Mr. Kendall moved that said report be laid upon the table to be printed.

Mr. Horton, from the committee on Railroads and Turnpikes, reported back H. No. 117, to lay out and establish a free turnpike road from Richland, in Logan county, to Roundhead, in Hardin county, recommending its passage.

Ordered to be read the third time on tomorrow.

Mr. Archbold, from a select committee, reported a bill (S. No. 57) to extend the provisions of the act passed Feb. 28th, 1813, entitled an act to authorize the court of common pleas to remit or reduce judgments or recognizes in certain cases, and for other purposes; which was read the first time.

Accompanying said bill was the following report:

II. No. 128; To appoint commissioners to lay out and establish a free turnpike road in the county of Paulding.

The following bills were severally read the third time and passed: H. No. 42; To incorporate the proprietors of the Burnett House, Cincinnati.

H. No. 102; To amend the act incorporating the town of Troy, in the county of Miami, passed March 7, 1842, and to repeal certain sections of an act amendatory thereto, passed February 26, 1846.

H. No. 110; To authorize the sale of school section sixteen, in Crane township, Wyandott county, Ohio.

H. No. 115; To lay out and establish a graded State road in the counties of Gallia and Jackson.

Ordered that the titles be as aforesaid.

Mr. Bennett gave notice that he would, on tomorrow or some other day of the present session, ask leave to introduce a bill, to amend the act entitled an act to amend the act for levying taxes on all property in this State according to their true value, passed February 8, 1817, so as to require county treasurers to visit the several townships of their respective counties for the purpose of receiving taxes.

On motion of Mr. Lewis,

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of requiring a docket fee to be taxed in all judicial causes, to be paid into the county treasury, and that said committee do also inquire into the expediency of making jury fees commensurate in amount with the time occupied in the trial of the

cause.

Mr. Scott offered for adoption the following resolution :

Resolved, That the Board of Public Works transmit to this body, at its earliest convenience, answers to the following inquiries, viz :

1. What quantity of water, estimated by the run of mill stones, is now leased at each of the towns of Bremen, St. Marys, and Spencer in the county of Mercer, and Howard in the county of Vanwert? 2. The contract price for each run of stone at the several towns named?

3. Do the leases at each place guaranty a permanent supply of water, save the usual reservation of a month for repairs, if not, which are exceptions?

4. What amount of water has the State to lease at St. Marys, with the reservoir at its present level?

5. What increased amount could the State lease at St. Marys, if the reservoir was filled to the level originally contemplated?

6.

Would it be detrimental to the interest of the State to lease a permanent water power at the west bank of said reservoir?

On motion of Mr. Archbold,

Said resolution was laid upon the table.

Mr. Archbold, according to previous notice, from a select cominittee, reported by bill (S. No. 58) supplementary to the several acts concerning banks and banking; which was read the first time.

On motion of Mr. Claypool,

The Senate resolved itself into a committee of the whole on the orders of the day, and after some time spent therein, rose, and Mr. Stutson reported back the following bills, some with and some without amendment:

The standing committee on New Counties, to which was referred remonstrances against the erection of the county of Cumberland, ask to be discharged from the further consideration of the subject, and recommend that the petitioners have leave to withdraw their papers. A message from the Governor was received and read, announcing the resignation, by Sam'l F. Yeoman, of the office of associate judge of the county of Fayette.

Also, a message announcing the resignation, by the Rev. Mr. Dobb, of the oflice of Trustee of the Asylum for the Deaf and Dumb.

House bill No. 3, prohibiting any citizen of this State from holding, by election or appointment, more than one of the several offices therein named at the same time, was taken up.

Mr. Ewing moved to amend said bill by adding the following pro

viso:

"Provided this act shall not take effect or be enforced in any county in this State where the population is less than ten thousand." Which was agreed to.

Mr. Olds moved the indefinite postponement of said bill. Upon which question, he demanded the yeas and nays, which were ordered, and resulted—yeas 14, nays 20, as follows:

YEAS-Messrs. Ankeny, Beaver, Bennett, Blocksom, Byers, Corwin, Evans, Graham, Hopkins, Johnson, King, Olds, Winegarner, and Speaker-14.

NAYS-Messrs. Archbold, Backus, Burns, Claypool, Cronise, Eaton, Ewing, Haines, Hastings, Horton, Judy, Kendall, Lewis, Randall, Reemelin, Scott, Spindler, Stutson, Wheeler, and Wilson-20.

So the motion was lost.
