Emergency. Section 7. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval. Approved March 27, 1924. CHAPTER 39 SENATE BILL NO. 25. County Excise Board. AN ACT relating to County Excise Boards; creating said Boards in each County in this State having a population in excess of 110,000 inhabitants, according to the Federal Census of 1920, and prescribing the powers and duties thereof; prescribing the qualifications, pay, term and manner of selecting members of said Boards, making the County Clerk of each such County Ex-Officio Secretary of said Board, presc! bing certain duties of the State Examiner and Inspector, and declaring an emergency. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: County Excise Board-Created-Members. Section 1. There is hereby created in each and every County in this State having a population in excess of One Hundred and Ten Thousand ($111,000), according to Federal Census of 1920, an excise board to be composed of five (5) freeholders as follows: one from each County Commissioner's District and two (2) from the County at large. Said member from each County Commissioner's District shall be nominated and elected in 1924 and every two (2) years thereafter in the manner prescribed for County Commissioners. Said members at large shall be nominated and elected in 1924 and every two (2) years thereafter in the manner prescribed for County officers. All of said members shall take office on July 1st, following their election and shall serve for two (2) years and until their successors are elected and qualified. Upon the passage and approval of this Act, the Governor shall within thirty (30) days thereafter, appoint proper persons in each such County as members of the Excise Board for said County, who shall serve untii July 1st, 1925, and until their successors are elected and qualified. Vacancies in said Excise Board of any such County shall be filled by appointment by the other members of said Board. All persons elected or appointed as members of the Excise Board of any County shall, before entering upon their duties as such, take and subscribe to the Constitutional oath for County officers. Same-Members-Serve Without Pay. Section 2. Members of the Excise Board of such County shall serve without pay, except that they shall be allowed their necessary traveling expenses, including hotel bills, while engaged in the performance of their duties. Same-Organization. Section 3. The Excise Board of each such County shall organize immediately after the beginning of each term by selecting one of its members as Chairman and another as Vice-Chairman. The County Clerk of said County shall be ex-officio Secretary of said Board, without any additional compensation therefor. Meetings-Adjournment. Section 4. All meetings of the Excise Board of any such county shall be held at the County seat of said County upon the call of the Chairman of the Board, or upon the call of three (3) members thereof or upon the order of said Board. No action except recess and adjournment shall be taken by said Board, without the concurrence of a majority of all members elected to and constituting said Board. Powers and Duties. Section 5. The excise Board of any such County shall have power and authority to call upon the State Examiner and Inspector for any assistance in determining the financial condition of said County, or of any city, town or school district therein. It is hereby made the duty of said State Examiner and Inspector to render such assistance. Emergency. Section 6. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval. Approved March 25, 1924. CHAPTER 40 SENATE BILL NO. 26. State Treasurer's Department. AN ACT Amending Paragraph "D", of Section 111, Compiled Statutes, 1921, Relating to the State Treasurer's Department, making Appropriation for said Department, Repealing Certain and Conflicting Statutes, and declaring an emergency. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: State Treasurer's Department-Salaries. Section 1. That Paragraph "d," of Section 111, Compiled Statutes, 1921, be, and the same is hereby amended to read as follows: "d. State Treasurer, $3,000.00; Assistant State Treasurer and Chief Clerk, $2,400.00; Chief Accountant, $2,100.00; Bond and Security Registrar, $1,800.00; Cashier, $1,800.00; Assistant Bond and Security Registrar, $1,500.00; Assistant Cashier, $1,500.00; Warrant Clerk, $1,500.00; Remittance Clerk, $1,500.00; Four (4) Bookkeepers, $1,500.00 each; Two (2) Stenographers, $1,500.00 each." Appropriation. Section 2. There is hereby appropriated out of any monies in the Treasury of the State of Oklahoma, not otherwise appropriated, for the fiscal years ending June 30th, 1924, and June 30th, 1925, the following sums, or so much thereof as may be necessary for the purposes herein named, and no other: Section 3. Section 81, Compiled Statutes, 1921, and Sub-Section, entitled "State Treasurer, Administration," of Section 1, Chapter 49, Senate Bill 107, Session Laws of Oklahoma, 1923, are hereby repealed, and all laws and parts of laws in conffict herewith are hereby repealed. Emergency. Section 4. Approved March 14, 1924. CHAPTER 41 SENATE BILL NO. 27. Adjutant General's Office. AN ACT reorganizing the Adjutant General's office of the Military Department, giving a list of the officers and employees, fixing salaries and providing for the appointment thereof, making appropriation for said department, and repealing conflicting statutes. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: Adjutant General's Office Officers and Employees-Salaries. Section 1. From and after July 1st, 1924, the officers and employees in the Adjutant General's office of the Military Department, and the salaries for same shall be as provided in this Section: One (1) File Clerk and Stenographer, salary. 1,200.00 One (1) Quartermaster and United States property and Disbursing Officer, salary ($104.67 per month) 1,256.04 One (1) Stenographer, salary 1,500.00 One (1) File Clerk and Stenographer, salary 1,200.00 One (1) Assistant Quartermaster and Survey Officer, salary. 1,800.00 All officers and employees herein provided, except the Adjutant General, shall be appointed by and shall serve during the pleasure of said Adjutant General. Same-Appointment-Duties. Section 2. The Adjutant General shall be appointed by the Governor, by and with the advice and consent of the Senate, and shall serve during the pleasure of the Governor. No person shall be appointed as Adjutant General, except a federally recognized officer of the Oklahoma National Guard not below the rank of Captain; provided, that said officer shall have been a federally recognized officer of said Guard for not less than three years next preceding said appointment; provided further, that said officer shall have been a federally recognized officer of said Guard of the rank of Captain or a higher rank for not less than two years next preceding said appointment. The position of Adjutant General shall carry with it the rank of Brigadier General in the Adjutant General's Department. The Adjutant General shall be military adviser to the Governor, shall be the Chief Administrative officer of said Guard, and shall be charged generally with the duty of supervising and directing the organization, regulation, instruction and other activities of said Guard and all units thereof; provided, that when said Guard or any part thereof shall be mobilized for instruction purposes or for field duty, the same shall be in charge of, and under the control and direction of, the senior line officer present and on duty.
