been completely organized and said road completed, the Board of County Commissioners of said county shall have the right to fix and regulate the rates of toll thereon.

SEC. 5. This Act is hereby declared a public Act, and may be amended by any subsequent Legislative Assembly in any man

CHAP. II.—An Act to authorize Bolivar Roberts, his heirs and assigns, to keep and maintain a Toll Bridge across the Carson River, at Dayton, in Lyon County, Nevada Territory.

[Approved December 2, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. That Bolivar Roberts, his heirs and assigns, be and they are hereby authorized and empowered to have, keep, and maintain, for the period of ten years from and after the passage of this Act, a toll bridge across the Carson River, at the foot of Main street, in the Village of Dayton, in the County of Lyon, and Territory of Nevada, or at any other point or points within three quarters of a mile both above and below said point on said river.

SEC. 2. That it shall be unlawful for any other person or other parties persons, during the period aforesaid, to have or maintain within the limits aforesaid, any bridge, ferry, or other public means for the conveyance or transporting of persons or property across said river.
