FLINT & PERE MARQUETTE RAILROAD CO.

An Ordinance Granting a Right-of-Way to the Flint & Pere Marquette Railroad Company to Construct, Maintain and Operate a Single Track Along and Upon the North Side of Water Street, from the Present Terminus of Its Tracks Near Seymour Street, to Trumbull Street.

It is hereby ordained by the Common Council of Bay City:

Section 1. That upon compliance with all the provisions of the charter of Bay City, a right of way is hereby granted to the Flint & Pere Marquette Railroad Company, its successors and assigns, to construct, maintain and operate its track upon and along Water street in the City of Bay City, from its present easterly terminus of the same, near Seymour street, east to Trumbull street, subject to the rights of owners and persons interested in property along said street.

Sec. 2. The said railroad company, its successors and assigns, shall and will, when directed by the common council of said city, place proper gates and safeguards at any street crossing on its said track and station and maintain at such crossings, when so directed, flagmen or watchmen to secure the safety of the public.

Sec. 3. Said grantee, its successors and assigns, shall and will construct its track upon the proper grade as now established or as hereafter may be established by the common council of Bay City, under the supervision and direction of the city surveyor of said city.

Sec. 4. The said grantee, its successors and assigns, shall and will observe and obey all ordinances of said city now in force or that may here

after be enacted regulating the running and operating of railroad trains.

Sec. 5. The common council reserves the right to make such amendments to this ordinance as it may deem proper and necessary. Nothing herein shall be construed as granting an exclusive franchise.

It is hereby ordained by the Common Council of Bay City:

Section 1. That upon the compliance with all the provisions of the charter of Bay City, a right of way is hereby granted to the Flint & Pere Marquette Railway Company, its successors and assigns, to construct, maintain and operate its track upon and along Bismarck street, as laid out and established through Duncan's subdivision, as per plat of same on record and in common use, subject to the rights of owners and persons interested in property along said street.
