each of said districts for the amount of all school taxes and interest thereon, included in any such tax leases and certificates of sale for non-payment of taxes, affecting any lot, piece or parcel of land within the corporate limits of the said city and of such districts, which several taxes shall not have been previously paid by the said town or its supervisor to said district; and such indebtedness on the part of such city to such district shall in the adjustment aforesaid be deemed and taken to be an asset of said district. §3. This act shall take effect immediately.

§ 3. to sign such bonds, and it shall be the duty of the clerk of the
common council of said city to countersign the same and to
affix thereto the seal of said city. Said bonds shall bear interest
at a rate to be fixed by the comptroller, not exceeding four per
cent per annum, and shall not be disposed of at less than the
par value thereof, and shall be issued only with the consent and
approval of the board of estimate and apportionment.
4. This act shall take effect immediately.

AN ACT to amend chapter six hundred and fifty-eight of the laws of eighteen hundred and sixty-nine, entitled, "An act to incorporate the 'Buffalo Turnverein," " passed May sixth, eighteen hundred and sixty-nine.

BECAME a law February 2, 1894, with the approval of the Governor. Passed, a majority being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section two of chapter six hundred and fifty-eight of the laws of eighteen hundred and sixty-nine entitled "An act to incorporate the 'Buffalo Turnverein'" is hereby amended so as to read as follows:

§ 2. The object of this society shall be the moral and mental improvement of its members, the charitable relief of sick or distressed members, and the education of its members and others by means of a public library, reading rooms, class instruction and otherwise.

§ 2. This act shall take effect immediately.

Chap. 13.

AN ACT to authorize the city of Yonkers to issue railway paving

bonds.

BECAME a law February 6, 1894, with the approval of the governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senats and Assembly, do enact as follows:

Section 1. The common council of the city of Yonkers may, from time to time, issue bonds in addition to all other bonds now

authorized to be issued by law, for such sums as may be necessary to pay the expense of paving those portions of the streets of the city through which street railroads are now or may hereafter be laid, which are comprised between the tracks and a distance of two feet in width on each side of the tracks of any such street surface railroad; provided, that the aggregate of such bonds outstanding and unredeemed do not at any one time exceed the sum of seventy-five thousand dollars. Such bonds shall be known as railroad paving bonds, and shall be of such denomination as the common council shall determine and bear interest at not exceeding the legal rate and mature in sums of not exceeding seven thousand dollars in any year. Said bonds shall be signed by the mayor and city clerk, and sealed with the city seal. The common council shall convert said bonds into money at not less than their par value, or may obtain temporary loans on the same, and the proceeds therefrom Application shall be used only for the payment of the obligations of the ceeds. city of Yonkers for paving the portion of its streets lying between the tracks and two feet on each side of the tracks of the street surface railroad or railroads now or hereafter to be built in the streets of said city. AN ACT to authorize the board of police and fire commissioners
of the city of Utica, and the city of Utica, to raise money for
the purpose of better equipping its fire department.

of this act, to prepare and furnish an estimate or statement to the common council of the city of Utica, of the amount of money which they deem immediately necessary for the better equip ment of the fire department of the city of Utica, and for the purchase of such necessary implements, machinery, engines and other necessary equipments for the purpose of enabling the fire department of the city to put out fires, and properly discharge its duties. Such estimate or amount, however, shall not exceed the sum of fifteen thousand dollars.

§ 2. The common council of the city of Utica shall, at the same or next meeting of said common council, when it receives the statement or amount referred to in the preceding section, from the police and fire commissioners of said city, cause to be issued bonds, which shall be known as the "police and fire commissioners' bonds;" said bonds shall be three in number, of five thousand dollars each; the first of which shall be payable November first, eighteen hundred and ninety-four; the second November first eighteen hundred and ninety-five, and the third November first eighteen hundred and ninety-six, and shall bear interest at a rate to be approved by the common council, vot exceeding five per centum per annum, and shall specify the pur pose for which they are issued. Such bonds shall be executed by the mayor and city clerk, under the corporate seal of said city, and shall be issued at not less than the par value thereof. Said bonds shall then be negotiated and sold by the mayor and clerk of the city of Utica, and the proceeds thereof shall be paid to the city treasurer of the city of Utica, there to remain subject to the draft of the police and fire commissioners, drawn as now provided.

§ 3. The common council of the city of Utica shall include in the annual tax levy of each year preceding the time when said bonds shall become due, a sufficient amount to pay each bond, with interest, and such amount shall be collected in the same manner as other moneys are collected for the purposes of the city of Utica.

§ 4. This act shall take effect immediately.

Chap. 15.

AN ACT to authorize the common council of the city of Rochester to raise money to provide for the deficiencies in the funds for the support of the public schools of said city.

BECAME a law February 8, 1894, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:
