As a member of the canvassing board of elections the supervisor must record, in books kept for the purpose, certificates of the results of the canvasses in general and primary elections. (43)

Provision has been made since 1889 for the transfer of all the records of the supervisor to his successor in office. (44)

XXVI. COUNTY CANVASSING BOARD

A county canvassing board has functioned in Clay county since its creation. Until 1868 the board was composed of the judge of probate and two or more inspectors of election. (1) From 1868 to 1887 it was composed of the clerk of the circuit court, the county judge, and any justice of the peace in the county. The sheriff could serve as a member of the board if the clerk or judge could not, or would not, serve. (2) Since 1387 the board has been composed of the chairman of the board of county commissioners, the county judge, and the supervisor of registration. Any of these officials who cannot, or will not, act may be replaced by another member of the board of county commissioners. (3)

The county canvassing board was required to meet at the courthouse on the third day after an election until 1868.(4) From 1868 to 1929 the board was required to meet on the sixth day after an election, or sooner if returns from all precincts were in. Since 1929 the board has been required to meet on the third day after a primary election, although it continues to meet on the sixth day after other elections. (5)

It is, and has, been, primarily the duty of the board publicly to open and to canvass the returns of elections. Between 1861 and 1868 no

returns were to be rejected or thrown out for any cause whatever, except fraud. From 1868 to 1877 the canvass was to be made "as shown by the returns on file" in the offices of the clerk of the circuit court and county judge, while since the latter date the canvass must be made "solely and entirely" from such returns, and in no case may the board vary or change the returns of inspectors. (6) Between 1861 and 1868 the board might surmon witnesses to enable it to ascertain what the true state of the poll and count was and should be, for which purpose the judge of probate might issue all necessary process to compel the attendance of any inspector, clerk, or other witness. (7)

Until 1868 the canvassing board, having completed the county canvass, was required to prepare a triplicate certificate of its findings. copy of the certificate was to remain on file with the judge of probate. If the certificate contained returns of the vote for Governor, the other two copies were sent, by different rails, to the Speaker of the House of Representatives. If the certificate contained returns of the vote for a Representative in Congress, a State Senator, or Presidential Electors, the other two copies were sent, by different mails, to the Secretary of State. (8)

From 1868 to 1887 the law required the county canvassing board to prepare a duplicate certificate of its findings. The certificate was required to be recorded "in a book to be kept ... for that purpose" by the clerk of the circuit court. The board was required to send one copy of the certificate to the Governor, the other to the Secretary of State. (9)

From 1887 to 1899 the board was required to make two certificates in duplicate, one for returns for state and county officers and the other for Representatives in Congress and Presidential Electors. Both certificates were to be recorded by the supervisor "in a book to be kept ... for that purpose." One copy of each certificate was to be sent to the Governor and the other copy to the Secretary of State. (10) Since 1899 the board has been required to certify all returns on one certificate, sending copies of the certificate to the Governor and the Secretary of State after having had the certificates recorded in the supervisor of registration's
