Tax legalized

CHAP. XXII.—An Act to legalize the Assessment of Real and Personal Property, as made by the County Commissioners of Washoe County, for the year eighteen hundred and sixty-two.

[Approved December 12, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. The assessment of the real and personal property which was made by the Board of County Commissioners of Washoe County, by the passage of an order, April seventh, A. D. eighteen hundred and sixty-two, which is in the words and figures as follows, to wit: "It is hereby ordered, that a tax for the year A. D. 1862, on the assessed value of all the property in the County of Washoe, not exempt from taxation, be and is hereby levied for Territorial purposes, forty (40) cents on each one hundred dollars ($100); it is further ordered, that a tax for the year A. D. 1862, on the assessed value of all property in the County of Washoe, not exempt from taxation, be and is hereby levied for Federal purposes, ten (10) cents on each one hundred (100) dollars; it is further ordered, that a tax for the year A. D. 1862, on the assessed value of all property in the County of Washoe, not exempt from taxation, be and is hereby levied for county expenditure, sixty (60) cents on each one hundred (100) dollars; it is further ordered, that a tax for the year A. D. 1862, on the assessed value of all property in the County of Washoe, not exempt from taxation, be and is hereby levied, as a special tax for Hospital purposes, of twenty (20) cents on each one hundred dollars ($100); it is further ordered, that a tax for the year 1862, on the assessed value of all taxable property in the County of Washoe, not exempt from taxation, and is hereby levied for a Building Fund, sixty (60) cents on each one hundred (100) dollars; it is further ordered, that a tax for the year A. D. 1862, on the assessed value of all taxable property in the County of Washoe, not exempt from taxation, be and is hereby levied for school purposes, of ten (10) cents on each one hundred (100) dollars," is hereby legalized and made valid, and the Tax Collector is hereby authorized to collect the same, as though said order had been made according to and authorized by law.

The assessment made during the year eighteen hundred and sixty-two, and subsequently to the assessment specified in section first, is hereby legalized and rendered valid.

SEC. 3. This Act to take effect from and after its passage.

CHAP. XXIII.-An Act to authorize Myron Lake, his heirs and assigns, to construct a Toll Road from the Junction House, in Washoe County, to the boundary line between Washoe and Lake Counties, in Nevada Territory.

[Approved December 17, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. That Myron Lake, his heirs and assigns, be and are hereby authorized to construct and maintain a toll road from the Junction House, in said Washoe County, running thence northerly, crossing the Truckee River at what is known as Faller's Bridge, to the mouth of a certain ravine coming down from the east side of what is known as the Pea Vine Mountain; thence following up said ravine to the base of the said mountain; thence in a northwesterly direction to the boundary line between the said Counties of Washoe and Lake, for the period of ten years from and after the passage of this Act, and the right of way over and along said route is hereby granted to said Myron Lake, his heirs and assigns.

SEC. 2. That it shall be the duty of said Myron Lake, his heirs and assigns, to construct, with all reasonable dispatch, a good road, with substantial bridges and culverts, over and along said route, for the safe and speedy transportation of persons and property, and keep the same in good repair and condition at all times.

CHAP. XXIV.-An Act to amend an Act entitled an Act to incorporate the Virginia City and Washoe Railroad Company, passed at the First Session of the Legislative Assembly of the Territory of Nevada.

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. Section seven of the above entitled Act is hereby amended so as to read as follows:

Section 7. The capital stock of said company shall be one million five hundred thousand dollars, and divided into shares of one hundred dollars each, which shall be deemed personal property, and transferable in such manner as may be provided for in the by-laws of said company, and the company is hereby authorized from time to time to borrow such sums of money as may be necessary for the completion of the furnishing and operating such road, and to dispose of their bonds, in denominations of not less than five hundred dollars, for any amount so borrowed, and to mortgage their corporate property, or convey the same by deed of trust, to secure the payment of debts contracted by the company for the purpose aforesaid.

SEC. 2. Nothing contained in the provisions of this Act shall be so construed as to mean or operate as a legalization or nonlegalization of the charter granted under and by virtue of the Act of which this Act is amendatory.

SEC. 3. This Act shall take effect from and after its passage.

CHAP. XXV.-An Act to authorize Alfred Helm, his associates and assigns, to construct a Toll Road.

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. Alfred Helm, his associates and assigns, shall have the right and are hereby authorized to build, construct, and keep, a toll road, the eastern terminus of which shall be at or near the western end of King street, in the Town of Carson City, in the Territory of Nevada, and shall continue up and through what is known as King's Cañon, to the summit of the eastern range of the Sierra Nevada Mountains; thence along the western slope of said mountains, by the most direct and practicable route, to Lake Bigler; thence along and near the eastern and southern shore of said lake, until said road intersect's the boundary line of the State of California, or a road known as the Kingsbury Road; and shall have the exclusive right of way for said road between the points herein named as the termini of said road, which is hereby granted and ceded to the above named parties for the term of twenty years; pro

vided, that the said parties shall commence the construction of Conditions. the road within ninety days from the passage of this Act, and shall make it open for public travel within one year from said date, otherwise the right to construct and keep the same shall be forfeited, and this Act become null and void.

SEC. 2. The parties above named shall, at all times after the completion of the road, keep it in good passable order for public travel, and shall be held responsible for any damage that may be awarded by any Court of competent jurisdiction, by reason of or on account of the failure of the parties aforesaid to keep such road in proper condition and repair.

SEC. 3. After the expiration of five years from the comple- Counties tion of the road, the counties through which it runs shall have chase. the right to purchase the road at such price and upon such terms as may be agreed upon by six Appraisers, three of whom shall be chosen by the proprietors of the road, and three of them by the authorized Agents of such counties; provided, that should such Appraisers fail to agree upon the terms of purchase, then and in that case the six Appraisers thus provided for shall choose a seventh Appraiser, who shall act as umpire in a final decision of the matter.

SEC. 4. The parties herein named shall have the right and May regulate they and their assigns are hereby authorized to collect such rates of toll and from such persons as the County Commissioners, or other financial Agents of the County of Ormsby, may from time to time prescribe; provided, that such Commissioners or financial Agents shall not be allowed to alter the rates of toll oftener than once per annum.

SEC. 5. Any person or persons who shall break down, obstruct, Injury to or in any way injure any bridge, culvert, or embankment, or in road. any way or manner endanger the safe travel on said road, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than one hundred nor more than one thousand dollars, or imprisonment in the County Jail of the county where such offence shall have been committed for a term of not less than one nor more than twelve months. SEC. 6. The said parties shall cause to keep posted up at each Bulletin toll house or gate along the road, a bulletin board, with the rates of toll thereon legibly inscribed.

SEC. 7. The parties shall, furthermore, have the right to sue Legal rights. for and collect any toll that may be due to them by parties who neglect or refuse to pay the same, or any damages that may accrue to them by virtue of any injury done to the road, the same to be sued for and collected in accordance with provisions made by law.

SEC. 8. Such privilege shall extend from a point at the southern end of the lake, where the said boundary line intersects with the waters of the lake, to a point four miles northerly from where the road connects with the lake, following along the shore of said lake; and such franchise shall continue for a term of twenty years.

SEC. 9. The parties above mentioned shall, furthermore, have the right and are hereby authorized to collect such rates of toll or ferriage as the County Commissioners or other financial Agents of the county wherein the eastern terminus or landing of the ferry is situated [may establish ;] provided, that the parties shall keep good, safe, and sufficient ferry boats on the lake for the accommodation of and safe transit of all persons and property that may cross or be crossed over such ferry, and shall be liable for all damages that may be assessed against them by a competent Court in favor of any person or persons, for person or property injured, damaged, or lost in such transit by reason of neglect or want of care on the part of the parties herein named SEC. 10. This Act shall take effect from and after its passage.

CHAP. XXVI.—An Act to supply the Town of Washoe City with
Water, and to protect the Town against Fires.

[Approved December 17, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. That John W. North, John P. Foulks, and their associates, successors, and assigns, are hereby granted the right for the term of ten years, and the same is hereby granted to said parties and their assigns, to lay distributing water pipes in any of the public streets or alleys of the Town of Washoe City, and County of Washoe; provided said pipes shall be so laid down as not to interfere or obstruct the public thoroughfares of said City or Town of Washoe, and County of Washoe.

SEC. 2. The rate or price to be charged for water shall be fixed by the County Commissioners of Washoe County.

SEC. 3. It shall be the duty of said parties to commence the said work within six months, from the time of the of passage this Act.

SEC. 4. The City of Washoe, in the County of Washoe, shall county may have the right, at any time after the expiration of five years from the passage of this Act, on giving six months notice of their intention to do so, to purchase all the works and franchise hereby granted to said parties which may be in use for the purpose of supplying water to the people of said city and county at their true value, to be determined by two Commissioners selected by the company, two by the County Commissioners, and one selected by the four Commissioners; provided, the Town_of Washoe City, for fire purposes, the fire companies, and Fire Department, shall be furnished water free of charge; and further, provided, the works sufficient to supply said city with good and pure water shall be completed within two years from the passage of this Act; and provided, the Board of County Commissioners of Washoe County shall at all times have power to order any improvements or repairs in the water works of the parties owning the franchise hereby granted which they may think
