PREFACE.

In pursuance of the plan adopted two years ago of publishing each year a volume of opinions written by the Corporation Counsel and Assistants, so that each book may represent, in point of time, the principal advisory work of the Law Department for a fixed period, this volume is issued for the year extending from April 16, 1925, to April 15, 1926.

It was announced that with the completion of the last two volumes and the volume recently printed covering the years 1905-1907 substantially all opinions of present importance rendered by the department since 1872 were made available. When the index for these was being prepared, however, it was found that some had been omitted which are still of sufficient interest and present value to make their publication desirable. In order to bring these within the reach of the City Council and the heads of the various departments of the city, as well as to make them more accessible to the staff of the Corporation Counsel, we concluded to add them to this volume, and they appear at the end of the work as an appendix. A glance at the opinions contained in that part of this book will show that there is ample justification for doing this.

There have been published, up to the present time, thirteen volumes of selected Opinions of the Corporation Counsel and Assistants, covering the time from January 1, 1872, to April 15, 1925. An index to these thirteen volumes, printed as a separate book, was recently added. The publication of this series of books was not the result of a preconceived plan, and consequently no system of numbering the volumes was adopted. For obvious reasons it was not considered advisable to number them even when the index was printed. Since it

is the purpose now to publish a new book each year, we believe it will tend to make the work as a whole more convenient for ready reference if future volumes are numbered. We have therefore designated this as Volume Fourteen, with

the intention of having future issues numbered successively after the thirteen already in print.

In all other respects the current work follows the general plan of the former books. The aim has been to select opinions which will be of value in the future rather than such as are concerned with matters that will not arise again. We have also, as far as possible, avoided duplication, although necessarily, with respect to opinions that treat of the same general subject-matter, reiteration cannot be entirely eliminated. It is to be hoped that the work will add to the value of the series heretofore completed.

Maintenance of Commercial Sign in Apartment District Contrary to Zoning Ordinance.

HON. FRANK E. DOHERTY, Commissioner of Buildings.

Dear Sir:

You have advised this office that a sign is being maintained by the Illinois Life Insurance Company at 1212 Lake Shore drive, Chicago, which, in your opinion, is in violation of the Zoning Ordinance. You state that you have notified the Illinois Life Insurance Company to remove this sign, and that they have refused so to do. You have requested this office to render an opinion relative to whether the maintenance of this sign is in violation of the Zoning Ordinance.

The building occupied by the Illinois Life Insurance Company is located at 1212 Lake Shore drive in the City of Chicago. Except for the south seventy-eight or eighty feet of the block, it occupies all the block which lies south of Scott street west of Lake Shore drive, north of Division street and east of Stone street. The south half of the building was completed in May, 1922, and the north half of the building
