Salary of recorder.

Chap. 57.

AN ACT to amend chapter seven hundred and fourteen of the laws of eighteen hundred and sixty-nine entitled "An act to incorporate the city of Watertown" as amended by chapter five hundred and seventeen of the laws of eighteen hundred and seventy-nine relating to the salary of the recorder of said city. BECAME a law February 26, 194, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section 15 of chapter seven hundred and fourteen of the laws of eighteen hundred and sixty-nine entitled "An act to incorporate the city of Watertown " as amended by chapter five hundred and seventeen of the laws of eighteen hundred and seventy-nine is hereby amended so as to read as follows:

§ 15. The salary of the recorder of the city of Watertown, from and after January first eighteen hundred and ninety-four, shall be one thousand dollars per annum, payable in the same manner as the salary of the said recorder is now payable.

AN ACT to amend chapter two hundred and thirty of the laws of one thousand eight hundred and ninety-three entitled "An act to provide for the erection and furnishing of a new courthouse in the city of Troy, for the use of the county of Rensselaer, and to provide means to defray the expenses thereof." BECAME a law February 26, 1894, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section ten of chapter two hundred and thirty of the laws of eighteen hundred and ninety-three, entitled, “An act to provide for the erection and furnishing of a new court-house in the city of Troy, for the use of the county of Rensselaer, and to provide means to defray the expense thereof," is hereby amended so as to read as follows:

§ 10. It shall be the duty of the board of supervisors of the said county of Rensselaer, to borrow upon the faith and credit

of said county, such a sum of money as shall be sufficient to meet and pay all the expenditures which the said board of commissioners is authorized by this act to make, and to issue the bonds of the said county therefor, bearing interest at a rate not exceeding three and a half per centum per annum, payable semi-annually; the principal of said bonds shall be payable at such time and Principal, times within fifty years from their respective date of issue, and able. in such amount in each and every year from the date of issue, as shall be fixed and determined by the board of supervisors of said county, excepting, however, that not less than six thousand dollars of the principal of said bonds shall be made payable and shall be paid in each and every year from and after the first day of April eighteen hundred and ninety-five, and none of the said bonds shall be renewed when due. Said bonds shall be of Bonds, how executed, the denomination of not less than one thousand dollars. Each etc. shall be signed by the county treasurer of the said county of Rensselaer, and countersigned by the chairman of the board of supervisors of said county, and the seal of the said board of supervisors shall be affixed to each of said bonds by the county treasurer. Said bonds shall be issued and negotiated by the county treasurer of said county as hereinafter provided, as the proceeds thereof shall be required by said board of commissioners for the purposes provided for in this act. Said bonds shall be registered in the office of the county treasurer and shall be payable at that office. The county treasurer shall keep a separate Disposition account of the moneys raised upon said bonds, and shall pay ceeds. therefrom upon the order of said board of commissioners, from time to time, such amounts as shall be required to pay the expenditures which said board of commissioners are empowered by this act to make. Said bonds shall be negotiated by the Sale of county treasurer selling the same at his office to the highest bidder at public auction, or in such other manner as he may deem for the best interests of the county at not less than the par value thereof. Said county treasurer shall give public notice of the time and place of any sale of such bonds by public auction and of any reception and opening of sealed proposals therefor, by publishing a notice thereof for at least fifteen days previous to each sale or opening, in the newspapers published in the county of Rensselaer designated by the board of supervisors of said county for the publication of official notices. Advances county treasurer of said county is hereby authorized to make advances for the necessary expenditures of said board of commissioners on its order, from any funds of the county in his pos session, prior to the issuing of the bonds herein authorized, and to be reimbursed from the proceeds of any subsequent sale of said bonds.

§ 2. Section twelve of said chapter two hundred and thirty of the laws of eighteen hundred and ninety-three, is hereby amended so as to read as follows:

§ 12. The whole amount to be expended by said board of com missioners, by virtue of this act, in the erection, completion and furnishing of said new court-house, the procuring of lands there for, and in paying for the services of the clerk, architect, super intendent and assistant, and all other necessary expenses per taining to the building or construction thereof shall not exceed the sum of three hundred and fifteen thousand dollars. § 3. This act shall take effect immediately.

AN ACT to provide for the better administration of justice in the town of Halfmoon, in the county of Saratoga.

BECAME a law February 27, 1894, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. There shall be elected in the town of Halfmoon, in the county of Saratoga, an officer to be designated the police justice of the town of Halfmoon. Such officer shall be elected at the same time and in the same manner as other town officers of said town are elected, and hold his office for the term of two years from and including the first day of April next succeeding his election; but no person shall hold the office of justice of the peace and that of police justice of said town at the same time, except in the cases provided for in section seven of this act. officers; and until any vacancy shall be so filled the supervisor, town clerk and assessors of said town, by warrant signed by a majority of such officers, shall appoint a resident elector of said town, other than a justice of the peace, to fill such vacancy. All such appointments shall take effect immediately and continue in force until and including the last day of March next after the next succeeding election of town officers in said town. A justice Justice of of the peace appointed police justice, as provided in section pointed seven of this act, shall immediately enter upon the duties of such office and serve during the continuance of the disability of the police justice; and during the time of such service he shall be the police justice of said town, but he shall be designated the acting police justice of the town of Halfmoon, which title he shall affix to all official papers signed by him. § 3. The police justice of said town shall be a resident elector thereof. He shall provide and maintain a proper and suitable office in some central and convenient place in that part of the office. village of Mechanicville that lies in said town, and not elsewhere. Before entering upon the duties of his office, and within ten Oath of days after his election or appointment to fill a vacancy, he shall take and subscribe the constitutional oath of office before, and file the same with, the clerk of the county of Saratoga. And also, official within said time, he shall file in the office of the clerk of said town a bond to the people of the state of New York, in the penal sum of one thousand dollars, executed by himself and two sufficient sureties approved thereon, in writing by the supervisor of said town, conditioned that said police justice will faithfully discharge the duties of his office, and well and truly account for and pay over to said supervisors, or his successors, for the use and benefit of said town, all moneys which shall be received or collected by him by virtue of his office, in the manner and at

to file such oath or bond within the time herein required, shall create a vacancy in said office otherwise than by expiration of term.

§ 4. Such police justice shall have and exercise the same in criminal powers, authority and jurisdiction in all criminal matters, actions and proceedings, including special proceedings of a criminal nature, as justices of the peace of said town now have, or which may hereafter be conferred on such justices of the peace, and be subject to the same duties and liabilities in respect thereto as such justices of the peace. The court held by such police justice shall be designated the police court of the town of Halfmoon. Such court shall have and exercise the same powers, authority and jurisdiction as courts of special sessions now have, or which may hereafter be conferred on said courts. The police justice shall not be entitled to receive any fees or costs for services rendered by him; but in lieu thereof he shall receive an annual salary of five hundred dollars, which shall be audited, levied and paid by said town in the same manner as other town charges. Such salary shall include all charges and expenses for providing, maintaining, heating, lighting and furnishing the office of the police justice, and for all books, blanks and stationery.

§ 5. The police justice shall keep a record or docket of all pro ceedings had before him, and enter therein the names of all per sons arrested and brought before him, on what charge and by whom arrested, whether arrested with or without warrant, the names of the complainants, all proceedings in, and the final dis position of each case, and in case of fine the amount thereof and when paid to the supervisor; and also the date and dates of all such proceedings; which record or docket shall always be open to the inspection of any taxpayer of said town. He also shall prepare a copy of such record or docket, and duly verify and present the same to the board of town auditors of said town, on the first day of its second meeting in each year.

§ 6. Such police justice shall pay over to the supervisor of said town, for the use and benefit thereof, on or before the fifth day of each month, all moneys he shall have received or collected by virtue of his office during the preceding month, and shall accom pany the same with his affidavit that such payment includes all the moneys received or collected by him as aforesaid.
