SEC. 4. The said O. M. Evans, and his associates or assigns, Toll gates. may establish the following named toll gates, or more, on said road: One between the Big and Little Meadows, and the other at or above the lower crossing, and collect tolls thereat; provided, the aggregate tolls so collected shall not exceed the rates as designated in section three of this Act; and said company are required to keep said road in good condition and repair; and, provided, further, that said company shall keep a correct account of all moneys received, and pay into the Territorial · Treasury two per cent of the gross receipts thereof. And if it be proven before any Court of competent jurisdiction that said. company has wilfully misrepresented or kept a false account of the receipts of said road, then this charter shall be null and void.

SEC. 6. Any person or persons who shall in any way wan- Penalty for tonly or maliciously destroy or injure any bridge or gate on the injuring line of said road, upon complaint and conviction before any Court of competent jurisdiction shall be fined in any sum not less than twenty-five dollars nor more than five hundred dollars, with costs of suit, and stand committed until the same be paid, or be punished by imprisonment in the County Jail for a period not exceeding six months, in the discretion of the Court. All fines collected under this Act shall be for the use and benefit of said road company.

Sec. 7. The term of this franchise shall be twenty years. SEC. 8. It shall be lawful for the Governor and Legislature of this Territory, at any future session of such Legislature, to alter or change the rates of toll herein provided.

CHAP. CXVI.-An Act authorizing Robert Lyons and L. Wilbourn to construct and maintain a Toll Bridge on the East Walker River, near Dickson's Ranch.

[Approved December 20, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. Robert Lyon and L. Wilbourn, their associates and assigns, are hereby granted the right and privilege of constructing and maintaining a toll bridge (said bridge to be constructed in a good and substantial manner, and not less than sixteen feet wide) on the East Walker River, near Dickson's Ranch, in Esmeralda County.

SEC. 2. The said Robert Lyons, L. Wilbourn, and their associates or assigns, shall have the right to charge and collect tolls on said bridge, not exceeding the following rates, viz:

Wagon and one span of horses, one dollar.

Wagon and one yoke of oxen, one dollar.

Each additional animal, twelve and one half cents.

Empty teams returning, half price.

Buggy and two horses, one dollar.

Buggy and one horse, seventy-five cents.

Man on horseback, twenty-five cents.

Each pack animal, ten cents.

Loose animals, each, five cents.

SEC. 3. The said Robert Lyons, L. Wilbourn, and their associates or assigns, are required to keep said bridge in good condition and repair.

SEC. 4. Any person or persons who, upon demand being made for toll, as provided in this Act, at said toll bridge, by the said parties, or their Agent or Agents, refuses to pay the same as herein authorized, or who shall pass or attempt to pass over said bridge without paying toll as aforesaid, shall, upon complaint and conviction before a Court of competent jurisdiction, be fined in any sum not less than ten dollars nor more than one hundred dollars for each offence, with costs, and stand committed until such fine and costs are paid.

SEC. 5. It shall be lawful for the Governor and Legislature of this Territory, at any future session of such Legislature, to alter or change the rates of toll herein provided.

SEC. 6. This Act shall take effect immediately after its passage.

CHAP. CXVII.—An Act to grant the right to construct a Toll Road from the Town of Como, in Palmyra District, Lyon County, to Carson River, at or south of Empire City, and to authorize the construction of a Bridge across said River.

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. A. J. Vanwinkle, M. Mendelson, and their asso- Franchise. ciates, shall take, have, possess, and enjoy all the rights, privileges, franchises, and rights of way, and full power to build, construct, and maintain a public toll road and bridge; said road to commence at the Town of Como, in the County of Lyon, and running westerly in the most direct available route to the Carson River, at or south of the Town of Empire City, on said river, and there to build, construct, and maintain a good and substantial bridge across said river, which is hereby granted and ceded to said parties for the term of twenty years; provided, that within six months from the date of the passage of this Act, the said parties shall commence the construction of said road, and within twelve months thereafter shall construct and complete said toll road and bridge, otherwise the right to construct the same shall be forfeited, and this Act become null and void. Said parties shall at all times, after its completion, keep said road and bridge in passable order and condition, and shall be responsible for any damage to persons or property travelling over said road and bridge, caused by neglect to keep said road and bridge in proper repair and condition.

SEC. 2. The said parties shall have the right to charge and Rates of toll. collect tolls on said road and bridge, not exceeding the following rates, to wit:

SEC. 4. After the expiration of three years from the comple- County may tion of said road, the Counties of Ormsby and Lyon may have purchase the right to purchase said road at an appraised value, to be determined by five Appraisers-two to be selected by the owners of said road, two by the County Commissioners of Lyon and Ormsby Counties, and one to be selected by the four Appraisers herein before provided for, and such valuation shall be estimated to be the value of the road.

SEC. 5. This Act to take effect and be in force on and after its passage.

CHAP. CXVIII.-An Act to provide for the payment of a Private Secretary to the Governor of Nevada Territory, for services rendered in A. D. one thousand eight hundred and sixty-two.

Be it enacted, by the Governor and Legislative Assembly, as follows: SECTION 1. That the sum of twelve hundred dollars be and the same is hereby appropriated, out of any moneys in the Territorial Treasury not otherwise appropriated, as payment of services rendered by Thomas C. Nye, in the capacity of Private Secretary to the Governor during the year one thousand eight hundred and sixty-two.

SEC. 2. The Territorial Auditor is hereby directed to draw his warrant upon the Territorial Treasurer for the amount specified in section first of this Act in favor of said Thomas C. Nye.

CHAP. CXIX.-An Act to provide for the Appointment of Clerks in the Territorial Auditor and Treasurer Departments, and to provide for the Payment of Contingent Expenses of such Offices.

Be it enacted, by the Governor and Legislative Assembly of Nevada
Territory, as follows:

SECTION 1. That the Territorial Auditor and the Territorial appointed. Treasurer be and are hereby authorized to appoint, in their several departments, one Clerk each, at rates of compensation as hereinafter provided.

SEC. 2. That the sum of two thousand dollars each be and the same is hereby appropriated, out of any moneys in the Territorial Treasury, for the purpose of defraying the current expenses of the offices of the Territorial Auditor and the Territorial Treasurer, and for providing for the necessary stationery, furniture, etc., of their several offices.

SEC. 3. That the sum of twelve hundred dollars per annum be allowed as the compensation of each Clerk so employed and appointed by the Territorial Auditor and Territorial Treasurer, and that the sum of two thousand four hundred dollars per annum be and the same is hereby appropriated, out of any moneys in the Territorial Treasury, for such compensation.

CHAP. CXX.-An Act appointing a Board of Commissioners to have charge of the Territorial Prison.

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. CHAP. CXXI.—An Act supplementary to and amendatory of an Act to provide for the Election of Probate Judges and Prosecuting Attorneys, and defining their Duties, passed at the Second Session of the Legislative Assembly of the Territory of Nevada.

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. Section nine of an Act entitled an Act to provide for the election of Probate Judges and Prosecuting Attorneys, and defining their duties, passed at the second session of the Legislative Assembly of the Territory of Nevada, is hereby amended so as to read as follows:

salary of five hundred dollars, out of the County Treasury.

SEC. 3. This Act shall take effect from and after its passage; Counties provided, that the Counties of Douglas, Humboldt, and Washoe, exempted. are hereby excepted from the provisions of this Act.
