priated out of any moneys in the State Treasury, not otherwise appropriated, the sum of eighty thousand dollars $80,000.00) for the erection and equipping of an Armory and Gymnasium Building upon the grounds of the State College of Agriculture and Mechanic Arts at Brookings.

§ 2. Regents to Have Supervision] The erection and equipping of said building shall be under the control and management of the regents of education, and shall be allotted by contract after duly advertising for bids therefor.

§ 3. Duty of State Auditor] The State Auditor shall issue warrants upon the State Treasurer in payment for the erection and equipping of said Armory and Gymnasium Building upon properly certified and itemized vouchers from said regents of education, and upon the presentation of such warrants the state Treasurer shall pay the same.

APPROPRIATION FOR LITIGATION IN U. S. SUPREME COURT.

AN ACT Entitled, An Act to Appropriate Money to Pay Towards the Expenses of Procuring Evidence and Preparing Same for Trial and Presenting Same to the Court in the Case of State of South Dakota vs. The State of Minnesota, Pending in the United States Supreme Court.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. There is hereby appropriated out of any money in the state treasury not otherwise appropriated or so much thereof as may be deemed necessary, the sum of one thousand $1000 dollars, to be expended under the direction of the attorney general, for the purpose of procuring evidence, preparing same for trial, and presenting same to the court in the case of South Dakota vs. State of Minnesota, now pending in the United States Supreme Court.

§ 2. The moneys hereby appropriated shall be paid out by warrants issued by the state auditor upon vouchers approved by the attorney general.

APPROPRIATION FOR STATE COLLEGE AT BROOKINGS.

AN ACT Entitled, An Act to Appropriate Money for Repairing and Reconstructing the Steam Heating Pipe Lines from the Central Heating Plant to the Gymnasium and from the Central Heating Plant to the Creamery and for Furnishing and Equipping the New Women's Dormitory at the State College of Agriculture and Mechanic Arts.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. There is hereby appropriated out of any money in the state treasury not otherwise appropriated the sum of five thousand dollars ($5000.00) for the repairing and reconstructing of the steam heating pipe lines from the Central Heating Plant to the Gymnasium and from the Central Heating Plant to the Creamery and the sum of Ten thousand Dollars ($10,000.00) for furnishing and equipping the new women's dormitory at the State College of Agriculture and Mechanic Arts, to be expended under the direction of the State Board of Regents of Education. § 2. An emergency is hereby declared to exist and this act shall be in full force and effect from and after its passage and approval.

APPROPRIATION FOR LIVE STOCK REVOLVING FUND AT STATE COLLEGE.

AN ACT Entitled, An Act Creating a Live Stock Revolving Fund, for the Purchase of Live Stock for Feeding Experiments at the State College of Agriculture and Mechanic Arts.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. There is hereby appropriated out of moneys in the State Treasury not otherwise appropriated the sum of five thousand ($5000) dollars for the purchase of live stock for feeding experiments at the State College of Agriculture and Mechanic

Arts to be expended by the Professor of Animal Husbandry under the direction of the State Board of Regents of Education.

§ 2. All moneys received by the State College of Agriculture and Mechanic Arts from the sales of any live stock purchased under the provisions of this act shall be paid into the State Treasury in the manner now provided by law and shall be credited to the fund to be known as the live stock revolving fund, which shall be used only for the purchase of live stock for feeding experiments and for the care of such live stock and for expenses incidental thereto, as herein provided. DEFICIENCY APPROPRIATION EXPENSE FUND, RAILROAD
COMMISSIONER, THIRD DISTRICT.

AN ACT Entitled, An Act Appropriating Money for the Payment of a Deficiency Existing in the Expense Fund of W. G. Smith, Ex-Railroad Commissioner from the Third District.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. There is hereby appropriated out of any money in the state treasury not otherwise appropriated the sum of Seventy-six Dollars and fifty-three cents ($76.53), or so much thereof as may be necessary to pay deficiency evisting in expense fund of W. G. Smith, Ex-Railroad Commissioner from the Third District.

§ 2. The moneys so appropriated shall be paid out by the state treasurer on warrants of the state auditor on itemized and certified vouchers approved by the Railroad Commissioners.

§ 3. For the reason that the appropriation out of which this claim was to be paid was exhausted when the voucher was presented, an emergency is hereby declared to exist and this act shall take effect and be in force from and after its passage and approval.

APPROPRIATION FOR EXPENSES INCURRED BY RAILROAD
COMMISSION.

AN ACT Entitled, An Act to Appropriate Money to Pay for Expenses of Nelly I. Clarke and D. L. Kelley Incurred Attending Hearing of Railroad Commissioners Held at Deadwood, Belle Fourche, Rapid City and Hot Springs from June 1st to June 27th, 1914.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. There is hereby appropriated out of the general fund of the state of South Dakota the sum of Thirty-one Dollars and fifty-nine cents ($31.59) or so much thereof as may be necessary, to pay the expenses incurred by Nellie I. Clarke and D. L. Kelley attending hearing of the Board of Railroad Commissioners held at Deadwood, Belle Fourche, Rapid City and Hot Springs from June 1st to June 27th, 1914, as follows:

APPROPRIATION FOR INSURANCE TAX TO THE CITY OF FAITH.

AN ACT Entitled, An Act to Appropriate Money to Pay the City of Faith Their Apportionment of the Insurance Tax for Fire Department for Which They Failed to Qualify in 1915.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. There is hereby appropriated out of the general fund

of the State not otherwise appropriated the sum of Fifty-four and 11/100th ($54.11) Dollars to pay the city of Faith for their portion of the insurance tax for the fire department which they failed to receive for the year 1915 by reason of the failure of their city auditor to report as provided by section 1526 of the Political Code of 1903.

§ 2. That the City of Faith shall become entitled to and may receive the amount apportioned to them under the preceding Section upon the city auditor furnishing to the auditor of the state and to the commissioner of insurance on or before. the 1st day of April, 1917, a certificate as required by Section 1522 and Section 1525 of the Political Code of 1903.

§ 3. An emergency is hereby declared to exist and this act shall be in full force and effect from and after its passage and approval.

Be It Enacted by the Legislature of the State of South Dakota:

§ 1. There is hereby appropriated out of any money in the state treasury not otherwise appropriated the following sums to the following persons respectively, for the payment of the expenses of the members of the joint legislative committee appointed under the provisions of Concurrent Resolution, Adopted Janvary 30, 1917, found on page 342 of the House Journal:
