Duties.

§ 4. Chapter two hundred and four of the laws of eighteen hundred and sixty-four, is amended by adding thereto a new title to be known as title twelve and to read as follows:

TITLE XII.

Village Attorney.

Section 1. Within fifteen days after the passage of this act, the board of trustees shall meet and appoint an attorney for said village, who shall hold such office until the first Monday in April, in the year eighteen hundred and ninety-five; and on the first Monday in April, in each year thereafter, said board of trus tees shall meet and appoint for the term of one year, an attorney for said village to transact and do the law business of said village and of the several departments thereof, and to prosecute and defend all actions, suits or proceedings in which the said village is interested, and the attorney so appointed by said board shall be the legal adviser of the said village and of all the depart ments thereof, and he shall be entitled to receive from said village the sum of one thousand dollars per year for his services. § 5. Section six of title seven of chapter two hundred and four of the laws of eighteen hundred and sixty-four, as amended by section six of chapter five hundred and twenty-three of the laws of eighteen hundred and seventy-nine, as amended by section eleven of chapter four hundred and five of the laws of eighteen hundred and ninety-two, is hereby amended so as to read as follows:

§ 6. The board of trustees of the said village are authorized to raise annually by tax, at the time and in the manner that other taxes are levied and collected in said village, the sum of four thousand dollars, which, together with two thousand five hundred dollars, to be drawn from the six-mill fund, or such part thereof as may be required to pay the estimates of the board of

fire commissioners, to be made as hereinafter provided, shall be set apart annually as the fire department fund. All bills for Audit and necessary expenditures connected with the said fire department, not exceeding, however, in any one year, the amount of the fire department fund, shall be audited by the board of fire commissioners and paid by the treasurer of the said village, and out of the said fire department fund, on the warrant of the board of fire commissioners, signed by the president and the clerk thereof. The Annual board of fire commissioners shall on or before the third Monday expenses. in November, in each year, make and submit to the board of trustees of the said village, an itemized estimate of the amount of money required to pay the expenses of the fire department for the ensuing year. The board of fire commissioners shall also, on or Annual before the third Monday in February in each year, present to trustees. the board of trustees of the said village a report showing a complete inventory of all the property under their charge, which report shall also exhibit a particular statement of all fire alarms and fires which have occurred in said village during the preceding year, together with the cause of all such fires, as far as the same shall have been ascertained. It shall also exhibit a particular statement of losses caused by said fires and all insurance thereon. It shall also show the number of feet of hose which shall have been used, and also designate the source from whence the supply of water was derived, and also present the names of all the members and officers of the fire department, and likewise the names of the companies of firemen, and also the names of all the persons employed by the board of fire commissioners and the compensation paid them, and a statement of all expenses paid or incurred by the fire department during the year; also, a statement of all moneys received by the fire commissioners, and such other information relating to the fire department as shall seem important to the fire commissioners.

§ 6. Section two of title seven of chapter two hundred and four of the laws of eighteen hundred and sixty-four, as amended by section six of chapter ten of the laws of eighteen hundred and seventy-four, as amended by section twelve of chapter four hundred and five of the laws of eighteen hundred and ninety-two, is hereby amended so as to read as follows:

and every other person who shall at the time of a fire in the said village be guilty of riotous or disorderly conduct, or which shall tend to obstruct the operation of the fire department or to incite insubordination in others, or willfully attempt to obstruct the execution of any orders of an officer of the fire department, shall, for such an offense, be liable to such penalty as shall be prescribed by the by-laws of the fire department, not exceeding one hundred dollars, and also be deemed guilty of a misdemeanor, punishable by fine or imprisonment, or both, as the court may direct, on conviction of such offense.

§ 7. Section nine of title seven of chapter two hundred and four of the laws of eighteen hundred and sixty-four, as amended by section seven of chapter five hundred and twenty-three of the laws of eighteen hundred and seventy-nine, as amended by section thirteen of chapter four hundred and five of the laws of eighteen hundred and ninety-two, is hereby amended so as to read as follows:

§ 9. The board of fire commissioners of the said village shall keep a record book, in which shall be entered every dismissal and resignation of a member of the department, and the board of tire commissioners shall appoint competent persons to fill such vacancies as shall, from time to time, occur in the positions of firemen Register of and employes. Vacancies, § 8. Every vacancy in the office of fire commissioner of such village, filled since January first, eighteen hundred and ninety four, and before the passage of this act, shall be deemed to have been filled for the balance of such unexpired term, and every vacancy filled after the passage of this act, shall be filled for the unexpired term only.

§ 15. Before the charter election in the said village, to be held Election on the first Tuesday in March, eighteen hundred and ninety-four, and before the charter election in said village in each year thereafter, it shall be the duty of the board of trustees of the said village to divide each of the four wards in the said village into two election districts, which shall contain as nearly as may be the same number of voters; and to designate the polling places in the said election districts. The board of trustees shall appoint Inspectors, before the first Tuesday in March, eighteen hundred and ninety- appointfour, and before the charter election in said village in each year thereafter, four inspectors of election to serve at the charter election then next following in said village. Not more than two of the said inspectors of election in each election district shall be members of the same political party. The said inspectors of election shall be men of good character and residents of the elec tion districts in which they shall perform the duties of inspectors of election and shall be competent to cast accounts and to read and write the English language understandingly, and they shall designate one of their number to act as ballot clerk. Said How inspectors shall be selected from the two political parties casting the greatest number of votes in the town of Lansingburgh at the last general election held therein, and shall be chosen from a list of qualified electors submitted to the said trustees by the presiding officers of the two principal political organization of said town. Said lists so presented for appointment as inspectors to the board of trustees shall contain the names of not less than ten persons from each election district in said village. In case of the failure of such political organizations to furnish such lists as aforesaid, the board of trustees shall have power and it shall be their duty to appoint such inspectors from persons known to them to be of the political party or parties failing to present such list or lists. It shall also be the duty of the board of trustees to appoint two Poll clerks. poll clerks in each election district who shall be members of different political parties. required by law to be taken by inspectors of election and poll Chairman clerks, and shall select by lot or agreement from the inspectors representing the political party casting the largest vote at the last general election in said town, a chairman for said board, and the said inspectors of election shall open the polls in the said village at sunrise and receive the ballot of all qualified elect tors, and deposit them in the ballot boxes, and close the polls of the said election at four o'clock in the afternoon. On the closing of the polls, the inspectors of election shall open the ballot boxes and count and compare with the poll-lists the number of ballots, as required by law, and shall then, in the manner provided by law, proceed to canvass the votes cast and ascertain the result of the said canvass, which they shall declare, and make due returns thereof, and they shall not leave the polling place until they have publicly declared the result and made and signed the returns. They shall immediately proceed with said returns to the office of the clerk of said village, whose duty it shall be to be in his office in the said village, Canvass by at that time, and to receive and record the same. The board of trustees of said village shall, within forty-eight hours after the close of the polls, meet and proceed to canvass said returns, and shall make a certificate stating the results of the said canvass Certificate and declaring what persons have been elected, and shall cause the said certificate to be recorded in the book of minutes of the proceedings of the said trustees. It shall then be the duty of the said clerk to notify immediately in writing each of the said persons of his election.

10. The next annual town meeting of the town of Lansingburgh shall be held at some suitable place in said town, to be designated by the town board of such town.

§ 11. The officers, or any thereof, hereinbefore provided to be chosen or elected by the board of trustees of the said village, may be so chosen or elected at any regular meeting thereof, or at any special or adjourned meeting held within or at the time hereinbefore provided. Any such special meeting may be called by the clerk of said village on request in writing of four trustees, and notice thereof shall be given by said clerk to the members of said board, either personally or by mailing the same at Lansingburgh, addressed to them at their respective places of residences or business, at least twenty-four hours before such meeting.
