CHAPTER 43.

An Act to Amend Chapter 73, The Revised Statutes, 1923, "Of Laying Out of Private Ways."

(Passed the 23rd day of May, A. D., 1925

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 5 of Chapter 73 of the Revised Statutes, R. S., c. 78, s. 5 1923, "Of Laying Out of Private Ways," is amended by striking out in the first line of said section the word "roadside" and substituting therefor the words "side of a private way.'

CHAPTER 44.

An Act to Amend Chapter 75, The Revised Statutes, 1923, "The Public Highways Act."

(Passed the 23rd day of April, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Sub-section (3) of Section 39 of Chapter 75 R. S., c. 75, of the Revised Statutes, 1923, "The Public Highways stituted. Act," is repealed and the following substituted therefor:

(3) Every person ordered to attend for work as Duty of person aforesaid shall

(a) attend for work and work as aforesaid, or

(b) provide a competent person to work and who shall work as aforesaid in his place, or

ordered to attend.

(c) pay to the overseer on the day on which he is ordered to work as aforesaid a tax of two dollars and fifty cents for the use of the municipality, and the overseer shall expend said sum for the purpose of removing the snow from the highway and making it passable, and shall account to the municipality for all such sums received and expended.

If any person ordered to attend for work as aforesaid fails to comply with the provisions of this subsection such person shall be liable to a penalty of not less than two dollars and fifty cents nor more than ten dollars.

Ss. 27, 28, 30- 2. Sections 27, 28, 30, 31, 32, 33, 34 and 45 of said 34, 45 repealed. Chapter 75 are repealed and said sections shall be deemed not to have come into force or effect nor to have had nor to have on, from or after the 21st day of February, 1924, the force or effect of or as law nor to have been inserted or included in nor to have formed part of said Chapter 75.

3. Sub-section (2) of Section 47 of said Chapter 75 is repealed and the following substituted therefor :

(2) Every highway, together with the land within the highways' boundaries, is vested in His Majesty The King, his heirs and successors. Every road now open or used as a public road or highway is declared to be a common and public highway.

4. Section 50 of said Chapter 75 is amended by adding thereto the following:

(4) Notwithstanding the provisions of any special or general Act of the Legislature of Nova Scotia no person or corporation shall except as in this Act provided place, set or maintain any telegraph, telephone, electric light or power pole or wire, fixture or attachment on any highway in any municipality other than a city or town.

5. Section 52 of said Chapter 75 is repealed and the following substituted therefor:

(2) A certificate signed by the Chairman of the Board containing a description of such highway or part thereof and stating that the right of the public to use the same has been extinguished, shall be filed in the office of the Registrar of Deeds for the registration district in which such highway or part thereof is situate.

(3) The Board may make such provision for the use of such highway or part thereof by the adjoining owners as the Board deems expedient, or the land within the boundaries of such highway or part thereof may be sold, leased, or otherwise disposed of by the Governor-in-Council.

CHAPTER 45.

An Act to Amend Chapter 76, The Revised Statutes, 1923, "The Motor Vehicle Act."

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 16 of Chapter 76 of the Revised Statutes, R. S., c. 76, 1923, is amended by adding to Sub-section (4) the 16 amended. following clause:

(d) if a Commercial Vehicle of a carrying capacity of one ton or more than one ton is operated on any public highway outside of a City or incorporated Town at a rate of speed greater than twenty miles in one hour.

3. Sub-section (4) of Section 49 of said Chapter is repealed and the following substituted therefor:

(4) (a) The Governor-in-Council may repeal the said schedule and substitute a new schedule in place thereof, or may from time to time alter or amend the said schedule or such new schedule.

(b) the fees contained in any such substituted schedule may be determined by the price, horsepower or weight of the motor vehicle or by any or all of the foregoing, or may be determined by any other basis or rate.

CHAPTER 46.

An Act to Amend Chapter 76, Revised Statutes, 1923, "The Motor Vehicle Act."

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 12 of Chapter 76 of the Revised Statutes, 1923, "The Motor Vehicle Act" is amended by inserting the following sub-section after sub-section (4):—

(4a) The provisions of the next preceding sub-section of this section shall not apply to any motor vehicle owned by a person residing or carrying on business in any province or state which does not grant the same privilege to motor vehicles registered in the Province of Nova Scotia; and where such province or state grants a lesser privilege in respect to the operating period or to the style of vehicle affected the exemp

CHAPTER 47.

An Act to Amend Chapter 77, Revised Statutes, 1923, the "Load of Vehicles Act."

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:
