Mr. White, from the committee on affairs of cities, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

Mr. Cohalan moved that the committee on the judiciary be discharged from the consideration of Senate bill (No. 1012, Int. No. 773) entitled "An act to establish a public service commission and prescribing its powers and duties, and to provide for the regulation and control of certain public service corporations and making an appropriation therefor," and that said bill be amended, reprinted and recommitted to the committee on the judiciary.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Ackroyd moved that the committee of the whole be discharged from the consideration of Senate bill (No. 1353, Int. No. 528) entitled "An act to amend and consolidate the several acts relating to the department of public instruction in the city of Utica, N. Y.," and that said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Wemple moved that the committee of the whole be discharged from the consideration of Senate bill (No. 1471, Int. No. 801) entitled "An act to amend chapter 690 of the Laws of 1892, entitled 'An act in relation to insurance corporations, constituting chapter 38 of the general laws,' as amended by chapter 543 of the Laws of 1904 and by chapter 326 of the Laws of 1906, relating to securities guaranty corporations," and that said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Owens moved that the committee of the whole be discharged from the consideration of Assembly bill (No. 2270, Senate reprint No. 1491, Rec. No. 632) entitled "An act to amend the Greater New York charter, relative to salaries of the members of the fire department," and that said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Wemple offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor, requesting the return to the Senate of Senate bill (No. 859, Int. No. 717) entitled "An act to change the name of Home of the Friendless of Schenectady' to 'Old Ladies' Home of Schenectady,'" for the purpose of amendment..

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above resolution, with a messagethat they have concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Gov

ernor.

The Senate resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

(1) Senate (No. 1420, Int. No. 121), entitled "An act to amend the Domestic Relations Law, by providing for marriage licenses."

After some time spent therein, the President resumed the chair, and Mr. Franchot, from said committee, reported in favor of the passage of the above-named bill, with amendments.

Mr. Cobb moved to disagree with said report by striking out the amendments made by the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative, as follows:

Said report was then agreed to, and said bill ordered to a third reading.

Mr. Franchot also reported in favor of the passage of the bill.

(2) Assembly (No. 1339, Rec. No. 304), entitled "An act to amend the Domestic Relations Law, in relation to marriage by written agreement," with amendments, which report was agreed to, and said bill ordered to a third reading.

A message from the Assembly was received, in the words following:

IN ASSEMBLY, April 24, 1907.

Pursuant to concurrent resolution of the Senate and Assembly, the Governor returned the Assembly bill (No. 2145, reprint No. 2547, Rec. No. 562) entitled "An act to amend the Liquor Tax Law, in relation to State Commissioner of Excise; deputy commissioner; special deputy commissioner; and local option.'

The vote upon the final passage of the said bill having been reconsidered, on motion of Mr. F. G. Whitney, said bill was recommitted to the committee on excise, with instructions to said committee to report the same forthwith, amended as follows:

Page 1, amend title by striking out the words "excise taxes; liquor tax certificates ".

Page 3, line 7, strike out brackets and the word "October". Page 3, line 8, strike out brackets and the word "May".

Page 8, strike out lines 24 and 25.

Page 9, strike out from and including line 1 to and including line 23.

Page 9, line 24, strike out "5" after "8" and insert "4". Page 10, line 25, strike out "6 after "8" and insert " 5" Page 14, line 15, strike out brackets and the word "October ". Page 15, line 17, strike out brackets and the word "October". Page 16, line 2, strike out letter "t" in "not" so as to read no liquor tax certificate".

The Assembly returned the Senate bill (No. 1130, Int. No. 893) entitled "An act to amend the Greater New York charter, relative to the department of health pension fund," with a message that they have concurred in the passage of the same.

Ordered, That the Clerk transmit said bill to the mayor of the city of New York for a hearing, pursuant to the provisions of the constitution.

The Assembly returned the Senate bill (No. 1066, Int. No. 851) entitled "An act making an appropriation for the State's proportion of the amounts appropriated for the repair of highways, pursuant to section 53 of the Highway Law."

Also, Senate bill (No. 592, Int. No. 511) entitled "An act to amend section 384-h of the Penal Code, relative to hours of labor to be required of employees of a corporation operating a line of railroad thirty miles in length, or over."

Also, Senate bill (No. 1415, Int. No. 594) entitled "An act to amend chapter 306 of the Laws of 1904, entitled 'An act to organize and establish a police department for the village of White Plains, in the county of Westchester and State of New York,' in relation to the number and compensation of members of the police force and the maximum sums to be raised for the expenses of the board of police and police force," with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said bills to the Governor. The Senate bill (No. 1027, Int. No. 642) entitled "An act to amend section 142 of chapter 105 of the Laws of 1891, entitled 'An act to revise the charter of the city of Buffalo,' as amended by chapter 707 of the Laws of 1900, in relation to divisions of taxes and assessments," was returned by the mayor of the city of Buffalo, with a certificate that a public hearing had been duly held on said bill in pursuance of law, and that the mayor had duly accepted the same.

Ordered, That the Clerk deliver said bill to the Governor.
