1 MR. CHIEF JUSTICE WARREN served under a recess appointment from October 5, 1953 until March 2, 1954. (See 346 U. S. IV, VII.) His nomination was sent to the Senate by President Eisenhower on January 11, 1954; the nomination was confirmed on March 1, 1954; and a new commission was issued to him under date of March 2, 1954. See post, p. VII.

2 Mr. Simon E. Sobeloff, of Maryland, was nominated to be Solicitor General by President Eisenhower on January 22, 1954; the nomination was confirmed by the Senate on February 9, 1954; he was commissioned on February 10, 1954; and he took the oath and entered on duty on February 25, 1954. During the vacancy which had existed since the resignation of Solicitor General Cummings effective March 1, 1953 (see 344 U. S. iv, n. 3), the duties of the office of Solicitor General were performed by Mr. Robert L. Stern, First Assistant to the Solicitor General, who signed government briefs and appeared as "Acting Solicitor General."

ALLOTMENT OF JUSTICES.

It is ordered that the following allotment be made of the Chief Justice and Associate Justices of this Court among the circuits, pursuant to Title 28, United States. Code, section 42, and that such allotment be entered of record, viz:
