Chap. 2.

'AN ACT to enable the city of Elmira to provide for its floating

indebtedness.

BECAME a law January 11, 1894, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The common council of the city of Elmira is hereby fund. authorized. to transfer to the credit of the general fund of the city of Elmira, so called, and to use as a part thereof, the sum of

five thousand dollars and all interest accrued thereon, which sind was included in the annual estimate of said common council in the year eighteen hundred eighty-nine, raised by tax and set aside for the purpose of raising a sum necessary to erect a city hall.

§ 2. The said common council is hereby authorized and empow. ered to audit bills in addition to those already authorized by law, and the mayor of said city is authorized and empowered to sign orders therefor against said general fund, and street fund, of said city of Elmira, in an amount not exceeding ten thousand dollars and the amount specified in the first section hereof, for the pur pose of paying the necessary expenses and obligations of the city during the year eighteen hundred and ninety-three and eighteen hundred and ninety-four, said amount being a part of the sum to be used in paying the floating indebtedness of the said city not sufficiently provided for in the annual estimate of the council for eighteen hundred ninety-three, and by the bonds of said city authorized and issued under chapter six hundred eighty-five of the laws of eighteen hundred ninety-two, as amended by chapters one hundred twenty-two and four hundred sixty-six of the laws of eighteen hundred ninety-three.

§ 3. The said amount of ten thousand dollars, or such part thereof as shall be used, shall be raised by the annual tax levy of the city of Elmira in eighteen hundred ninety-four in addition to the amount that shall be raised pursuant to section thirtytwo of an act entitled "An act to amend and consolidate the several acts relating to the city of Elmira passed May seven

§ 4. This act shall take effect immediately.

AN ACT making an appropriation for repairs to the Binghamton

state hospital.

BECAME a law January 12, 1894, with the approval of the Governor. Passed, three-fifths being present.

AN ACT to authorize the common council of the city of Rochester to raise money for the temporary and immediate wants and necessities of the board of park commissioners of said city. BECAME a law January 18, 1894, with the approval of the Governor. Passed, three-fifths boing present.

AN ACT to authorize the city of Kingston hospital to borrow money and to mortgage its real estate.

RECAME a law January 20, 1894, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The city of Kingston hospital is hereby authorized to borrow the sum of five thousand dollars for the purpose of completing and furnishing its building in the city of Kingston, Ulster county, New York; and, in order to secure the payment of said sum, to execute its bond and a mortgage upon the real estate owned by said corporation.

§ 2. This act shall take effect immediately,

Chap. 6.

AN ACT to provide for the raising of money, for public improvements, in the city of Jamestown.

BECAME a law January 23, 1894, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The common council of the city of Jamestown is hereby given authority to issue the bond, promissory note, certificate of indebtedness or other obligation which they may deem proper and expedient in the name of the city, for the purpose of borrowing for said city and its use a sum of money not exceeding ten thousand dollars, to be used by and under the direction of the common council aforesaid, in the grading of streets and public improvements for said city and its inhabitants, as said common council in its discretion, shall deem the best interests of

said city require. Such moneys need not all be borrowed at one time or by one form of obligation; but the common council may borrow the same and issue therefor the obligation or obligations of the city from time to time and in such sum or sums as they shall deem advisable, not exceeding ten thousand dollars in the aggregate. Said obligations shall bear interest not exceeding Interest, six per cent per annum, and shall not be for a longer term than able, etc. five years and shall not be sold for less than par, and when so issued, negotiated and delivered by authority of said common council, shall be a valid and legal obligation against the said city of Jamestown.

§ 2. The common council of said city shall have the power and Tax. authority and it shall be their duty to levy and collect said moneys from the taxable property and inhabitants of said city as other taxes against said city are levied and collected, at such time and in such amounts as they shall deem proper, except such portion as shall be paid from the street or general fund as hereinafter provided.

§ 3. The said common council may cause to be paid from the Payment street or general fund of said city any or all of said moneys so or general borrowed if in their judgment either of said funds will be suf ficient therefor after taking care of the expenses of said city for which said funds are provided.

§ 4. This act shall take effect immediately.

Chap. 7.

AN ACT to legalize, ratify and confirm the action and vote of the taxpayers of the city of Jamestown in the state of New York, and the action and proceedings of the officers of said city in respect to constructing and operating by said city an addition to its electric-light plant and providing for raising of money for the payment of the same.

of May eighteen hundred and ninety-three, and the proceedings of the officers of said city, had and taken prior to and providing for the holding of the same, and the notice of such meeting and election, and the form of ballots used thereat, are in all respects hereby legalized, ratified and confirmed, and shall for all purposes whatsoever be held and deemed as legal and valid as though such action and proceedings and meeting and election notice and ballots had in all respects been in form and had been done, made and taken as provided by the charter of said city and as though the common council of said city had duly prescribed the form of such ballots and the same had been duly incorporated in the notice of such special meeting and election and published therewith as required by such charter.

§ 2. Said city of Jamestown, is hereby authorized to issue the bonds recommended by the board of public works of said city, in and by their report bearing date April third, eighteen hundred and ninety-three, upon the subject of electric-lighting, and voted to be issued at the meeting and election held in said city on the said first day of May eighteen hundred and ninety-three, in the same manner as and by the same officers who are authorized to issue bonds in behalf of said city, and when so issued said bonds shall become and be a valid legal obligation of said city of Jamestown, to be paid in the same manner as other bonded indebtedness of said city.

§ 3. This act shall take effect immediately.

AN ACT to amend chapter one hundred and two of the laws of eighteen hundred and ninety-three, entitled "An act to lay out, establish and regulate a public driveway in the city of New York."
