Three persons who shall be registered, licensed, practicing physicians or surgeons of the State of Idaho, and residents of this State for at least five years next before their * appointment, during which time they shall have been engaged in the lawful and ethical practice of medicine and surgery as defined by the laws of the State of Idaho. Such persons shall be allowed their actual expenses incurred in the performance of their duties, and a per diem allowance, which shall not exceed the sum of $10.00 per day for each day of actual service. The action or report in writing of a majority of the persons designated shall be sufficient authority upon which the Commissioner of Law Enforcement may act.

In making the designation of persons to act for the chiropodists the Commissioner shall give due consideration to recommendations by members of the chiropodist profession and by organizations therein.

SEC. 4. APPLICATION FOR LICENSE. Application for license shall be made in writing, under oath, at such time, in such form and accompanied by such proof of the applicant's fitness to practice as the department may from time to time prescribe.

SEC. 5. QUALIFICATIONS. Each applicant shall be at least twenty-one years of age, of good moral character, and be graduates of some reputable school of Chiropody accredited by the department and which requires for graduation a course of study of at least two years.

SEC. 6. EXAMINATIONS. Except as herein otherwise provided, each applicant shall be examined in writing by the department to determine his knowledge of the subjects taught in reputable schools of chiropody; and which examination shall include the following subjects: anatomy, histology, pathology, bacteriology, physiology, chemistry, dermatology, materia medica, diagnosis, therapeutics, clinical and orthopedic chiropody, limited in their scope to the treament of the foot. Should any applicant fail on such examination to make the required grade, as herein provided, and by reason thereof be refused a license, he shall be entitled within six months of such refusal to a re-examination upon payment of an additional fee of $10.00 to the department; but two

such re-examinations shall exhaust his privilege under his original application.

SEC. 7. REGULATION OF CHIROPODISTS NOW PRACTICING. Any person of good moral character who is now established in the practice of Chiropody and has been actively engaged in the practice thereof for not less than one year next preceding the passage of this Act, within the State of Idaho, whether graduates of any school of chiropody or not, shall, upon furnishing proof thereof to the department and upon payment of the proper license fee, be entitled to a license without examination; Provided, that applications by such persons for license shall be filed with the department not later than July 1, 1925.

SEC. 8. APPLICANTS LICENSED ELSEWHERE. Any Chiropodist who has been lawfully licensed to practice in another state which maintains a standard of proficiency equal with that now maintained in this state under the provisions of this chapter, and which extends the same reciprocal privilege to this state, may upon proper application, and upon payment of a license fee of $50.00 to the department, be issued a license without examination.

SEC. 9. FEES. Each applicant shall remit a fee of $15.00 with his application for a license. The request of each licensed chiropodist for an annual renewal license shall be accompanied by a fee of $2.00. The payment of fees herein provided is a condition precedent to the performance of any acts by the department.

SEC. 10. LICENSES. If the applicant shall pass a satisfactory examination and shall show that he is a person of good moral character and that he possesses the qualifications required by this chapter to entitle him to a license as a chiropodist, he shall be entitled to a license authorizing him to practice chiropody within the State of Idaho.

All licenses to practice chiropody shall expire on the 30th day of June of each year; all persons who practice chiropody within the meaning of this chapter are entitled to renew and shall renew their licenses on or before the 1st day of July of each year; and shall make application to the department therefor.

Every person to whom a license is granted shall have such license displayed in a conspicuous part of his office wherein the practice of chiropody is conducted, at all times when practicing or offering to practice chiropody.

SEC. 11. REGISTER. The department shall keep on file a register of all applicants for license, rejected applicants and licentiates.

SEC. 12. REVOCATION OF LICENSES. Every license issued under the provisions of this chapter shall be subject to revocation by the department upon any of the following grounds:

1. Fraud or deception in procuring a license.

2. The publication or use of untruthful or improbable statements with the view of deceiving or defrauding the public or any patient.

3. Conviction of any offense involving moral turpitude. 4. Habitual intemperance in the use of ardent spirits, narcotics or stimulants.

5. Immoral, unprofessional or dishonorable conduct manifestly disqualifying the licentiate for the public practice of healing the sick.

6. The failure to procure a renewal license as provided in this chapter.

In prescribing procedure for the determination of the truth or falsity of any charge against a licensee, having for its purpose the revocation of his license, the accused shall in every case have reasonable notice of, and opportunity to appear and be heard at any hearing thereof. In case the department revoke a license to practice under this chapter, the licentiate shall have the right to have the action of the department revoking such license reviewed by the district court in and for the county in which the meeting at which the license was revoked was held, or such other county as may be agreed upon. Provided, proceedings for such review be instituted within 20 days after notice of such revocation to the applicant.

SEC. 13. PENALTY. Any person who practices or attempts to practice chiropody, who publicly advertises as a chiropodist, or who uses the title "Chiropodist", "Podiatrist", any other word, title, or abbreviation calculated to induce belief that he is engaged in the practice of chiropody, without a license as provided in this chapter, is guilty of a misdemeanor.

AN ACT

AMENDING SECTION 808 OF THE IDAHO COMPILED STATUTES RELATING TO THE OATH, BOND AND QUALIFICATIONS OF COUNTY SUPERINTENDENTS OF PUBLIC INSTRUCTION.

Be It Enacted by the Legislature of the State of Idaho:

SECTION 1. That Section 808 of the Idaho Compiled Statutes be and the same hereby is amended to read as follows:

"Section 808. OATH; BOND; QUALIFICATIONS. entering upon the duties of his office, the County Superintendent of Public Instruction shall take and subscribe the oath prescribed by law, and execute a bond, payable to the State of Idaho, with two or more sureties to be approved by the Board of County Commissioners, in the penal sum of not less than $2000, conditioned upon the faithful performance of his official duties, and the delivery of all moneys and property received by him as such superintendent to his successor in office, which official bond, together with his official oath, shall be filed in the office of the County Recorder, not later than the second Monday in January, next after election: Provided, That no person shall be eligible to the office of County Superintendent of Public Instruction unless he be, at the time of his nomination or appointment a qualified elector of the county from which he is nominated or appointed, of the age of 25 years, a holder of a state or state life certificate, a teacher of not less than two year's actual experience and service as a teacher in the schools of Idaho, one of which year's experience must have been while holding a valid certificate of a grade not lower than a state certificate; all of which aforesaid qualifications must be in force at the time of nomination or appointment, Provided, That in counties of less than 2500 population the County Superintendent of Public Instruction need not have two years service as teacher in Idaho nor need such service be under a certificate of Idaho to hold such office.

RELATING TO THE FORESTS OF THE STATE; PROVIDING FOR THEIR PRESERVATION; CREATING A STATE COOPERATIVE BOARD OF FORESTRY AND DEFINING THE POWERS AND DUTIES THEREOF; ENLARGING THE POWERS AND DUTIES OF THE STATE LAND DEPARTMENT; ADDING THERETO AN OFFICE TO BE KNOWN AS STATE FORESTER AND PROVIDING COMPENSATION FOR HIS SERVICE; PROVIDING FOR THE APPOINTMENT OF A DEPUTY STATE FORESTER; FIRE WARDENS AND DEPUTY FIRE WARDENS AND DEFINING THEIR DUTIES AND POWERS; PROVIDING FOR THE CREATION OF FOREST PROTECTIVE DISTRICTS; PROVIDING FOR THE COOPERATION OF ALL AGENCIES WITHIN THE STATE FOR THE PREVENTION AND CONTROL OF FOREST FIRES WITHIN SUCH DISTRICTS; CREATING A FOREST PROTECTION FUND; A FORESTERS' SPECIAL FUND, AND MAKING AN APPROPRIATION THEREFOR; PROVIDING METHODS FOR CARRYING THE PROVISIONS OF THIS ACT INTO EFFECT; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; REPEALING CHAPTER 132 OF IDAHO COMPILED STATUTES, AND DECLARING AN EMERGENCY.

Be It Enacted by the Legislature of the State of Idaho:

SECTION 1. To facilitate the cooperation, financial and otherwise, of the State of Idaho with the other principal agencies with which it is associated in the protection of forest resources, forest range, water conservation and sustained stream flow, and to promote advantageous knowledge and utilization of the State's forest holdings on behalf of its citizens, schools and institutions, there is hereby created a State Cooperative Board of Forestry which shall consist of the Governor, the Attorney General, the Secretary of State, the State Auditor, the State Superintendent of Public Instruction, the State Land Commissioner, the Dean of the School of Forestry of the University of Idaho, the State Commissioner of Reclamation, and four citizens of the State of Idaho to be appointed by the Governor, as follows: one from and upon the recommendation of the timber protective associations of North Idaho; one from and upon the recommendation of the timber protective association of South Idaho; one from and upon the joint recommendation of the Idaho Wool Growers Association and the Idaho Cattle and Horse Growers Association; and one from and upon the recommendation of the United States Forest Service.
